AFFIDAVIT OF CANCELLATION OF ADVERSE CLAIM

I, BELINDA TECSON MAGHANOY-WALTER, Filipino Citizen, of

legal age, divorced to Wendelin Josef Walter, a German National, under oath, do
hereby depose and state:

1. That I was married to WENDELIN JOSEF WALTER on December 21, 2001,

in Germany;

2. That I acquired these properties even before our marriage;

3. That I was not dependent upon my ex-husband to acquire the said properties,
neither was I dependent on him for support;

4. That I acquired these properties on February 8, 2001, even before we got

married, because I was able to save some money including the pension of my
late husband, Eduardo G. Arquiza;

5. That the parcels of land that I purchased in year 2001 are covered under Tax
Declaration No. 09114 for Lot no 10801-E with an area of 6,655 square
meters and a road Lot No. 10802-P with an area of 224 square meters located
in Logon Island, Daanbantayan, Cebu;

6. That a copy of the deed of sale of the property wherein it can be clearly seen
that I purchased the property on February 8, 2001. Attached herein is a copy
of the Deed of Sale dated February 8, 2001, as Annex A;
7. That my ex-husband filed an affidavit of adverse claim when he filed a
petition for divorce against me in Germany. Since 2008, when he filed the
affidavit of adverse claim, he had not claimed nor file any case in court
because according to him, his intention was only in connection to his
application for Divorce in Germany;

8. Furthermore, my ex-husband is a German National and has no right to own

any real property in the Philippines because foreigners are prohibited to own
any land/real property in the Philippines;

9. That my ex-husband could not properly claim that he invested money in the
properties that I purchased before my marriage, because we did not enter into
a business venture agreement, we were husband and wife;

10. That I am executing this affidavit to cancel the adverse claim filed by
Wendelin Josef Walter, and to attest to the foregoing facts and to make known
my request to cancel his adverse claim before the Provincial Assessor of Cebu
as well as the Municipal Assessor of Daanbantayan to cancel the annotations
found on the above mentioned properties.
 IN WITNESS WHEREOF, I have hereunto set my hand this 12 th day of
