AN ORDINANCE REQUIRING MANDATORY VACCINATION

OF ALL PERSONS ACCESSING PUBLIC PLACES IN THE
CITY OF ISABELA, PROVINCE OF BASILAN

WHEREAS, pursuant to the 1987 Constitution and Section16 of the Local

Government Code of 1991, the City Government of Isabela shall be primarily responsible for
the promotion of the general welfare of its constituents;

WHEREAS, on March 8, 2020, the President of the Philippines issued Proclamation

No. 922 declaring a State of Public Health Emergency throughout the Philippines in order to
prompt a whole-of-government approach in addressing the COVID-19 outbreak;

WHEREAS, for the past several months after the declaration of the previous General
Community Quarantine, the City of Isabela has been under Modified General Community
Quarantine (GCQ), the lowest level of quarantine classification, due to the relatively few
number of COVID-19 cases in the city;

WHEREAS, recently, however, there is a surge in COVID-19 cases in Isabela City

with 67 active COVID-19 cases with 17 suspected cases as of December 1, 2021;

WHEREAS, there is an existing and real threat of the Omicron variant of COVID-19
possibly spreading into the general population if not mitigated;

WHEREAS, there is still a low percentage of the residents of Isabela City that are
vaccinated against COVID-19;

WHEREAS, there is a need to shore up the vaccination effort of the government in

order to reach out to a greater majority of the populace;

WHEREAS, scientific evidence dictates that unvaccinated persons are more likely to
get infected and spread corona virus than the vaccinated ones;

NOW THEREFORE, BE IT ORDAIN, AS IT IS HEREBY ORDAINED, by the 7th

Sangguniang Panlungsod of Isabela in session assembled that:

SECTION 1. Title – This ordinance shall be known as, “Mandatory COVID-19

Vaccination Ordinance”.

SECTION 2. Coverage – This ordinance shall cover all persons accessing public
places in Isabela City Basilan.

SECTION 3. Mandatory Vaccination – It is hereby declared as the policy of the city

SECTION 3. Appropriation – The amount of PhP540,000.00 from the

_____________________ under the 2021 Budget Ordinance is hereby realigned and
reappropriated to an item: NON-OFFICE-ALLOWANCE/HONORARIUM TO NATIONAL
GOVERNMENT AGENCIES under the Office of the Mayor which shall be used for the
payment of the said allowance from the effectivity of this Ordinance to December 2021.
Thereafter, the said allowance/honorarium shall be included in the Budget Ordinance every
year unless revoked or amended by legislative action.

SECTION 4. Copies of this Ordinance shall be furnished to the Office of the City
Budget, City Treasurer, Accounting Office, City Auditor, City Prosecutor and Executive
Judges of the RTC and MTC and Head of Public Attorney’s Office (PAO).

SECTION 5. Separability Clause – If for any reason or reasons any part or

provisions of this ordinance shall be held to the unconstitutional or invalid, other parts or
provision hereof which are not affected thereby shall continue to be in full force or effect.

SECTION 6. Repealing Clause. All previous ordinances inconsistent with this

ordinance shall be deemed repealed or modified accordingly

SECTION 7. Effectivity Clause – This ordinance shall take effect immediately.

ENACTED, by the 7th Sangguniang Panlungsod of Isabela this ____ day of

January 2022, on its ___ Regular Session.
