FORMATION OF NEW M.I. TANK ACROSS JILLEDUBANDA VAGU NEAR
GUDDAMPALLI THANDA, GUNJEPALLI (V), MUDIGUBBA (M), (PACKAGE-I)

(B) Non- acquisition of Land for execution of canals


During the course of execution of Head works the division prepared the Land
plan schedules for the canals and submitted to the Land Acquisition Officer /
R.D.O Penukonda on 10-08-2006 for acquisition of land to an extent of 123.20
acres towards execution of two canals. The department deposited an amount of Rs.
16-00 lakh on 09-03-2007 against the requirement of Rs.93-00 lakhs. The
department frequently reminding the Revenue authorities for early acquisition of
land without depositing the required funds. Even after lapse of seven years the
required land for execution of canals was not acquired.
On this being pointed it was replied that the SE addressed to the RDO/Land
Acquisition Officer, Penukonda for completion of land acquisition and handing over
for excavation of LF and RF canals. The same is awaited from the RDO.
Compliance may be intimated to audit.
Reply:
In the 1st revised sanctioned estimate provision for an amount of Rs.1, 29,
90, 000/- was made towards Land acquisition for Head works and Canals. During
execution of work an amount of Rs. 7566000/- was deposited with Revenue
Divisional Officer, Penukonda for finalization of Land acquisition of Head works
and the same was completed.
Regarding Land Acquisition for canals under Jilledubanda tank, the land
plan schedules for both the left and right side of canals for acquisition of land to an
extent of 123.20 acres were prepared and submitted to the LAO/RDO Penukonda
on 10-8-2006 by the Executive Engineer, I. B division, Dharmavaram. Further an
amount of Rs.16.00 Lakhs was also deposited on 9-3-2007 with the LAO/RDO,
Penukonda to take up the LA process. But, after lapse of about 7 years, the LA
officer has placed a requisition for the sanctioned award amount of Rs.1, 11,
17,552/- for acquisition of total land of 118.28 acres required for both LFMC &
RFMC of Jilledubanda tank. But an amount of Rs. 89,66,236/- (Rs 45,48,646/-
for LSMC and Rs 44,17,590/- for RSMC) was deposited with Revenue Divisional
Officer, Penukonda for finalization of Land acquisition for Excavation of L/S and
R/S canals. Accordingly the land acquisition process was completed for 112.62
acres against 118.28 acres originally proposed. The acquisition of balance land of
5.56 acres could not be completed due to non-submission of original documents to
the Revenue authorities by the Ryths for identification of Land owner, as they are
not willing to forgo their lands under land acquisition. The extent of land required
for land acquisition of Right & Left canals of Jilledubanda New M.I. tank are as
follows.
Patta Land : 31.56 Ac.
Govt. land : 17.32 Ac.
Assigned land : 67.56 Ac
Endowment land : 1.84 Ac.
Total extent : 118.28 Ac
Due to non-completion of LA in full shape the possession of lands required
for both canals could not be handed over to Irrigation Department and hence the
execution of canals could not be taken up so far.
Meanwhile based on the representation of Sri Kethireddy Venkata Rami Reddy
Garu the present Hon’ble M.L.A of Dharmavaram Constituency, the Jilledubanda
tank is proposed for conversion in to Reservoir with storage capacity of 2.18 TMC
and administrative approval for the same has been accorded by the Govt. vide
G.O.Rt No.459 Water Resources (Projects-III) department dated:02-09-2020 for
Rs.680.00 Crores under HNSS scheme and necessary action is being taken up by
the Chief Engineer (Projects), Ananthapuramu for grounding the work.
Hence before grounding of Jilledubanda MI tank in to reservoir, the existing
contract is to be closed duly settlement of all the accounts and claims if any of the
contractor to avoid further legal complications.
Hence, in view of the above the audit para may please be dropped.

(D)NON REVALIDATION OF B.G’S

Reasons for non validation of B.G’S

The contractor has stopped the work in August 2008.Inspite of several notices the
contractor not turned up to take up the balance work.In this circumstances the
contract was determined under the clause 60C of PS to APDSS.As per the clause 5
percent of the total cost of the project has to be recovered from the contractor.On
the scrutiny of the register it was observed that the BG bearing No 05013 Dt 28-06-
2005 for Rs 51,80,000/- was expired on 26-04-2006.The department neither
renewed the B.G nor encashed the same before epiry
The reasons for non renewal of the same and source of recovery of amount under
the above said clause may be stated as the deposits are necessary to make good to
the possible additional overburden due to revised cost of the work

REPLY
The Superintending Engineer Irrigation circle ,Ananthapuram
vide memo no F J5/JB Banda Head Works/DB-JTO-3/No-95DMM Dt 18-05-2006
the bank guarantee was redeemed to the agency vide this office Lr No:305M Dt 20-
05-2006.However after protracted correspondence with the agency and based on
the request of the contractor and recommendations of the Superintending
Engineer,the Chief Engineer ,Minor Irrigation,Hyderabad has issued instructions
to delete the balance work from the scope of existing contract of the existing
agency under clause 60C of P.S to APDSS and to take action to complete the head
works vide Chief Engineer,Minor Irrigation, Hyderabad memo No DCE/MI/OT2-
T2/1112/2003 Dt 28-07-2011.Accordingly the balance work is determined from
the scope of contract of the existing agency under clause of 60C of PS to APDSS
duly with holding all the dues to be paid to the contractor vide Executive Engineer
Proceedings No 2J1/VOL11/DB/ATO/NO 706M Dt 17.11.2011

In view of the above and also on the request of the contractor to settle all
his accounts and closing of contract the work slip for the work done upto LSXVII&
Part bill was approved by the Chief Engineer,Minor Irrigation for Rs 837.36 Lakhs
vide proceedings No DCE-2/OT2/T1/ATP /New MI tank across Jilledubanda vagu
Dt 19-02-2020.The final bill is to be paid to the contractor
