NOTICE

To, Hayat Ali & Co.

Near Audi Centre, Main Golra Road,

Subject: “Supply Construction, Installation and O&M of Direct Supply and Water
Filtration Plants in Rawalpindi Division” (Package-1)
Detailed Work Plan & Notice for Execution of Balance Works under Risk and
Cost

Reference to subject, the said project was awarded to you vide acceptance letter No.
Dir(P&C)/01/2145-50 dated 04-06-2021with the completion period of 06 months ending on 03-
12-2021.
An Extension of Time-1 (EOT) of 180 days was requested by your Firm vide letter No.
HAC/PAPA/0029 dated 04-11-2021. Based upon detailed evaluation and verification by this
office vide Ref: JERS-AID JV Letter No. 465-J01-01-CS/13 dated 20-12-2021 and subsequent by
Client, you were granted an extension of time from 04-12-2021 to 21-03-2022 (108 days, non-
compensable) vide Ref: PAPA/D(P&QC)/NZ/458-464 dated: 23rd December, 2021. It was also
directed to complete the remaining works within extended time period, however it was not
completed.
Further, another Extension of Time-2 (EOT) of 163 days was requested by your side vide letter
No. HAC/PAPA/0043 dated 01-03-22 and letter No. HAC/PAPA/158 dated 25-06-22. Based
upon detailed evaluation and verification by this office vide Ref: JERS-AID JV Letter No. 465-
J01-01-CS/35 dated 30-06-2022 and subsequent by Client, you were granted an extension of time
from 22-03-2022 to 31-08-2022 (163 days, non-compensable) vide Ref:
PAPA/D(P&QC)/NZ/1123-1129 Dated: 30 June, 2022 and was also directed to complete the

remaining works within stipulated time period.

In spite of multiple reminders from the office of undersigned and from Client side pertaining to
completion of pending tasks at all sites in order to ensure the commissioning of plants, you have
not augmented your field teams by injecting more technical teams along with investing the
required financial support. In case of any genuine reasons, you are required to state the same along
with justifications and submit your detailed work plan for completion of all pending activities with
in a time frame of 7 days.
In the event of non-compliance as stated above, you will be served with a notice under Clause-61
(a) of Contract Agreement as well as Article-V to do the needful in a period of 14 days after receipt
of the notice failing which action under Clause 61 (a) of the Contract Agreement will be initiated
without prejudice.
