AFFIDAVIT of WITNESS
I, CHRISTIAN HARVEY N. WONG of legal age, Married,
Filipino, and a resident of Catalunan Grande, Davao City, Philippines,
after having been duly sworn to in accordance with law, do hereby
depose and state that:

1. I am voluntarily executing this Affidavit in connection with

file the criminal complaint for MALICIOUS MISCHIEF
under Art. 327 of the Revised Penal Code against
Respondent VERGEL G. PASPAS, who may be served with
notices, orders and processes at his residence at Catalunan
Grande, Davao City, Philippines;
2. I am the Barangay Chairman of Barangay Catalunan Grande;
3. On July 26, 2021, around 9 in the morning Vergel G. Paspas
(MR. PASPAS), visited the Barangay Hall. Thereinafter, he
came by my office to complain about his neighbour ALEXIS
M. JAVIER (MR. JAVIER);
4. MR. PASPAS said he wanted to report MR. JAVIER because
he damaged the fence dividing their 2 lots 2 days ago;
5. I asked him if he has proof and he merely stated "ang koral
man na nagtunga sa among lote ang naguba, siya jud to wa
nay lain!", (It was the fence dividing our two lot's that was
damaged so it can't be anyone else but him!)
6. I told him that I will visit the place later that day and set a date
for conciliation, however, he just said "kadugay ba ninyo
mulihok! sayang among buwis na ginabayad!" after the
remark he left the barangay hall (You people work too slowly,
Our taxes are being wasted!);
7. At around 1 PM MR. JAVIER visited the barangay hall and
complained about MR. PASPAS for damaging his 3 year old
mango tree worth 7, 000 pesos LAST AUGUST 25, 2021;
8. He filed a complaint with the barangay with his witness Mr.
Englatera Lorenzo. The Lupon later that day, convened and
set a date for a conciliation and mediation between Mr. Javier
and Mr. Paspas on July 29, 2021. We served summons to both
parties, however, only Mr. Javier appeared before the Lupon;
9. The Lupon thereafter, set another schedule on August 2, 2021.
But Mr. PASPAS also did not appear even after summons.
Another schedule was set on August 5, 2021 and again, MR
PASPAS did not appear even after summons.
10. Thereafter on August 5, 2021 we issued a Certificate to File
Action to Mr. Javier so that he may file any appropriate action
in court or whichever tribunal concerned;
 11. I am executing this Affidavit to inform the authorities and to
attest to the truthfulness of the foregoing facts.
