2. What is he crime of bigamy?

- He will be guilty by doing crime of bigamy if he married another person while legally
married to another spouse which is included in committing civil code here in the
Philippines especially when the spouse are still living. We all know that majority of the
citizen in the Philippines are religious thats why doing so will not only be a crime to law
but also making a sin to God because it is also included in Ten commandments of the
Bible.

3. What are the elements of bigamy?

a) That the offender has been legally married;
b) That the marriage has not been legally dissolve or, in case his or her spouse is
absent, the absent spouse could not yet be presumed dead according to the Civil Code;
c) That he or she contracts a second or subsequent marriage has all the essential
requisites for validity.

4. What are the elements of performance of illegal marriage ceremony?

a) That the accused has the authority of the solemnizing officer; and
b) That he performs an illegal marriage ceremony.

5. Who could commit the crime of performance of illegal marriage ceremony?

- None other than the Priest or the Ministers because they are the ones who has the
authorities to execute the wedding or marriage ceremony.

6. Why good faith a defense in bigamy?

- Good faith and lack of criminal intent is a complete defense. Example is person A, the
man who will marry person B, the second woman but she has no intention or plans to
hurt the legal wife but person A is making a mistake in his judgement which is wrong or
evil itself.

7. A, minister, is fully aware that the couple C and D have no marriage license. But he
proceeded to solemnize their marriage. What crime has been committed?
- The minister committed the Article 352 Performance of Illegal Marriage Ceremony
because he acknowledge it and still perform that illegal marriage ceremony that's why
the minister found guilty by that. The minister just over using his authority maybe
because it is paid by the involved people.
