8 IDENTIFICATION SYSTEM IN ALL THE BARANGAYS IN
9 BUTUAN CITY, AND FOR OTHER PURPOSES

15 EXPLANATORY NOTE

17 WHEREAS, Section 16 of Republic Act No. 7160, also known as the Local
18Government Code of 1991, provides:
19
20 “Every local government unit shall exercise the powers
21 expressly granted, those necessarily implied therefrom, as well as
22 powers necessary, appropriate, or incidental for its efficient and
23 effective governance, and those which are essential to the promotion
24 of the general welfare.”
25
26 WHEREAS, the institutionalization of the Barangay Identification System
27will improve the delivery of basic services in the Barangay, making it faster, more
28efficient, and more convenient on the part of the residents, and will contribute to
29the maintenance of peace and order;

31 WHEREAS, the Barangay Identification System will enable the Barangay
32to establish a Barangay Information System, the entries of which can be used by
33the Barangay Council in crafting policies, programs, and projects to advance the
34welfare of the residents;

36 WHEREAS, the said identification system will hasten and simplify the
37processing and release of other Barangay documents, such as Barangay Clearance,
38Certifications, and the like, as the information of all the inhabitants in the Barangay
39are already available in the information system;

41 WHEREAS, the Barangay Identification Card will be of great help to those
42who do not possess any valid identification cards, since the same shall be
43recognized and accepted in all public and private offices within the city of Butuan.

45 BE IT ENACTED by the Sangguniang Panlungsod of Butuan in session
46assembled and by authority of the same that:

48Section
1. Title - This Ordinance shall be known as the “BARANGAY ID
49SYSTEM ORDINANCE.”
50
51Section 2. Scope and Definition – The Barangay Identification System shall cover
52all residents (permanent and/or transient) of the Barangay. For the purpose of this
53Ordinance, a resident shall refer to an actual inhabitant in the Barangay, 15 years
54of age and above, who has resided in the Barangay for a period of 6 months prior
55to the application, as certified by the Purok President in a Purok Certification.

57Section 3. Coverage – All residents, 18 years of age and above, are required to
58secure a Barangay ID Card. However, in the case of residents under 18 years of
59age but not less than 15, the application for a Barangay ID Card shall be voluntary.

61Section 4. Proof of Residency – A resident applying for a Barangay Identification
62Card must submit a proof of residency to the Purok President, e.g. any valid ID,
63utility bill, proof of lease, pay slip, etc., before the latter issues a Purok
64Certification.

66Section 5. Imposition of Additional Requirement – The Barangay may, by
67ordinance, impose additional requirements for the issuance of a Barangay ID Card.

69Section6. One Barangay ID Card Policy – Every individual shall possess only
70one Barangay Identification Card.

72Section 7. Issuance of a Barangay Identification Card – All residents of the
73Barangay, as certified by the President of the Purok where they live, shall be issued
74a Barangay Identification Card. The Punong Barangay, as the validating officer,
75shall be the signatory of the ID Card.

77Section 8. Process – Prior to the issuance of the Barangay Identification Card, the
78applicant shall fill out a form and submit to the Barangay a Purok Clearance issued
79by the Purok President. The Barangay shall process the application and issue the
80applicant’s Barangay ID Card within a period to be determined by the Barangay.

82Section 9. Validity – A Barangay Identification Card issued by every Barangay in
83in the city shall be recognized and accepted in all offices, public and private,
84within the jurisdiction of Butuan City. The same shall be valid for a period of one
85year from the date of issuance.

87Section 10. Fee – The Barangay may, by ordinance, impose a reasonable fee for
88the issuance of the Barangay Identification Card.

90Section11. Information to be contained in the Barangay Identification Card –
91The Barangay Identification Card shall contain the following information:

93 1. Logo and Name of the City
94 2. Logo and Name of the Barangay
95 3. Full Name of the ID Bearer
96 4. Photo of the ID Bearer
97 5. Citizenship
98 6. Sex
99 7. Blood Type
100 8. Address of the ID Bearer
101 9. Date of Birth of the ID Bearer
102 10.Contact Person in case of emergency
103 11.Mother
104 12.Father
105 13.Number of Children
106 14.Voter’s ID Number
107 15.Date of Issuance and Period of Validity
108 16.Unique Identification Number
109 17.Signature of the Bearer

112Section 12. Prescribed Information Sheet1 – There shall be a prescribed
113information sheet, which shall be used by all Barangays for the Barangay
114Identification/Information System. The said information sheet shall contain all the
115information enumerated in the preceding section, and shall be subscribed. An
116applicant who provides any false entry in the information sheet shall be held
117criminally liable under existing laws.

119Section 13. Prescribed Size and Format of ID Card2 – The size of the Barangay
120Identification Card shall be 3.37 inches by 2.127 inches. There shall be a
121prescribed format for the Barangay ID Card, which shall be used by all Barangays;

122but the latter can make any modification as regards the design, e.g. background, of
123the card.

125Section 14. Barangay Information System – A Barangay Information System
126shall be established in every Barangay, which will serve as the repository of
127information for the Barangay Identification System. The Barangay shall provide
128the necessary software, hardware, and other equipment for the said information
129system.

131Section 15. Confidentiality – The Punong Barangay and the Barangay Secretary
132shall ensure that the entries in the information system are kept confidential and
133accessible solely for official purposes. The data and information contained in the
134Identification Card and the information sheet shall not be used for any purposes
135other than identification.

137Section 16. Validity of Barangay IDs Issued Prior to the Implementation of
138this Ordinance – All Barangay IDs issued prior to the implementation of this
139Ordinance shall remain valid until the expiration date indicated therein. In the
140absence of an expiration date in the Barangay ID, the same shall be valid only until
141December 2018.

143Section 17. Penal Clause – Any person who obtains a Barangay ID Card from
144more than one Barangay shall be penalized with a fine of one thousand pesos (Php
1451,000). Any person, barangay official or not, who violates the provisions of Article
14615 hereof shall be civilly, criminally, and administratively liable under existing
147laws.

149Section 18. Separability Clause - If any provision of this Ordinance is held
150invalid or unconstitutional, the same shall not affect the validity and effectivity of
151the other provisions hereof.

153Section 19. Repealing Clause - All existing ordinances and resolutions of this City
154found to be inconsistent herewith are hereby repealed or modified accordingly.

156Section 20. Effectivity Clause - This Ordinance shall take effect after fifteen (15)
157days following the completion of its publication in a local newspaper of general
158circulation in Butuan City.
