Please note that Governor DeSantis’ Executive Order Number 20-69 suspended the

Executive Order also allows local government bodies to utilize communications media
technology, such as telephonic and video conferencing for local government body meetings.

7. REPORT OF THE CITY ATTORNEY. The City Attorney reported the courts has not set
oral arguments on the Banyan Healthcare vs. City of West Miami as of this date.
8. REPORT OF THE CITY ENGINEER. The City Engineer reported on the Drainage Project
on SW 13th Street and 65th AVE, which is near completion and the Water Main
Improvements Phase 1 Project starting soon. The City Manager added that on early
October a calendar for the groundbreaking of the project will be sent out containing
possible dates for consideration.

order of the Agenda, with item 6. Report of the City Manager.
NOTE FOR THE RECORD: The City Attorney lost connection at 11:57 AM and rejoined the

5. GOOD OF THE ORDER. The Mayor thanked each and every Commissioner for
taking the time to meet with the Manager during budget time. The Mayor also
thanked the Manager and Finance Director for their professionalism and hard work.
The Manager thanked the Commission for their trust. In closing, the Mayor thanked
all Department Directors for keeping the City stable and safe during these difficult
times.

WHEREAS, MAJO Properties Holdings LLC, hereinafter referred to as "owner", as owner of the
real property described in the attached Exhibit "A" hereinafter referred to as "Parent Tract" has submitted an
application for SPECIAL USE PERMIT FOR PLANNED DEVELOPMENT # 2020-003, together with a
site plan of the proposed development plans, showing certain subdivision improvements which the owners
covenant and agree to make; and
WHEREAS, A “Public Hearing” was held on September 22nd, 2020 before the Planning and
Zoning Board. During the hearing the people expressed their views on this project and relevant suggestions
and ideas for cohesion of the project with the residential neighborhood to the south of the project; and
WHEREAS, after hearing all the views of the public and responses from the attorney for the
development and the owner/developer the Planning and Zoning Board made a motion to recommend the
development with the below stated items with a favorable recommendation to the City Commission; and
WHEREAS, on October 7th, 2020 a “Public Hearing” was before the West Miami City
Commission to hear views and concerns of the area property owners; and
WHEREAS, the development was presented and different views and questions were expressed the
attorney for the developer explained and answered questions about the project; and
WHEREAS, The review of the proposed “Special Use Permit for Plan Development” a duplex
residential unit use project consisting of a two family two (2) stories residential homes; and
WHEREAS, the reviews by Planning and Zoning Department and the “Public Hearing” on
September 22nd, 2020 and before the Planning and Zoning Board and the “Public Hearing” on October
7th, 2020 before the City of West Miami City Commission have determined that the proposed “Special
Use Permit for Plan Development” of an One story duplex use at 1501 SW 66 Avenue, is in compliance
with the intent of Zoning Ordinance 282 Sec.2B, 4.1 Ord. 99-01
WHEREAS, said owner has agreed to the terms and conditions set forth in this resolution in
consideration for the granting of the site plan approval.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of West Miami as
follows:
Section 1. The aforementioned statements are true and correct and adopted as is fully stated
herein.
Section 2. In consideration of the foregoing, Owner is hereby granted Special Use Permit #
2020-003 of the above described Parent Tract located and being in the City of West Miami, County of
Miami-Dade, State of Florida, on the following terms and conditions:
A.) The front building elevation shows a twenty-five (25) feet setbacks on the West property
line and a rear setback of fifteen (15) feet as required.
B.) The rear of the building is setback twenty-three feet and nine (9”1/8) and on-eight inches
from the rear property line. The side setbacks are at six (6’) feet on the interior side
setback and fifteen (15’) feet from the front exterior side property line.
C.) The parking provided is for two cars on the property per unit as required.
Landscaping:
D.) Landscaped area is shown at 6,340 square feet of the site and the City Ordinance 282
requires 35% for all developments in a residential area. Landscaping as provided meets
required and the massing of trees, plants and palms meet our requirement. Trees shown
on elevation renderings must be of same height and caliber when planted at the proposed
project site and as indicated by the Director of Public Works.
E.) Applicant will be required to construct all improvements per FDOT and Miami Dade
Standards as required and shall reimburse the City for expense relative to the project
oversight by the City Engineer.
F.) Existing sewer laterals have capacities for the new building and any additional
improvements to the system shall be borne by the developer.
G.) Storm Water for this property shall meet current storm water run-off ordinance for the
entire property. All modifications of the existing Storm Water System and any
realignment for the new road way shall be borne by the developer and approved by the
City Public Works Department.
H.) Any streets surrounding the development that are damaged during construction shall be
completely milled and overlaid at the end of project as directed by the Public Works
Director. The roadway shall be completely milled and overlaid per MDPWD standards
for local roadways as part of the design.
I.) All sidewalks surrounding project shall be six-inch, 3000 psi concrete sidewalks as
approved by the City.
J.) All City impact fees for GSA, Police and Sanitary Sewers will be paid by the developer
prior to zoning approval being issued. Any other governmental agencies having
jurisdiction shall have the right to review, collect impact fees and developer shall be
required to pay and meet all concurrency requirements.
K.) Any fees for review, inspections and certifications by the City Engineers shall be the
responsibility of the developer or agents. Any omission from this review does not relieve
the developer from its responsibility to provide details and pay all associated costs.
L.) The review by Planning and Zoning Department has determined that the proposed
“Special Use Permit for Plan Development” of a one-story duplex use in the duplex zone
is within the intent of Zoning Ordinance 282 and the 2000 and 2005 City of West Miami
Comprehensive Plan and meets current ordinance 99-01. This development provides
residential units on the inner perimeter of the City’s corridor as indicated in the
Comprehensive Plan.
M.) Developer shall reimburse the City for all administrative, legal and engineering costs
incurred by the City in conjunction with this proposed development.
N.) Owner shall provide detailed plans for the construction of proposed development depicted
on the plans submitted under SUPPD # 2020-003 heretofore submitted to the City, prior to
issuance of building permits for improvements. Said plans shall include civil plans to
include pavement, drainage and other structures and shall be subject to approval by the City
and all governing agencies.
O.) Owner agrees that no Certificate of Occupancy or Temporary Certificate of Occupancy shall
be granted for any occupancy of the building until all dedications and improvements made a
part of this resolution are completed and approved by the City of West Miami and all other
pertinent government agencies.
P.) Owner agrees that the City shall have the right to invoke and enforce the conditions,
restrictions, limitations and reservations set forth within the Special Use Permit for Planned
Development, at developers/owner’s expense.
Section 3. This Resolution shall take effect immediately upon passage by the City
Commission and signature of the Mayor.

MEMORANDUM

On Monday, September 28, 2020 this office issued a draft memo regarding the Governor’s
Executive Order and Miami-Dade County Mayor Carlos Gimenez Emergency Order that was
in effect at the time with the understanding and expectation that something would change
shortly thereafter (and it did).
Yesterday, Mayor Gimenez addressed Mayors, Vice Mayors, Managers and City Attorneys and
others who participated in a Zoom conference call and offered the following changes to the
emergency orders and I would like to try to summarize them by departments and make some
recommendations for your consideration as follows:
CURFEW
NOISE
Mayor Gimenez emphatically informed the group that noise deriving from loud music or live
performances needed to be toned down and strictly enforced. He advised that the lower you
speak, the less you will project any possible contamination. Loud music interferes with the
ability to have a normal conversation. These recommendations come from the medical experts,
health department, and CDC. This is particularly of interest to the business community,
restaurants, bars or places where people gather. This said, the Police Department will be
instructed to monitor gatherings/parties in the commercial and residential areas where loud
music is being played.

RESTAURANTS AND FOOD SERVICE
Restaurants and food service establishments to include banquet halls are allowed to open for
businesses following the protocol for Social Distancing now referred to as “Physical
Distancing” and the wearing of masks provided that these establishments follow the rule by
allowing 6 people maximum to a table or a group of 10 for as long as they are members of the
same family and live in the same household.
The restaurants and food service and/or banquet halls can operate at 100% capacity if they have
the space or operate at 50% capacity following the “Physical Distancing” requirements. In all
of these examples, persons must maintain a 6-foot separation and wear masks.
The City was notified in writing that Miami-Dade County Emergency Order No. 30-20 would
permit or allow cities to open the community centers for as long as we follow the “Physical
Distancing” guidelines and the capacity requirements contained in the moving to “The New
Normal” handbook https://www.miamidade.gov/information/library/new-normal.pdf.
With this said, pursuant to my conversation with Barbara Suarez at the Alliance for Aging
yesterday, they would like for us to provide them with a plan of action for the reopening.
Presently, we are conducting a survey to see how many of our seniors would react to coming
back to the community center. The seniors being surveyed are West Miami residents first. The
reason that we are surveying our residents first is because we are still limited in terms of capacity
and cannot bring back all the seniors at once due to “Physical Distancing” and space limitations.
This office hereby recommends that the West Miami Community Center remain closed
until after the end of Early Voting (which starts on Monday, October 19, 2020 until
Sunday, November 1, 2020) and pending the outcome of the survey being conducted.
Another recommendation dealing with the community center participants and the phasing in
of activities will be provided to you in a separate memo.
VENUE RENTALS
We are permitted by the Executive Order from the Governor and Emergency Order from Miami-
Dade County to open our venue for rentals provided that we enforce “Physical Distancing”
maintaining a 6-foot separation and the mask requirement.
It is the recommendation of this office that we postpone the venue rentals until after
the election, as both sites will be used for polling places and/or early voting.
Additionally, I would like to avoid, where possible, any confrontation between
employees and guests who fail to adhere to the standing emergency orders. The same
recommendation applies when dealing with park rentals. This will avoid enforcement
action or a dispute on our part.

WEST MIAMI RECREATION CENTER
As of this writing, Mayor Gimenez issued an amendment to the emergency order (sent to you
via email on 9/30/2020) ordering the opening of playgrounds in municipal parks. To be able to
maintain the playground open, we will need to wash down the equipment daily using CDC
approved cleansers. Additionally, parks with restroom facilities will require cleaning several
times per day.
We recommend that all restrooms close at 4 pm daily during the week and remain
completely closed during the weekend at our unsupervised parks. This measure will
also cutdown on overtime. The West Miami Recreation Center is a supervised facility.
We recommend that restrooms follow the same guidelines with restroom closure at 4
pm daily. Our recommendation also includes the closing of the Recreation Center on
Sundays until we resume venue rentals and orders are further relaxed.
All restrooms will be posted. All water fountains will remain closed per emergency order.
The Mayor reported that organized league sports can resume with a “No Mask” requirement
during games. Furthermore, he advised that pickup games would require the wearing of a mask.
AFTER-SCHOOL CARE
At the direction of this office, the Park Director is conducting a survey to see how many children
who reside in the City of West Miami expect or wish to return to the After-School Care program
once the phasing in of all students on campus is accomplished.
Because there are “Physical Distancing” requirements, we recommend that we limit our survey
to City residents only at this time.
This office recommends that the After-School Care program resume on Monday,
November 9, 2020 pending further orders and mask requirements which will be
dictated by the Miami-Dade County Mayor Gimenez Emergency Orders.

As a follow-up to my memo dated October 1, 2020, a survey was conducted by the Community Center
to gauge interest on the part of our seniors to return to the Center during the Phase 3 of the Emergency
Order by Miami-Dade County Mayor Carlos Gimenez that would allow and permit the City to move
towards a new normal based on capacity and Physical Distancing requirements.
Out of 50 senior citizens who reside in the City of West Miami only 13 would be ready to resume their
daily activities in early November. The balance/remaining of the seniors would like to wait longer until
all restrictions are lifted. This information is provided for your ready reference and we propose to
conduct another survey on or about Monday, November 9, 2020. This allows approximately 30 days to
see if orders are further relaxed.
A similar survey was conducted by the City of West Miami Recreation Center staff to gauge interest for
children to return to our After-School Care Program following the reopening of Miami-Dade County
Public Schools.
We have approved 146 City residents who have registered their children. This does not mean that 146
children attend daily however, all calls made resulted in an expressed interest (on the part of the
parents/guardians) for their children to return to the After-School Care Program.
Our assessment of the positive responses led us to believe that most kids will be returning to the
Recreation Center as soon as we are able to open. Capacity is still an issue in an effort to be able to adhere
