CONTRACT ON PROJECT BASED EMPLOYMENT

Re: Appointment on Project Basis

Dear:

Pleased to inform you of your appointment as a Customer Service Representative on a


Project Basis effective on _____________for a period of six (6) months or sooner as
warranted by the result of your performance evaluation that determines the cessation of
your project based employment, or your regular appointment.

Your salary shall be 430 pesos per day plus commissions, and incentives. It is understood
that while your position has a particular job description, you are required to do multi-
tasking that benefits not only the company but also yourself for your own growth.

The company has the absolute right and discretion to stop or cease the Project Based
Employment of the Employee if in case the project has been pulled out, cancelled or
stopped by the company’s client.

Your success under this project based appointment is further assured by your strict
adherence to company policy, rules and regulations.

1. GROUNDS FOR TERMINATION OF PROJECT BASED EMPLOYMENT – The COMPANY may


terminate this Project Based Employment Contract if the EMPLOYEE:
a. Fails to meet the production/performance standards that have already been
agreed upon with the EMPLOYEE at the time of his/her employment;
b. Performs work that is unsatisfactory, inefficient, slow, negligent, inaccurate,
shoddy, haphazard, and/or fraught with errors and mistakes;
c. Without any prior notice, fails to report to his assigned office for three (3)
consecutive days;
d. Engages in part-time work in any other undertaking or activity during working
time and/or fails to devote full-time work to his project based employment with
the COMPANY; and
e. Fails to observe policies relating to punctuality, attendance and/or other terms
and conditions of this Project Based Employment Contract, as well as rules and
policies that maybe promulgated by the company.
f. Fails to submit the pre-employment requirements or did not pass the standard
for the requirements.
g. Violation of NON DISCLOSURE AGREEMENT.

2. MANAGEMENT RIGHTS – The COMPANY reserves its right to conduct a review of the
performance of the EMPLOYEE at any time, whether on a daily, weekly or monthly
basis. The COMPANY, during aforementioned project based period, shall have the right
to terminate the employment of the EMPLOYEE if he fails to meet the performance

standards herein set out or meet company rules, policies, and regulations. In addition,
the COMPANY retains its absolute and unqualified right to terminate the project based
employment of the EMPLOYEE at any time during the project based period, without
any liability to pay any separation pay, should the COMPANY find the employment of
the EMPLOYEE redundant, unneeded or unnecessary, and/or to transfer or reassign the
EMPLOYEE to any of its other projects at any time even without the consent of the
EMPLOYEE.

 RESIGNATION

The labor code recognizes two kinds of resignation – without cause and with
cause. If the resignation is without cause, the employee is required to give a 30-
day advance written notice to the employer, to enable the employer to look for
a replacement to prevent work disruption. If the employee fails to give a written
notice, he or she runs the risk of incurring liability for damages. Whether you will
receive your salary or not, it depends on the decision of the company.

With cause, Employee will not receive back pay depending on company’s
discretion.

3 months below employees will not receive back pay and will only receive the
remaining days that said employee reported.

In the event that an employee is said to be AWOL (Absent Without Leave),


he/she will may not receive any amount that he/she demands because of the
fact that the employee did not formally filed a resignation or formally notified
the company about his or her willingness to continue to work or anything about
his/her employment status.

The salary and the other pending pays will be given 90 working days after the
employee formally submits a resignation letter through email and/or by formal
letter.

3. PERIOD OF VALIDITY OF AGREEMENT – The agreement shall be valid and subsisting


during the entire period of employment of the EMPLOYEE with the COMPANY and shall
remain in full force and effect for a period of one year from the termination date of
the EMPLOYEE employment, determined as of the time the EMPLOYEE submits an
unconditional statement in writing, duly received by the COMPANY, terminating his
project based employment.

4. RIGHT TO INJUNCTION, DAMAGES, AND OTHER LEGAL REMEDIES – Any violation of any
provision of this contract shall give the COMPANY the right to file for injunction and/or
a temporary restraining order against the EMPLOYEE and/or his agent, partners,
principals, associates or employers, plus a fifty (50%) share in all incomes, dividends,
profits, and/or compensation arising from, in relation to, connected with or as a
consequence of the competing venture, plus damages of not less than Php 20,000.00,
attorney’s fees of not less than Php 20,000.00, and cost of suit.

5. OTHER CONDITIONS – The failure of the COMPANY for any reasons whatsoever to
require or insist upon strict compliance of any of the terms and conditions of this
contract shall not be construed as a waiver of its right to enforce the same. The
invalidity of any provision hereof shall not affect or impair other provisions which
otherwise can be given full force and effect.

Should you be amenable to this appointment, please indicate your acceptance by affixing
your signature below, and forthwith, your project based appointment shall be in effect.
