Suit for Partition and injunction, valued at Rs 70,000/- for Partition Rs 100/- for injunction altogether
valued at Rs 70,100

The plaintiff above named begs to state as under:-

1. All that part and parcel of land measuring 4 Cottah, 4 Chittaks with two storid building thereon
known as 2/64, Naktal, 2nd Pally, P.O: Naktala, P.S. Netaji Nagar (Previously Jadavpur) within the
limits of Kolkata Municipal Corporation, Kolkata-700047, District: 24 Parganas(South), morefully
described in schedule hereunder, is the subject matter of this suit, herein after referred to as
the suit property, which situated within the jurisdiction of this Ld. Court.
2. That originally, the plotof land under the suit property was occupied by Smt. Renu Das
Chowdhury @ Smt. Priti Renu Das Chowdhury, being a refuse displaced from East Pakstan(by
constructing a hutment) thereon after the Partition of India for long and subsequently according
to the Rehabilitation Project, the said plot was acquired by the Government of West Bengal to
hand over the same to the Refugee Rehabilitation Department Goverment of West Bengal to
confer absolute right, title, interest by ways of gift.
3. That as aforesaid, Smt. Renu Das Chowdhury@ Smt. Priti Renu Das Chowdhury, obtained a
registered Deed of Gift on 25th May 1988 with conditions stated in the said registered deed
executed in her favour by R.R. Department, Government of West Bengal With a plan annexed
therein.
4. That at the relevant point of time she used to live there along with her husband and two sons
namely Binoy Kumar Das Chowdhury and Bimol Kumar Das Chowdhury and she died on
16.04.1998 and in such circumstances, aforesaid sons became absolute owners to record their
names in the Kolkata Municipal Corporation record.
