Both the First Party and the Second Party are hereinafter referred to as ( The Parties/ Both Parties) in this Job Offer and
Annex thereof.
‫ﺗﻤﮭﯿﺪ‬:

‫ ﻟﺬا ﻗﺎﻡ )أﻭ ﻗﺎﻣﺖ ( ﺑﺘﻘﺪﻳﻢ ھﺬا اﻟﻌﺮﺽ إﻟﻴﻪ )أﻭ‬، ‫ﺣﻴﺚ أﺑﺪﻯ اﻟﻄﺮﻑ اﻷﻭﻝ ﺭﻏﺒﺘﻪ ﻓﻲ اﻟﺘﻌﺎﻗﺪ ﻣﻊ اﻟﻄﺮﻑ اﻟﺜﺎﻧﻲ ﻟﺘﺸﻐﻴﻠﻪ ﻟﺪﻳﻪ )أﻭ ﻟﺪﻳﻬﺎ ( ﻓﻲ اﻟﻌﻤﻞ اﻟﻤﻮﺿﺢ أﺩﻧﺎﻩ‬

Preamble

Whereas the First Party desires to contract with the Second Party to employ the latter to carry out the below-mentioned
job, the First Party has granted the Second Party this Job Offer including the following terms:
( ‫اﻟﺒﻨﺪ ) اﻷوﻝ‬

(‫ ﺑﺪﻭﻟﺔ اﻻﻣﺎﺭاﺕ اﻟﻌﺮﺑﻴﺔ اﻟﻤﺘﺤﺪﺓ ﻓﻲ إﻣﺎﺭﺓ ﺩﺑﻲ )ﺗﺤﺪﻳﺪ اﻻﻣﺎﺭﺓ ﺣﻘﻞ اﺧﺘﻴﺎﺭﻱ‬،‫ أﻭ ﻭﻅﻴﻔﺔ ﻣﻬﻨﺪﺱ ﺗﻌﺪﻳﻦ‬/ ‫ﻳﻠﺘﺰﻡ اﻟﻄﺮﻑ اﻟﺜﺎﻧﻲ ﺑﺄﻥ ﻳﻌﻤﻞ ﻟﺪﻯ اﻟﻄﺮﻑ اﻷﻭﻝ ﺑـ ﻣﻬﻨﺔ‬
First Article

The Second Party shall work for the First Party in the job/profession of Mining Engineer within the UAE, (Dubai).
( ‫اﻟﺒﻨﺪ ) اﻟﺜﺎﻧﻲ‬

‫ ﻭﻣﻦ ﺗﺎﺭﻳﺦ‬، ‫ ﻭﺗﺒﺪأ اﻟﻤﺪﺓ ﻣﻦ ﺗﺎﺭﻳﺦ ﺩﺧﻮﻝ اﻟﻄﺮﻑ اﻟﺜﺎﻧﻲ ﻟﻠﺪﻭﻟﺔ إﺫا ﻛﺎﻥ ُﻣﺴﺘﻘﺪﻣﺎ ً ﻣﻦ ﺧﺎﺭﺟﻬﺎ‬، ‫ﻳﻜﻮﻥ اﻟﻌﻘﺪ اﻟﺬﻱ ﻳﺒﺮﻡ ﺑﻨﺎًء ﻋﻠﻰ ھﺬا اﻟﻌﺮﺽ ﻣﺤﺪﺩ اﻟﻤﺪﺓ ﺑﺴﻨﺘﻴﻦ‬
.‫ﺗﻌﺪﻳﻞ ﻭﺿﻌﻪ إﺫا ﻛﺎﻥ ﺩاﺧﻞ اﻟﺪﻭﻟﺔ‬
Second Article

The Contract to be executed under this Job Offer shall be with a limited term of two years commencing from the date of
entering the State by the Second Party in case of being employed from abroad and as of the date of status amendment in
case of being contracted with from inside the State.

( ‫ ﺷﻬﺮ‬6) ‫ ﻭﺗﻜﻮﻥ ﻣﺪﺓ ھﺬﻩ اﻟﺘﺠﺮﺑﺔ‬، ‫ﻳﻌﻤﻞ اﻟﻄﺮﻑ اﻟﺜﺎﻧﻲ ﻟﺪﻯ اﻟﻄﺮﻑ اﻷﻭﻝ ﺗﺤﺖ اﻟﺘﺠﺮﺑﺔ‬
Third Article

The Second Party MAY work under a probation period of (6 month/s) to the First Party.

. ‫ ﻭﻳﻠﺘﺰﻡ اﻟﻄﺮﻑ اﻷﻭﻝ ﺑﺘﺤﺪﻳﺪ ھﺬﻩ اﻷﻳﺎﻡ ﻭإﻋﻼﻡ اﻟﻄﺮﻑ اﻟﺜﺎﻧﻲ ﺑﻬﺎ ﻣﻦ ﺗﺎﺭﻳﺦ ﺑﺪء ﻋﻼﻗﺔ اﻟﻌﻤﻞ‬، 1 ‫ﺗﻜﻮﻥ اﻟﺮاﺣﺔ اﻷﺳﺒﻮﻋﻴﺔ ﻟﻠﻄﺮﻑ اﻟﺜﺎﻧﻲ ﻟﻤﺪﺓ ﻳﻮﻡ‬
Fourth Article

The Second Party’s weekly rest shall be 1 day(s). The First Party shall determine such day(s) and inform the Second Party
thereof at the commencement date of the employment relationship.

:‫ ) اﻟﻔﺎﻥ ﻭﺧﻤﺴﻤﺎﺋﺔ ﺩﺭھﻤﺎ( ﻭﻳﺸﻤﻞ ھﺬا اﻷﺟﺮ اﻵﺗﻲ‬AED 2500 ‫ أﺟﺮ ﺷﻬﺮﻱ ﻣﻘﺪاﺭﻩ‬: ‫اﺗﻔﻖ اﻟﻄﺮﻓﺎﻥ ﻋﻠﻰ أﻥ ﻳﻌﻤﻞ اﻟﻄﺮﻑ اﻟﺜﺎﻧﻲ ﻟﺪﻯ اﻟﻄﺮﻑ اﻷﻭﻝ ﻣﻘﺎﺑﻞ‬

‫ ﻁﺒﻘﺎ ً ﻟﻠﻨﻈﻢ اﻟﻘﺎﻧﻮﻧﻴﺔ اﻟﺘﻲ ﺗﻘﺮﺭھﺎ اﻟﻮﺯاﺭﺓ‬، ‫ ﻭﻗﻴﺎﻡ اﻟﻄﺮﻑ اﻟﺜﺎﻧﻲ ﺑﺎﺳﺘﻼﻡ ھﺬا اﻷﺟﺮ‬، ‫ﻭﻳﻜﻮﻥ اﻟﺘﺰاﻡ اﻟﻄﺮﻑ اﻷﻭﻝ ﺑﺴﺪاﺩ اﻷﺟﺮ‬
Fifth Article

Both Parties agree that the Second Party shall work for the First Party in return for Monthly Wage of 2500 AED (Two
thousand five hundred) . Such wage shall include:
The Basic Salary at an amount of AED 2000(Two thousand)
Allowances:
These allowances should include without limitation:
Housing Allowance: AED 250(Two hundred fifty)
Transport Allowance: AED 250(Two hundred fifty)
Other Allowances :
The First Party shall pay the wage and the Second Party shall receive the wage according to the regulations determined by
MOHRE.
( ‫اﻟﺒﻨﺪ ) اﻟﺴﺎدﺱ‬

‫ ﻭﻻ ﻳُﻠﺰﻡ أﻱ ﻁﺮﻑ ﻣﻦ اﻟﻄﺮﻓﻴﻦ ﺑﺎﺳﺘﻤﺮاﺭ ﺗﻌﺎﻗﺪﻩ ﻣﻊ اﻟﻄﺮﻑ اﻵﺧﺮ‬، ‫ ﻋﻼﻗﺔ ﺗﻌﺎﻗﺪﻳﺔ ﺭﺿﺎﺋﻴﺔ‬، ‫ اﻟﺘﻲ ﻳﻨﻈﻤﻬﺎ اﻟﻌﻘﺪ اﻟﺬﻱ ﻳُﺒﺮﻡ ﺑﻨﺎء ﻋﻠﻰ ھﺬا اﻟﻌﺮﺽ‬، ‫ﻋﻼﻗﺔ اﻟﻌﻤﻞ‬
ً ‫ ﻋﻠﻰ أﻥ ﻳﺘﺤﻤﻞ اﻟﻄﺮﻑ اﻟﺬﻱ ﻳ ُﻨﻬﻰ اﻟﻌﻼﻗﺔ ﺑﺈﺭاﺩﺗﻪ اﻟﻤﻨﻔﺮﺩﺓ ﻛﺎﻓﺔ اﻟﺘﺒﻌﺎﺕ اﻟﻘﺎﻧﻮﻧﻴﺔ اﻟﻤﺘﺮﺗﺒﺔ ﻋﻠﻰ ﺫﻟﻚ ﻭﻓﻘﺎ ً ﻟﻤﺎ ھﻮ ًﻣﺤﺪﺩ ﺑُﻤﻠﺤﻖ ھﺬا اﻟﻌﺮﺽ ﻭﻭﻓﻘﺎ‬، ‫ﺑﻐﻴﺮ إﺭاﺩﺗﻪ‬
‫ ( ﻣﻦ ﺑﻨﻮﺩ ُﻣﻠﺤﻖ ھﺬا‬2 ) ‫ ﻭﺗﻨﺘﻬﻲ ﻋﻼﻗﺔ اﻟﻌﻤﻞ ﺑﻴﻦ اﻟﻄﺮﻓﻴﻦ إﺫا ﺗﻮاﻓﺮﺕ ﺣﺎﻟﺔ ﻣﻦ اﻟﺤﺎﻻﺕ اﻟﻤﻨﺼﻮﺹ ﻋﻠﻴﻬﺎ ﻓﻲ اﻟﺒﻨﺪ‬. ‫ﻷﻳﺔ أﻧﻈﻤﺔ ﻗﺎﻧﻮﻧﻴﺔ أﺧﺮﻯ ﺳﺎﺭﻳﺔ ﺑﺎﻟﻮﺯاﺭﺓ‬

Sixth Article

The labour relation governed by the Contract executed under this Job Offer, shall be a contractual, consensual
relationship. Neither Party shall be obliged to continue such contractual labour relationship with the other Party without its
consent, provided that the Party terminating the Contract at its sole discretion shall bear all legal consequences resulting
therefrom as stipulated in the Annex enclosed herewith and according to any MOHRE Applicable Laws. The labour
relationship between both Parties shall end if any of the events set forth in Article (2) of the Annex enclosed herewith
occurs.

ْ ‫ﻳﻘﺮ اﻟﻄﺮﻑ اﻷﻭﻝ ﺑﺄﻧﻪ أ‬

‫ﻁﻠَﻊ اﻟﻄﺮﻑ اﻟﺜﺎﻧﻲ ﺗﻔﺼﻴﻠﻴﺎ ً ﻋﻠﻰ ﻛﺎﻓﺔ اﻟﺒﻨﻮﺩ اﻟﻮاﺭﺩﺓ ﻓﻲ ُﻣﻠﺤﻖ ھﺬا اﻟﻌﺮﺽ ) ﺳﺒﻌﺔ ﺑﻨﻮﺩ( ﻛﻤﺎ ﻳﻘﺮ ﺑﺄﻥ اﻟﻄﺮﻑ اﻟﺜﺎﻧﻲ ﻗﺎﻡ ﺑﻘﺒﻮﻝ ﻭﺗﻮﻗﻴﻊ ھﺬا‬
‫اﻟﻌﺮﺽ ﻓﻲ ﺩﻭﻟﺔ اﻻﺳﺘﻘﺪاﻡ أﻭ ﺩاﺧﻞ اﻟﺪﻭﻟﺔ‬
Seventh Article

The First Party acknowledges that it has informed the Second Party of all the articles stipulated in the Annex enclosed
herewith (a number of 7 articles) and that the Second Party has accepted and signed this Offer in the State of Recruitment
or within the UAE.

‫ﻁَﻠﻊ ﺗﻔﺼﻴﻠﻴﺎ ً ﻋﻠﻰ ﻛﺎﻓﺔ اﻟﺒﻨﻮﺩ اﻟﻮاﺭﺩﺓ ﻓﻲ ُﻣﻠﺤﻖ ھﺬا اﻟﻌﺮﺽ ) ﺳﺒﻌﺔ ﺑﻨﻮﺩ( ﻭَﻋِﻠﻢ ﺑﻜﺎﻓﺔ ﻣﺎ ﺗ ﱠ‬
‫ ﻛﻤﺎ ﻳﻘﺮ ﺑﺄﻧﻪ ﻗﺎﻡ ﺑﻘﺒﻮﻝ‬،‫ﻀﻤﻨﺘﻪ ﻣﻦ أﺣﻜﺎﻡ‬ َ ‫ﻳُﻘﺮ اﻟﻄﺮﻑ اﻟﺜﺎﻧﻲ ﺑﺄﻧﻪ إ‬
.‫ﻭﺗﻮﻗﻴﻊ ھﺬا اﻟﻌﺮﺽ ﻓﻲ ﺩﻭﻟﺔ اﻻﺳﺘﻘﺪاﻡ أﻭ ﺩاﺧﻞ اﻟﺪﻭﻟﺔ‬
Eighth Article

The Second Party acknowledges that it has thoroughly reviewed all the articles stipulated in the Annex enclosed herewith
(7 articles), and he is well aware of all contained provisions and that he has accepted and signed this Offer in the State of
Recruitment or within the UAE.
( ‫اﻟﺒﻨﺪ ) اﻟﺘﺎﺳﻊ‬

‫ ﻛﻤﺎ ﻳﻘﺮاﻥ أﻧﻪ ﻓﻲ ﺣﺎﻝ ﺗﺠﺪﻳﺪ اﻟﻌﻘﺪ اﻟﺬﻱ ﻳُﺒﺮﻡ‬، ‫ ﻭﻳﻠﺘﺰﻣﺎﻥ ﺑﻜِﻞ ﻣﺎ ﻭﺭﺩ ﻓﻴﻬﺎ‬، ً ‫ ﻭُﻣﻜﻤﻠﺔ ﻟﻪ ﺗﻤﺎﻣﺎ‬، ‫ﻳُﻘﱡﺮ اﻟﻄﺮﻓﺎﻥ ﺑﺄﱠﻥ ﻛﺎﻓﺔ ﺑﻨﻮﺩ ُﻣﻠﺤﻖ ھﺬا اﻟﻌﺮﺽ ﺟﺰٌء ﻻ ﻳﺘﺠﺰأ ﻣﻨﻪ‬

Ninth Article

Both Parties acknowledge that the articles stipulated in the Annex enclosed herewith shall constitute an integral and
complementary part thereof and shall be binding on both Parties. Both Parties shall further acknowledge that in case of
renewing the Contract executed under this Offer, either Party may terminate the Contract during the renewed period,
provided that such Party notifies the other Party of such desire within (1 Months) prior to the date of termination. The
labour relation shall remain effective throughout such period along with paying the termination wage to the other Party at
the value of the Worker’s total wage in (1 Months).

‫ اﺻﺪاﺭ ﺗﺼﺮﻳﺢ اﻟﻌﻤﻞ‬.
Eleventh Article

This Job Offer has been made up of three counterparts duly signed by both parties. Each party shall receive and retain a
copy thereof and the third one shall be submitted by the First Party to the MOHRE as a prerequisite for issuance of the
work permit.
