DEFINITION BY SOLMOND :
Tort means a civil Wrong for which the remedy is a common
law action for
unliquidated damages, and which is not exclusively the breach
of a contract or the
breach of a trust or other merely equitable obligation.

fixed by the law
: This duty is towards persons generally and its breach is
redressable by an
action for unliquidated damages.

Qui facit per alium facit per se is a Latin ---legal term that


means, “He who acts through another does the act himself.” It is
a fundamental legal maxim of the law of agency. It is a maxim
often stated in discussing the liability of employer for the act of
employee in terms of -- vicarious liability

-----Section 291 - Naa Paa Ta - Section 291 of IPC relates to

1. Trespass

Private nuisance is an unreasonable interference with


person’s right over wholesomeness Of land due to
emission of dust, offensive smell, fumes or noise,air or
water and Effluents

Essentials of Private Nuisance

1.Unreasonable interference 2. Interference with the use


or enjoyment of land 3. Damage

In Datta Mal Chiranji Lal v. Lodh Prasad, AIR 1960 - the


court held that the running of the mill amounted to a
private nuisance which should not be permitted

3Q) Trial Smelter Case


A Canadian company built a lead & zinc smelting plant at
Trail, British Columbia, 10 miles north of the state of
Washington border. The United States (P) sought damages
from Canada by taking it to court for the  air pollution caused.

The Trail Smelter arbitration is an example of one State


being liable to another for damage caused.

-It has resulted in two major principles:


(1)the state has a duty to prevent trans-boundary harm,
which is commonly expressed in the Latin maxim sic utere
tuo ut alilenum non laedas and
(2)the “polluter pays” principle, which holds that the
polluting state should pay compensation for the trans-
boundary harm it has caused. 

4Q) Noise pollution Rule & State Govt

---Under EP Act, 1986, Noise Pollution (Regulation and
Control) Rules, 2000 have been framed.
--However various laws have provisions related to Noise
such as :

The Police Act, 1861- Sec 30 (4) covers the problem of
noise arising from music played on streets

5)Sources of Water Pollution

Following are the two major sources of water


pollution:Point Source: They are the source of pollution
from single Identified location.e.g. Discharge from
domestic, commercial, and small industrial water into
sewer.Waste water generated from industries e.g. dye,
textile

Non-Point Source (Diffused Source):Those sources whose


location cannot be easily Identified are called diffused
sources.The pollutants are scattered on the ground
ultimately reach the water source and cause water
pollution.Air Pollution gets dissolved in rain water and
contaminate the ground water as well as surface water
source -------------

The sources of water pollution can be classified as


Municipal Waste Water,,Industrial Waste,,Inorganic
Pollutants,,Organic Pollutants,,Agricultural Wastes,,Marine
Pollution,,Thermal pollution

Ratlam Municipal Council vsVardhichand[AIR 1980 SC


1622] • 
This case concerns the Ratlam municipality's obligations to its
people under Section 123 M. P. Municipalities Act of
1961----------
The Supreme Court had introduced the concept of PIL for
the first time and had stated that a responsible Municipal
Council constituted for the precise purpose of preserving
public health, cannot run away from its principal duty by
pleading financial inability.

7. S.Jagannath V/s UOI


In this case the petitioner (a non-profit organisation)
sought the enforcement of the Costal Regulatory Zone
Notification, 1991 before the Supreme Court of India. The
petitioner argued that intensive and semi-intensive shrimp
farming in the ecologically fragile coastal areas must be
prohibited.
1. ---The Court held in favour of the petitioner that
shrimp farms do not need waterfront facilities. Further,
the Court observed that the purpose of the CRZ
Notification is to protect the fragile coastal areas, and
those activities that cause environmental degradation
cannot be permitted.
8Q) Reasons for declaring certain wild animals as vermin

In some areas, Poisonous & harmful animals that are over


populated in an area were declared vermin 

In India, wild animals can be declared as vermin if they


have become (i) dangerous to human life or property
(including standing crops on any land). 

9What is Ozone layer and reason for the depletion of


ozone layer

The ozone layer is an area in the stratosphere where


ozone is highly concentrated. It absorbs most of the UV
rays from the sun. Ozone – molecule made of 3 oxygen
atoms.

Ozone depletion: -- the gradual thinning of the ozone layer

Reasons Ozone Layer Depletion • The main cause of


ozone layer depletion was the emission of CFCs
(Chloroflurocarbons) containing chlorine. • CFCs escape
into the atmosphere from refrigeration and propellant
devices and other chemical processes • CFCs eventually
end up in the stratosphere, where UV light breaks the
bond holding chlorine atoms (Cl) to the CFC molecule. • A
free chlorine atom goes on to participate in a series of
chemical reactions that both destroy ozone and return the
free chlorine atom to the atmosphere to cause more
damage.

10Q)National forest policy 1988 • Salient features:


--Maintenance of environmental stability through
preservation and restoration of the ecological balance.--
Conservation of natural heritage of country by preserving
remaining forests. --Checking soil erosion and extension
of sand dunes. --Increasing forest cover by afforestation.
--Meeting basic requirements of people (fuel,timber,food)
-- Efficient utilization of forest produce. -- For conservation
of biological diversity, a network of national parks,
sanctuaries, biosphere reserves and other protected areas
should be extended and properly managed.
