Dear Ms. Burduli

Referring to our recent discussions during the monthly and weekly meetings, for minimizing the effect of
Force Majeure situation arising from the COVID – 19 pandemics, we are seeking the ways to remobilize our
staff back to our construction site in Kobuleti without quarantine conditions. It’s been a long while, with the
reference letters, we requested Employer’s support to get necessary permits for our staff.

Unfortunately, upon a very long period of waiting, we have notified by the “Ministry of Economy and
Sustainable Development of Georgia” that the permits have been granted with the condition of 14 days
quarantine and afterwards PCR test with negative result. Please note that, while we are in the summer
season that is critically precious for us to complete the works on time, to mobilize our staff with 14 days
quarantine is not a sustainable situation for us to maintain our activities properly on site.

It shall be clearly understood that our staff cannot stay steady and shall be mobile to work efficiently. As you
know from the earlier stages of our contract, our project manager, site managers other administrative staff
have been travelling frequently, to arrange the works, supplies and all other necessities. Majority of our staff
does not have ongoing works for a month or more that they have maximum 3 – 4 days of work and they shall
move and shall come back again for the remaining parts. In this regard, considering the nature of
construction works that is performed in a large area like our project, sustainability and efficiency cannot be
provided under these circumstances. We strongly request Employer’s involvement and influence before the
decision making Georgian Authorities to obtain the specific permit without quarantine but with PCR testing in
every 72 hours that was announced previously.
We have been informed that, border passing permits without quarantine were granted for the staff of some
other Turkish construction companies are maintaining some important contracts in various parts of Georgia.
Together with that, we believe that our contract has the equivalent importance for Ajara Region but that shall
be reflected to the Georgian Authorities by the Employer’s efforts. We are always ready to provide any
document, any application, reporting etc. to support your efforts. Please kindly take our request into
consideration and act swiftly to resolve this issue immediately. Otherwise, the completion of the works will
definitely be delayed, the additional costs will increase and budget problems will be inevitable for our
contract.
