CRIMINAL COMPLAINT
The undersigned offended party, after first being duly sworned, accuses
MA. JOJIE SANTILLAN SAMSON alias JOY of Balopinos Residence, Blk. 7,
Notre Dame Village, Cotabato City, Philippines of the crime of QUALIFIED
THEFT, defined and penalized under Art. 315, subdivision 1(b) of the Revised
Penal Code, committed as follows:
“That on or about April of year 2002, at Sitio
Acub, Brgy. San Isidro, City of Koronadal, South
Cotabato, Philippines, and within the preliminary
jurisdiction of the Honorable Court, the above-
named accused, one of the caretakers of the Private
Complainant with intent to gain, and while taking
advantage of the trust and confidence and of the
absence of the Private Complainant carted away the
following properties from the bank house/house of
the Private Complainant to wit:

2 hole dagger 1 Sander

1 bar 2 Cellphone
1 box electric wire heavy duty 1 Narra door
1 labatory 1 Window grill
1 bar cutter 1 hand saw
1 Compressor 1 hammer
1 Welding machine 1 bolo
1 Push Drill 3 sets flourescent lights
1 Electric Drill 3 sets 20 watt and
1 dresser

which properties have total value of EIGHTY FIVE

THOUSAND THREE HUNDRED SIXTY(P85,360.00)
PESOS, to the damage and prejudice of the Private
Complainant in the AFORESAID amount.

1. Q: Do you swear to tell the truth and nothing else but the whole truth in this
investigation?

A: Yes, sir;

2. Q: State your name, age, civil status and other personal circumstances?

A: ROMIE D. UY, of legal age, single, Filipino, and a resident of Pinto

Subdivision, Crossing Diaz, City of Koronadal, South Cotabato;

3. Q: What prompted you to be here at the Municipal Trial Court in Cities, City
of Koronadal, South Cotabato?

A: To file a formal Complaint against Maria Jojie Samson, Sir one of the care
takers of my farms and personal properties, Sir.

4. Q: What is your Complaint against Maria Jojie Samson?

A: She committed the crime of Qualified Theft against me, Sir.

5. Q: When did this incident happen?

A: Sometime on the month of April, 2002.

6. Q: Where did this incident happen?

A: At my house at Sitio Acub, Brgy. Isidro, City of Koronadal, South

Cotabato.

8. Q: And how did you able to know that your care taker named Maria Jojie S.
Samson committed a crime of Qualified Theft against you?

A: I was informed by my cousin Ricky Bernabe and Alberto Fluk, a Barangay

Kagawad of Barangay San Isidro, City of Koronadal, South Cotabato.

9. Q: When you discovered that your care taker had stolen your properties what
did you do?

A: I have the incident blottered by Ricky Bernabe at Barangay San Isidro,

City of Koronadal, South Cotabato. I also conducted inventories on my
properties at the bank house which I constructed for my care taker.

10. Q: Were there any items and personal belonging lost inside your bank house
upon your verification?

Maria Jojie S. Samson?

A: She admitted to me that she brought with her my properties, Sir. .

say, add or retract from your given statements?
