LAWS RELATED TO COMMUNITY DEVELOPMENT

Laws are very important in a community development for it serves as a norm of


conduct.

LAWS AND EXECUTIVE ISSUANCES

REPUBLIC ACTS:

RA 11201 -Department of Human Settlements and Urban Development Act


It shall be the sole and main planning and policy-making, regulatory, program coordination, and
performance monitoring entity for all housing, human settlement and urban development concerns,
primarily focusing on the access to and the affordability of basic human needs. It shall develop and
adopt a national strategy to immediately address the provision of adequate and affordable housing
to all Filipinos, and shall ensure the alignment of the policies, programs, and projects of all its
attached agencies to facilitate the achievement of this objective.

RA 10884 -Balanced Housing Development Program Amendments


An Act Strengthening the Balanced Housing Development Program, Amending for the Purpose
Republic Act No. 7279, as Amended, Otherwise Known as the Urban Development and Housing Act
of 1992.

RA 9904 -Magna Carta for Homeowners and Homeowners Association (2010)


AN ACT PROVIDING FOR A MAGNA CARTA FOR HOMEOWNERS AND HOMEOWNERS'
ASSOCIATIONS, AND FOR OTHER PURPOSES. It fulfills the constitutional principles directing
the state to encourage, promote and respect non-governmental, community-based and people's
organizations in serving their legitimate collective interests in our participatory democracy.
RA 9653 -Rent Control Act of 2009
AN ACT ESTABLISHING REFORMS IN THE REGULATION OF RENT OF CERTAIN
RESIDENTIAL UNITS, PROVIDING THE MECHANISMS THEREFOR AND FOR OTHER
PURPOSES. It states that the lessor or the landlord is not allowed to increase the rent more than
seven (7) % annually if the unit is occupied by the same tenant. The lessor is only allowed to
change the rate for new tenants once the unit becomes vacant.
RA 9507 -Socialized and Low-Cost Housing Loan Restructuring of 2008
AN ACT TO ESTABLISH A SOCIALIZED AND LOW-COST HOUSING LOAN RESTRUCTURING
AND CONDONATION PROGRAM, PROVIDING THE MECHANISMS THEREFOR, AND FOR
OTHER PURPOSES. \ It is the policy of the State to undertake a continuing program of urban
land reform and housing that will make available at affordable cost decent housing to
underprivileged and homeless citizens.
RA 9397 -Disposition of Lands for Socialized Housing (2007)
AN ACT AMENDING SECTION 12 OF REPUBLIC ACT NO. 7279, OTHERWISE KNOWN AS THE
URBAN DEVELOPMENT AND HOUSING ACT OF 1992, AND FOR OTHER PURPOSES.
The National Housing Authority, with respect to lands belonging to the National Government, and the
local government units with respect to the other lands within their respective localities, shall
coordinate with each other to formulate and make available various alternative schemes for the
disposition of lands to the beneficiaries of the Program.

RA 9341 -Rent Control Act of 2005


AN ACT ESTABLISHING REFORMS IN THE REGULATION OF RENT OF CERTAIN
RESIDENTIAL UNITS, PROVIDING THE MECHANISMS THEREFOR AND FOR OTHER
PURPOSES. The State shall, for the common good, undertake a continuing program of encouraging
the development of affordable housing for the lower income brackets. Toward this end, the State
shall continue to protect housing tenants in the lower income brackets from unreasonable rent
increases.
RA 8501 -Housing Loan Condonation Act of 1998
AN ACT TO RESCUE THE NATIONAL SHELTER PROGRAM OF THE GOVERNMENT BY
CONDONING THE PENALTIES ON ALL OUTSTANDING/DELINQUENT HOUSING LOAN
ACCOUNTS WITH ANY OF THE GOVERNMENT INSTITUTIONS AND AGENCIES INVOLVED IN
THE NATIONAL SHELTER PROGRAM AND BY AMENDING PRESIDENTIAL DECREE NO. 1752,
AS AMENDED. It was enacted to rescue the National Shelter Program of the government by condoning
the penalties on all outstanding / delinquent housing loan accounts with any of the government
institutions and agencies involved in the National Shelter Program.

RA 8437 =Rent Control Law of 1997


AN ACT FURTHER EXTENDING THE RENT CONTROL PERIOD FOR CERTAIN RESIDENTIAL
UNITS AMENDING THEREBY BATAS PAMBANSA BLG. 877 ENTITLED: "AN ACT PROVIDING
FOR THE STABILIZATION AND REGULATION OF RENTALS OF CERTAIN RESIDENTIAL UNITS,
AND FOR OTHER PURPOSES, AS AMENDED"

RA 8368 =Anti Squatting Law Repeal Act of 1997


AN ACT REPEALING PRESIDENTIAL DECREE NO. 772, ENTITLED "PENALIZING SQUATTING
AND OTHER SIMILAR ACTS."

Squatting is the action of occupying an abandoned or unoccupied area of land or a


building, usually residential, that the squatter does not own, rent or otherwise have
lawful permission to use.

RA 7835 -Comprehensive and Integrated Shelter Financing Act of 1994


AN ACT PROVIDING FOR A COMPREHENSIVE AND INTEGRATED SHELTER AND. URBAN
DEVELOPMENT FINANCING PROGRAM BY INCREASING AND. REGULARIZING THE
YEARLY APPROPRIATION OF THE MAJOR COMPONENTS. OF THE NATIONAL SHELTER
PROGRAM, INCLUDING THE ABOT-KAYA. It is hereby declared a policy of the State to
undertake, in cooperation with the private sector, a continuing program of urban land reform and
housing which will make available, at affordable cost, decent housing and basic services to
underprivileged and homeless citizens in urban centers and resettlement areas.
RA 7279 -Urban Development and Housing Act of 1992
AN ACT TO PROVIDE FOR A COMPREHENSIVE AND CONTINUING URBAN DEVELOPMENT AND HOUSING
PROGRAM, ESTABLISH THE MECHANISM FOR ITS IMPLEMENTATION, AND FOR OTHER PURPOSE. As
amended, states that it shall be the policy of the State to undertake, in cooperation with the
private sector, a comprehensive and continuing Urban Development and Housing Program
(Program). Improve the capability of local government units in undertaking urban development
and housing programs and projects
BP 220 -Economic and Socialized Housing (1982) batasang pambansa
AN ACT AUTHORIZING THE MINISTRY OF HUMAN SETTLEMENTS TO ESTABLISH AND PROMULGATE
DIFFERENT LEVELS OF STANDARDS AND TECHNICAL REQUIREMENTS FOR ECONOMIC AND SOCIALIZED
HOUSING PROJECTS IN URBAN AND RURAL AREAS FROM THOSE PROVIDED UNDER PRESIDENTIAL
DECREES NUMBERED NINE HUNDRED FIFTY-SEVEN, TWELVE HUNDRED SIXTEEN, TEN HUNDRED NINETY-
SIX AND ELEVEN HUNDRED EIGHTY-FIVE. It is a policy of the government to promote and
encourage the development of economic and socialized housing projects, primarily by
the private sector in order to make available adequate economic and socialized housing
units for averaged and low-income earners in urban and rural areas.

PD 1216 -Ammendments to Section 31 of PD 957 (1977)


DEFINING "OPEN SPACE" IN RESIDENTIAL SUBDIVISIONS AND AMENDING SECTION 31 OF
PRESIDENTIAL DECREE NO. 957 REQUIRING SUBDIVISION OWNERS TO PROVIDE ROADS,
ALLEYS, SIDEWALKS AND RESERVE OPEN SPACE FOR PARKS OR RECREATIONAL USE

It is the policy of the government to create and maintain a healthy environment in human
settlements by providing open spaces, roads, alleys, and sidewalks as may be deemed suitable
to enhance the quality of life of the residents therein
PD 957 -Subdivision and Condominium buyer’s Protective Decree (1976)
REGULATING THE SALE OF SUBDIVISION LOTS AND CONDOMINIUMS, PROVIDING
PENALTIES FOR VIOLATIONS THEREOF. It is initiated and signed by the late president
Ferdinand marcos on July 12, 1976 in Manila. The primary purpose of this law is to protect
buyers' welfare from all types of real estate misrepresentations. The state has passed to resolve
the numerous fraudulent reports about real estate problems in the country.

EXECUTIVE ORDERS:
Executive Order 272 Authorizing the Creation of the Social Housing Finance Corporation and
Directing the transfer of the Community Mortgage Program, Abot-Kaya Pabahay Fund
Program, and other social Housing Powers and Functions of the National Home
Mortgage Finance Corporation to the Social Housing Finance Corporation (2004).
Executive Order 105, s. 2002 Approving and Directing the Implementation of the
Program for “Provision of Group Home/Foster home for Neglected, Abandoned, Abused,
Detached and Poor Older Persons and Persons with Disabilities” (2002)
The housing program for the poor older persons and persons with disabilities includes the
establishment/donation of group/foster homes for the neglected, abused and unattached
or homeless older and disabled persons and those incapable of self-care including its
management, maintenance and operations.
The Social Security System (SSS), Government Service Insurance System (GSIS), Home
Development Mutual Fund (HDMF) and Land Bank of the Philippines (LBP) are hereby
directed to develop innovative financing/lending schemes for housing of poor aged and
disabled persons

Executive Order 20 Reaffirming Mass Housing as a Centerpiece Program in the Poverty


Alleviation efforts of the Government and further strengthening the Housing and Urban
Development Coordinating Council (2001)
The Housing and Urban Development Coordinating Council (HUDCC), under the immediate control and
supervision of the President of the Philippines, is charged with main function of coordinating the
activities of the government housing agencies to ensure the accomplishment of the National
Shelter Program.

Janmil:
Executive Order 258 Prescribing Time Standards in the Issuance of Permits for Housing
Projects (2000)
The following agencies of the national government shall adopt the following time standards in
the issuance of permits for housing projects:
a. Housing and Land Use Regulatory Board b. Department of Agriculture
c. Department of Agrarian Reform
d. Department of Environment and Natural Resources
e. Laguna Lake Development Authority (DENR attached)
f. Land Registration Authority (DOJ attached)
g. Local Government Units

Executive Order 45 Prescribing Time Periods for Issuance of Housing Related Certifications,
Clearances and Permits, and Imposing Sanctions for Failure to Observe the Same
(2001)
WHEREAS, in order to address urgent housing needs of the Filipino people and achieve the target of the
government housing program, it is imperative to strengthen the partnership between the
government and the private sector and fast-track the approval and implementation of housing
projects;

Executive Order 159 Declaring Mass Housing as Centerpiece Program of the Estrada
Administration and Constituting the Presidential Commission for Mass Housing (1999)
WHEREAS, the government has identified mass housing as one of the major components of the
Poverty Eradication Program of the Pres. Erap’s Administration. In line with the pro-poor
and pro-business orientation of the Estrada Administration, mass housing is hereby
declared as a centerpiece program of the government.

Executive Order 170 Establishing the Revolving Funds for Housing Projects of Local
Government Units (1999)

WHEREAS, housing is one of the fundamental needs of the nation’s poor;

WHEREAS, the national government supports the initiatives of local government units to
provide decent and affordable housing for their low-income constituents;

WHEREAS, the government’s main thrust is to eradicate poverty by providing support


services to the poor and the local government units that assist them;

Executive Order 129 Establishing an Institutional mechanism to Curtailment of the Activities of


the Professional Squatting Syndicates and Professional Squatters and Intensifying the
drive against them (1993)

WHEREAS, it is imperative to arrest the proliferation of squatters in the urban areas, which is
aggravated by the activities of squatting syndicates;

WHEREAS, there is a need to effect the identification and registration of the rightful beneficiaries of
the Urban Development and Housing Act (UDHA), who will be affected by the urgent infrastructure
projects of government as against professional squatters and squatting syndicates;
Edmar:
Executive Order 72 Providing for the Preparation and Implementation of Comprehensive Land
Use Plans of LOcal Government Units Pursuant to the Local Government Code of 1991
and other Pertinent Laws (1993)
Cities and municipalities shall continue to formulate or update their respective comprehensive
land use plans, in conformity with the land use planning and zoning standards and
guidelines prescribed by the HLRB pursuant to national policies.

Executive Order 71 Devolving the Powers of the Housing and Land use Regulatory Board to
approve Subdivision plans to Cities and Municipalities pursuant to R.A. no. 7160,
otherwise known as the Local Government Code of 1991 (1993)

Cities and municipalities shall heretofore assume the powers of the Housing and Land
Use Regulatory Board (HLRB) for example:

(a) Approval of preliminary as well as final subdivision schemes and development plans
of all subdivisions, residential, commercial, industrial and for other purposes of the public
and private sectors, in accordance with the provisions of P.D. No. 957 as amended and
its implementing standards, rules and regulations concerning approval of subdivision
plans;

Executive Order 357 Strengthening the Existing Coordinating Mechanism of the National
Shelter Program of the Government Under Executive Order No. 90, Dated December
17, 1986 (1989)
WHEREAS, to ensure the accomplishment of the National Shelter Program, it is necessary to strengthen
the existing coordinating mechanism of the National Shelter Program by delegating overall
administrative supervision over the key housing agencies, namely, the National Housing
Authority, the National Home Finance Corporation, the Housing and Land Use Regulatory Board,
and the Home Insurance and Guaranty Corporation, to the Housing and Urban Development
Coordinating Council acting as the Presidential arm on the National Shelter Program under the
direct control and supervision of the President of the Philippines;

Executive Order 90 Identifying the Government Agencies Essential for the National shelter
program and defineing their mandates, creating the Housing and Urban Development
Coordinating Council, Rationalizing funding sources and lending mechanisms for home
mortgages and for other purposes (1986)
The National Housing Authority shall be the sole government agency engaged in direct shelter
production. It shall focus its efforts in providing housing assistance to the lowest 30% of urban
income earners through slum upgrading, squatter relocation, development of sites and services
and construction of core-housing units.

This is to ensure the accomplishment of the National Shelter Program.
