AFFIDAVIT
I, NELY AQUINO-GASPAR, of legal age, Filipino, married, and a
resident of Bantug, Roxas, Isabela, after having been duly sworn to
in accordance with law, do hereby depose and say:

That I am the same person executing this Affidavit, with the

sole purpose of filing a case of ESTAFA against RICARDO
SANTOS, SR, a resident of Bantug, Roxas, Isabela;

That on April 29, 2013, Mr. Ricardo Santos, through deceit and
machination, enticed me to enter into a contract of sale,
regarding a parcel of land he allegedly owned, for a sum of
Fifty Thousand Pesos (P50,000.00); copy of our Deed of Sale is
hereto attached and marked as Annex “A”;

That the said parcel of land is a part of Transfer Certificate of

Title No. T-257205 which he bought from Rosie Dona Hidalgo,
by a virtue of their deed of absolute sale hereto attached as
Annex “B”;

That because of this misrepresentation and assurances that his

ownership of a portion of 100 square meters coupled by the
fact that he volunteered to process the issuance of a certificate
of title in my name as he is also a geodetic engineer, I paid him
the amount of fifty thousand pesos as consideration of the sale
plus five thousand pesos for the partial amount for the
issuance of title and incurred actual damages in fencing the
land in the amount of ten thousand pesos;

That the Deed of Absolute Sale (Annex “A”) was executed and
signed before Notary Public Atty. David S. Salibad, Jr., under
Doc. No. 173; Page No. 36; Book No. 5; Series of 2012; while
the Deed of Absolute Sale (Annex “B”) was executed and
signed before Notary Public Atty. Nemio D. Somera, under Doc.
No. 350; Page No. 60; Book No. 84; Series of 2011;

That subsequently, I was surprised when somebody claimed

ownership on the lot I bought to Mr. Ricardo Santos, Jr., and
equipped by a valid title, I was evicted and ejected on the said
lot;
 That as clearly viewed, I was deceived by Mr. Ricardo Santos,
Jr., by selling me a lot not owned by him, and converted the
money I gave to him in his own personal benefit, hence, by this
affidavit, I am filing a case of ESTAFA against him, worst is
that he has not shown any evidence that he is indeed a
geodetic engineer;

That I am executing this affidavit without being intimidated,

coerced, forced, nor promised any reward whatsoever.

IN WITNESS WHEREOF, I have hereunto set my hand this 15 TH

day of December 2014, at Roxas, Isabela.
