STANDARD TERMS AND CONDITIONS FOR PRECAST QUOTATIONS
COVERING SUPPLY, DELIVERY AND ERECTION OF PRECAST CONCRETE ELEMENTS
A. GENERAL
Contract amount is re-measurable and therefore,
the total amount payable is computed based on the
actual quantity of precast elements produced
and/or erected for the project in accordance with
the approved and/or final design and the
accepted/contracted unit rate.
Works shall commence only upon acceptance by
SMEET of a written order from Client, either in the
form of a confirmation letter and/or LPO, together
with the agreed down payment.
SMEET scope of works may cover design,
manufacture, delivery and erection of precast
concrete elements or any of the foregoing subject
to agreement.
B. CONDITIONS ON PRICING
SMEET reserves the right to claim for additional cost
resulting from any change in the original
Design/Plans/Layout, Design Details as first quoted.
SMEET will prepare fabrications drawings which will
be submitted to the Client for approval and once
approved they become the basis for fabrication
(production). Likewise, SMEET reserves the right to
claim for additional cost resulting from any change/
alteration in the fabrication and shop drawings after
approval.
Price is based on SMEET Precast Standard
Operational Procedures and Processes relative to
manufacturing, delivery, erection, quality control,
health and safety and site works.
Quoted/Contract price is subject to escalation in
case of rise in costs of raw materials, labor or fuel.
C. CLIENT/CONTRACTOR SUPPLIED PROVISIONS
1. Free and unobstructed access road for SMEET
Precast delivery trailers. Access road must be flat
and hard to allow easy maneuvering.
2. Parking space for trailers.
3. Gate passes, road permit and other special permits
to use public roads, neighbouring facilities and
the like.

4. Removal of any obstructions that may affect SMEET
continuous erection flow.
5. Supply of water and electricity to SMEET at site free
of charge.
6. Scaffolding and mobile platform for SMEET jointing
and sealant works if it is required.
7. Site safety protections provisions other than PPE
ARE which are supplied by SMEET.
D. OTHER TERMS AND CONDITIONS
1. Design
SMEET Design Engineering includes structural
analysis and calculations, preparation of
construction drawings, fabrication/shop drawings,
construction details, as-built drawings and warranty.
Based on client’s-supplied drawings, SMEET will
prepare design calculations and shop drawings
which are submitted to Client/Consultant for
approval and once approved, will serve as the basis
for production. Any cost that is to be incurred due
to revision after issuance of approval, will be
charged to the Client’s account.
2. Production
Production is done in accordance with SMEET
Standard Production and QA/QC Procedures and in
accordance with the approved fabrication drawings.
Production tolerances are in compliance with
tolerances set in the British Standard, PCI and
SMEET Design Requirements.
Cement and other concrete components (sand,
aggregates, etc.) being organic materials, SMEET
cannot guarantee uniformity in concrete color and
such will not serve as basis for rejection of the
precast element.
Cut-outs, holes and other openings are executed by
SMEET as shown in the fabrication drawings.
 All concrete-related testing activities are done in
SMEET Central Laboratory. If testing is required and
is to be made by an outside Independent
Laboratory, the cost of said independent testing is
borne by the Client.
3. Delivery and Erection
Construction schedule will be in accordance with
Construction Schedule agreed and signed by both
parties.
SMEET reserves its entitlement for time extension
due to any delay incurred for faults or reasons not
attributable to SMEET i.e., readiness of in-situ
foundation, bad weather condition (strong wind,
rain, sandstorm) etc.
Likewise, SMEET reserves its entitlement for time
extension for any delay due to raw materials
shortage (cement, steel, sand and aggregates, etc.).
Delivery/Erection is commenced upon receipt of a
written confirmation from client with respect to the
readiness of the foundation/site to proceed with the
delivery/erection of precast units. In case the
production of the precast elements is completed in
accordance with the Construction Programme and
the site is not ready to receive the cast units, the
Client has to provide stocking area at site to allow
delivery and stocking at site. Delivered and stocked
slabs at site shall be considered as “Materials Off-
site” and shall be invoiced accordingly at 85% of
their contract value.
If the Client is unable to provide stocking area at site
and the cast units are to be stocked at SMEET
factory premises, the cost of stocking is to be borne
by the client at a reasonable amount to be agreed
by both parties.
The cost of double handling shall be to Client’s
account.
In case of night delivery/erection, permit if required
and supply of lighting provisions are to be provided
by the Client. The Client and or authorized
representative thereof shall ensure that all SMEET
Delivery Tickets are properly acknowledged and
signed. SMEET will abide by existing Safety
Regulations at site.
4. Fixing/Connection Materials and
Accessories
All items for fixing (and related

accessories) and handling purposes shall be
made of ordinary mild steel when these items
are embedded in concrete and shall be
galvanized when they are exposed to the
elements. Unless otherwise stated, stainless
steel provisions have not been considered
and/or allotted in the price.
5. Liability
SMEET shall not be liable in damages or be
furnishing to the other Party grounds to a right to
terminate the contract by reason of delay or default
caused by conditions beyond the control of SMEET
including, but not limited to Acts of God,
government restrictions, wars, insurrections and the
likes.
SMEET shall not be liable for any third party claims
arising in connection with the works, except as
solely and directly arising from the wilful default of
SMEET. SMEETs cumulative liability for damages, if
any, for all claims of any kind arising in connection
with the work in limited to 10% of the contract
value. Notwithstanding the foregoing SMEET shall
not be liable for any special, punitive, indirect,
incidental or consequential damages, lost revenues
or lost profits, however caused, arising from or in
connection with the work done by SMEET.”
6. Disputes
All disputes and similar matter arising out of or
relating to contract or the interpretation thereof, is
to be settled at the first place amicably by both
SMEET and Client.
In the event of failure for amicable settlement, said
dispute (and similar matter) has to be referred to
any competent court in Qatar and therefore said
court shall have exclusive jurisdiction over any suit
or legal proceeding relating to the contract. Both
parties shall submit to the exclusive jurisdiction of
the said court as the proper legal venue for the
dispute that cannot be settled amicably by both
parties.
