Deoghar District Deoghar is in the name of Sri Nageshwar Prasad Sultaniya S/O Late Vanarasi
Lal Sultaniya
The aforementioned property is a Vacant Residential land which is originally recorded in the
name of Late. Kumar Ramanand Singh Later on through Land acquisition case No-07 of 1935-
36 Rani Ramawati devi and Rani Rameshwari Devi both wife’s of Late. Kumar Ramanand Singh
became the owners of the land describes in the schedule of land and they have been possessing
the same in peacefully.
The above mentioned Rampati Devi sold the said property 07 (seven) bigha 13 (thirteen) katta,
15 (fifteen) Dhur land and sold it to Mrs. Jagatmayi Devi wife of Mr. Girijanand Singh, without
dividing it within the house.
The above said Smt. Rameshwari Devi wife of Late Kumar Ramanand Singh and Smt.
Jagatmayi Devi W/o Shri Girijanand Singh kept the above relics 07 (seven) bigha, 13 (thirteen)
katta, 15 (fifteen) Dhur, while remaining unquestionably interfering in the form of Izmal dated
04.10.1980. registered from the registration office Deoghar, and built Two Pucca Room on Plot
No. 318
Later Rameshwari Devi and Jagmayi Devi sold the larger part of the property to Sri Sagar
Mohan Jha S/O Late Lakhpati Jha through sale deed no. 3092 in the year 1980.
Sri Sagar Mohan Jha further sold the property measuring 01 bigha, 01 kattha 05 dhur under plot
no. 317 to Sri Rama Nand Jha vide sale deed no. 2125 dated 04.09.1993.
Ramananda Jha sold the property to the vendor (Srimati Pramila Devi) vide sale deed no. 2176
dated 21.05.1994. Thereafter the said property was purchased by the vendee (Sri Nageshwar
Prasad Sultaniya) vide sale deed no. 239 dated 02.02.996.
Therefore, vendee Sri Nageshwar Prasad Sultaniya is in complete title and possession of the said
property and is paying taxes to the Government of Jharkhand.

The property is fit for equitable mortgage.

On perusal of above mentioned documents it can be said that the borrower Sri Nageshwar Prasad
Sultaniya has a clear, marketable, and unencumbered title to the property and they can create an
equitable mortgage in favour of the Bank subject to retrieval of Conversion Letter.

From the perusal of online Non-Encumbrance Certificate with respect to aforesaid property in
question, no registered encumbrance was found.
IV) That the lawyer has personally visited / his representative has visited the SRO and
conducted search / checked for encumbrances for the period of 13/ 30 years.

A Search has been conducted in the website of the Government of Jharkhand/District


Registrar/Sub Registrar - Deoghar, by me for 30 years.
V) That there are no encumbrances / charges on the said property found as a result of
the search conducted and if there are any charges the same needs to be highlighted.
