PETITION FOR HABEAS CORPUS
OF CZAR P. DELA CRUZ

PETITIONER, by and through the undersigned counsel, unto this Honorable Court most
respectfully avers that:

1. Petitioner is a mother of CZAR PUNZALAN Y DELA CRUZ.

2. On May 23, 1988, on or about 3 o’clock in the afternoon, CZAR went to MUNICIPAL
POLICE STATION of Bula, Camarines Sur, together with the three (3) in-uniform
personnel of the said police station.

3. One of the Police Officer told CZAR and I that the former is invited to their station
for the alleged crime that happened in Angeles City, Pampanga.

4. Due to the trust and confidence to the said officers and being innocent of my son
( CZAR ), notwithstanding the absence of warrant of arrest, I allowed the latter to go
in the aforementioned police station.

5. I assumed that the said interview will not last for an hours, but to the contrary, the
whole night, my son did not return back to our residence.

6. On May 24, 1988, early in the morning, together with our brgy. Chairman, HON.
WINSTON T YUTA, we went to the BULA MUNICIPAL POLICE STATION to know the
whereabouts of my son. However, the police officers on duty told us that CZAR
PUNZALAN Y DELA CRUZ has left their station right after the interview, more or less
5 o’clock in the afternoon.
 7. As we go back to our residence and for 5 days of waiting the return of my son, as of
this moment, the latter’s whereabouts is still unknown.

8. Petitioner believe that the respondent is responsible to this incident considering that
the PNP personnel is the last person who has custody to my son.

WHEREFORE, petitioner respectfully pray that a WRIT OF HABEAS CORPUS be issued

directing Respondent to show CZAR PUNZALAN Y DELA CRUZ and disclose to this honorable
court the crime charged to the latter.
