Subject: Seeking Clearance for Tree Cutting in Right of Way of North Central Railways in
Section of Rooma-Chakeri-Chandari for construction of New Railway Line.
Reference:
1. Letter No. F. No.11-37/2016-FC (pt) Ministry of Environment, Forests and Climate Change
(FC) division dated 21/05/2019
2.SSE/Works/Line Letter No W-49/Land/21 regarding clarification of land between Rooma and
Chandari Station dated 08/01/2021

In reference to above cited subject, it is brought to your kind notice that construction of new
railway line (3rd Line) between Rooma-Chakeri-Chandari Railway Station is in progress under
the Kanpur Construction Unit of North Central Railways. This is a targeted project and is being
monitored at level of Railway Board, Ministry of Railways.
Along the proposed alignment of the 3rd railway line,146 trees of different species have been
identified in Right of Way of North Central Railways which are hampering the work progress.
The joint Tree survey report is attached herewith for your kind reference.
In context to the issue, Ministry of Environment, Forests and Climate Change (FC) division has
issued clarification vide letter No. 1 under reference, which clarified that “if the land is a railway
land (i.e., ownership of the land vests with Railways) and which is under ‘non-forest use’ before
25th October,1980 then provisions of Forest Conservation Act would not apply”
After examining the railway’s records of land plans from Rooma-Chakeri-Chandari, the Senior
Section Engineer/Works/Fatehpur under Assistant Divisional Engineer/Fatehpur has certified
 that Allahabad division of North Central Railways has the ownership of the land between Rooma-
Chakeri-Chandari Railway Station in Right of Way vide letter No.2 under reference and it was
under ‘non-forest use’ before 25th October,1980. Hence, provisions of Forest Conservation
Act,1980 will not be applicable here.
But the revision in Forest Conservation act,1980 in year 2020 states that tree cutting of 29
identified species is not permitted without prior written permission of concerned Divisional
Forest Officer.
Hence, in view of these guidelines, it is requested to accord written permission for ‘Tree
Cutting in Right of Way of North Central Railways’ in Section of Rooma-Chakeri-Chandari for
construction of New Railway Line so that target can be completed within stipulated time.
It is for your kind information and necessary action at the earliest.
