MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement (“Agreement”) is entered into by and between the


following:

ACT AND SAVE THE YOUTH ASSOCIATION, INC., a private, non-profit


organization existing under and by virtues of the laws of the Republic of the Philippines with
principal address Block 1, Lot 2 Flamingo St. Brgy. Kaligayahan, Quezon City represented
by the Chairwoman of the Organization, Lydia G. Lasco, hereinafter referred to as the FIRST
PARTY,

-and-

The Local Government of Brgy Kaligayahan, a local government unit, located at


Kaligayahan Barangay Hall, Mockingbird, Quezon City hereinduly represented by the
Officer in Charge of its Human Resources Department,hereinafter referred to as the
SECOND PARTY;

Withesseth: --

WHEREAS, the FIRST PARTY has established a professional and support program
for youth and children which was duly approved by the security and exchange commission
(SEC);

WHEREAS, one of the objectives of the program is to facilitate emergency relief


programs for children in response to disasters and other emergency situation to the utmost
support and assistance necessary for immediate recovery and protection. ;

WHEREAS, the FIRST PARTY has chosen the SECOND PARTY as one of the
former’s venue for practicum purposes given the latter’s extensive resources and its
proximity;

WHEREAS, the SECOND PARTY has agreed to cooperate with the FIRST PARTY
in the utilization of the former’s premises and facilities as an extension for relief operation
program;

NOW THEREFORE, for and in consideration of the foregoing premises, the parties
bind themselves to the following terms and conditions:

Obligations of the FIRST PARTY

1. The FIRST PARTY shall provide the SECOND PARTY with the copy of the
upcoming relief programs and operations.

2. The FIRST PARTY will provide the SECOND PARTY with the list or target
number of beneficaries, the nature of the relief operation program, the schedule
when the program will be facilitated and the total number of members under the
program which will be expected to be present.
3. The FIRST PARTY undertakes to inform the participating beneficiaries to follow
the minimum standard health protocol before the relief operation program.

4. The FIRST PARTY will designate a Coordinator who will coordinate with the
SECOND PARTY regarding the emergency relief program, assist in ongoing task
and resolve any dispute which may arise during operation.

5. The FIRST PARTY, through the Coordinator, shall monitor or observe the
ongoing the relief operation.

6. The FIRST PARTY agrees not to use the name of the SECOND PARTY in any
publication or advertising, except in providing reports.

Obligation of the SECOND PARTY

1. The SECOND PARTY shall ready to provide utmost assistance to ensure orderly
distribution of goods or services to the public.

2. The SECOND PARTY shall ready to provide assistance through its tanods
and/or barangay health emergency response team, the latter of which may
provide standby ambulances or medical facilities if available.

3. The SECOND PARTY agrees to fix and confirm the dates of the operation in
such a way to conflict schedules, if any, as provided by the FIRST PARTY.

4. s Before the actual commencement of any relief operation program, the


SECOND PARTY shall conduct an orientation lecture in order to appraise the
participating members and working protocols of the SECOND PARTY.

5. The SECOND PARTY is primarily responsible for the actual assistance and
control sfor any incidents arising from operations.

6. The SECOND PARTY shall coordinate with the coordinator regarding any
concern involving any of the operations particularly in matters of health protocols
and regulations and their progress while in the field.

7. The SECOND PARTY shall coordinate with the coordinator regarding any
concerns such as like setting a cut-off time for persons in a queue, limiting the
number of people served each day, using marshals to enforce health protocols,
and delineating locations for queues.
By signing below, both parties consent to the terms of this agreement.

General Terms and Conditions

1. This agreement shall be effective beginning May 2021 and ending on May
2024.Either party may terminate this agreement based on just grounds by giving the
other a written notice of not less than thirty (30) days prior to the end of the current
term.

2. The determination of the number of students to be assigned to the placement shall


be subject to separate discussion between the parties. In case of any serious
dispute, the decision of the SECOND PARTY shall prevail.

3. Both parties undertake not to discriminate against any beneficiaries based on


gender, age, religion, disability or sexual orientation.

4. Both parties are in agreement that the beneficiaries are not employees of the
SECOND PARTY and that the program is not intended to support any regular
employees nor any existing for prospective labor-outsourcing contracts.

5. The parties agree that donations or any support and assistance shall be provided by
the SECOND PARTY in relation with the participation of the beneficiaries in the
emergency relief operation program.
