Legal References for Risk Assessments

Employers, employees and contractors have certain general duties under the Occupational Health
and Safety Authority Act XXVII of 2000, as amended by Act XXXII of 2007; Legal Notice 426 of 2007;
and Act X of 2013. All parties must be aware of their obligations.

Article 6 of the ACT states that the employers must, as far as practicable, provide and maintain
working environments in which their employees are not exposed to hazards.

This duty includes:

 Provision and maintenance of safe systems of work

 Provision of necessary information, instruction, training and supervision of their employees

to enable them to perform their work safely

 Consultation and co-operation with employees regarding occupational safety and health at
the workplace

 Provision of adequate personal protective clothing and equipment, at no cost to all

employees

Article 7 of the ACT states that all employees must take reasonable care to safeguard one’s own
health and safety and that of other persons who may be affected because of the work carried out. It
shall be also the duty of every employee to co-operate with the employer on all matters relating to
health and safety.
