MEMORANDUM OF AGREEMENT

This Memorandum of Agreement entered into and executed by and between:

The NORTHWESTERN MINDANAO STATE COLLEGE OF SCIENCE


AND TECHNOLOGY (NMSCST), a higher educational institution established by
virtue of Republic Act (R.A.) 9146 with present address at Labuyo, Tangub City,
Misamis Occidental, represented herein by its President, DR. HERBERT GLENN
P. REYES, herein after referred to as the FIRST PARTY;

RUTGERS, THE STATE UNIVERSITY OF NEW JERSEY (RUTGERS) on


behalf of the School of Environmental and Biological Sciences (SEBS), an
institution of higher learning established by the legislature of the State of New
Jersey, United States of America, in 1956, with principal office at New Brunswick,
New Jersey, United States of America, duly represented by its Executive Vice
President for Academic Affairs, DR. PRABHAS V. MOGHE herein after referred
to as the SECOND PARTY;

WITNESSETH

WHEREAS, the NORTHWESTERN MINDANAO STATE COLLEGE OF SCIENCE


AND TECHNOLOGY (NMSCST), as an institution of higher learning is mandated to
provide technological, professional, research and extension programs to form
principled men and women of competencies and skills responsive to local and
global development needs;

WHEREAS, RUTGERS, THE STATE UNIVERSITY OF NEW JERSEY


(RUTGERS) is an active partner of the NMSCST in the conduct of capability building
initiatives to enhance the research, development, extension and planning skills of its
faculty members for higher productivity;

WHEREAS, the FIRST PARTY, needs consultant/partners who can provide


technical assistance in the capability building of the college in sustaining the FIRST
PARTY’s journal publication and to elevate the status of its journal indexing;

WHEREAS, the FIRST PARTY, in its efforts to establish its existing


research journal to be indexed at the international level, continuously publish
scientific articles for the on-line visibility in reputable journal indexing organizations

WHEREAS, the SECOND PARTY, has experts in scientific journal


management and operation and is willing to provide assistance to the FIRST PARTY
in sustaining the quality of research paper publications.;

WHEREAS, the FIRST PARTY, would like to tap the services of the
consultants/and or experts of the SECOND PARTY who will provide assistance in
training and capacity building in creating and sustaining quality papers for
publication;
NOW, THEREFORE, for and its consideration of the foregoing premises
and the terms and conditions hereinafter set forth, the parties agree as they have
agreed as follows:

I. OBLIGATIONS OF THE NMSCST

1. Shall agree on engagement;


2. Shall shoulder the transportation and other incidental expenses incurred
by the Experts/and or Consultants of the SECOND PARTY;
3. Shall provide funding and mechanisms for the conduct of workshops
and seminars in capacity building for journal publication.

II. OBLIGATIONS OF RUTGERS

1. Shall provide experts/consultants to the FIRST PARTY depending


on the availability of their schedule;
2. Shall provide capability building and mentoring activities for the
publication staff and faculty of the FIRST PARTY;

III. This Memorandum of Agreement shall take effect upon signing of this document
and shall remain valid and effective for three (3) years unless terminated by any or
both of the parties.

IV. Any additional engagement between the parties shall be documented by an


agreement setting forth the terms and conditions of that engagement.

V. DISPUTE RESOLUTION

In case of breach or when disagreement arises in the interpretation or


implementation of this MOU, both parties shall endeavor to settle the matter
amicably within sixty (60) days from the receipt of a notice by the other party
in the following manner:

1. A notice in writing shall be sent by the concerned party to the other


party stating therein the basis for each for the breach or disagreement.
2. The parties shall thereafter set a meeting/s for the purpose of settling
the matter amicably.
3. All agreements shall be reduced in writing and signed by the parties or
their duly appointed representatives.

All such conflicts which cannot be decided by negotiation and/or mediation


shall be decided through the rules on arbitration in RA 876.
