SUBJECT: MEMORANDUM OF AGREEMENT FOR THE WATER ECOSYSTEM

REHABILITATION AND SUSTAINABILITY (WatERS) PROGRAM FOR
BARANGAY TIBAGON AND BARANGAY BONGABONG, MUNICIPALITY
OF PANTUKAN.

This refers to the Memorandum of Agreement to be entered into between and

among the DEPARTMENT OF PUBLIC WORKS AND HIGHWAYS, the DEPARTMENT
OF THE INTERIOR AND LOCAL GOVERNMENT and the PROVINCIAL GOVERNMENT
OF COMPOSTELA VALLEY. Re: Water System Rehabilitation and Sustainability
(WatERS) Program for Barangay Tibagon and Barangay Bongabong,
Municipality of Pantukan.

Perusing the content of the MOA, this office finds it to be valid, beneficial and
no legal infirmities. It is one of the basic yet important duties of the province as
provided under the General Welfare provision of the Local Government Code
of 1991.

However, the Province of Compostela Valley, being the proponent beneficiary,

shall ensure that the fund to be used is validly appropriated and readily
available upon the implementation of the forenamed MOA.

Finally, Sangguniang Panlalawigan legislative authority is necessary before the

Governor will sign the MOA as provided under Section 22 of Republic Act 7160.
The requested MOA have enumerated substantial responsibilities and that this
should be properly coordinated with the concerned party.
