AN ORDINANCE REGULATING COCKFIGHTING, PRESCRIBING GUIDELINES FOR THE


GRANT OF AUTHORITY AND LICENSE TO ESTABLISH, OPERATE AND MAINTAIN A
COCKPIT, AND OTHER REGULATIONS RELATIVE THERETO IN THE MUNICIPALITY OF
IGBARAS, ILOILO

WHEREAS, per PD 449 or Cockfighting Law of 1974, Cockfighting has been and is still
a popular, traditional and customary form of recreation and entertainment among Filipinos
during legal holidays, local fiestas, agricultural, commercial and industrial fairs, carnivals or
expositions;

WHEREAS, the same law further states that by the reason of the afore stated meaning
and connotation of cockfighting in relation to Filipino customs and traditions, it should neither be
exploited as an object of commercialism or business enterprise, nor made a tool of uncontrolled
gambling, but more as a vehicle for the preservation and perpetuation of native Filipino heritage
and thereby enhance our national identity;

WHEREAS, it should be endeavored to make this recreation and entertainment


accessible to all, rich and poor alike and also our elderly even in far flung barangays of this
Municipality;

WHEREAS PD 449 also allows cockfighting in parks and playgrounds for the benefits of
tourists, visiting guests and dignitaries (PD 449, section 5(e)). Barangay fiestas are among the
occasions wherein there are influx of guests, tourists, and balikbayans that may be provided
with entertainment by cockfighting;

WHEREAS, Section 447, paragraph 3, sub-paragraph 4 of the Local Government Code


of 1991 provides, among the functions of the Sanggunian, “that any law to the contrary
notwithstanding, authorize and license the establishment, operation and maintenance of
cockpits and regulate cockfighting and commercial breeding of gamecocks provided existing
rights should not be prejudiced”;

WHEREAS, under the same Code, likewise devolved to the Municipality the power to
regulate cockfighting and the operation of cockpit.

Now therefore, be it enacted by the Sangguniang Bayan, this Municipality, that

Section I. Title.
This Ordinance shall be known as “An Ordinance Regulating Cockfighting, Prescribing
Guidelines for the Grant of Authority and License, to Establish, Operate, and Maintain a Cockpit
and Other Regulations Relative Thereto in the Municipality of Igbaras, Iloilo or ”Cockfighting
Ordinance of Igbaras” for brevity.

Section II. Definition of Terms.

The following terms when used in this Ordinance shall be construed as follows:

a. Authority and License to Establish, Operate and Maintain a Cockpit (ALEOMC)-


a privilege granted by the Municipality through the Sangguniang Bayan to an
individual or entity to establish, operate and maintain a cockpit for a specified
period.
b. Bet Taker (Kristo)- refers to a person who calls and takes care of the bets from
owners of both gamecocks and those of other bettors before he orders
commencement of the cockfight and thereafter distributes won bets to the
winners after deducting a certain commission, or both.
c. Cashier (Montonan)- a person taking care of bets of the owner of the fighting
cocks both winners and losers; collects the bets from the loser’s owner of
gamecock and give it to the winners; is a person in authority to collect pot money
during derbies and determines how much is the plasada or tax being collected
per fight/sultada.; also determines the gross and net income of every activity
being held; and also releases the salary of the cockpit officials and employees
thereafter per end of events.
d. Cockfighting- is a sport of pitting or matching gamecocks to engage in an actual
fight where bets on either side are laid. Cockfighting may also be formed as
“cockfighting derby or pintakasi”.
e. Cockpit Premises- includes all spaces within the fence/enclosure of the
establishment.
f. Derby- is an invitational cockfight participated in by game cockers or cockfighting
aficionados with “pot money” awarded to the proclaimed winning entry.
g. Fighting Cock/Gamecock- also called a rooster, refers to domesticated fouls,
whether imported or locally bred, as well as native fighting cocks indigenous to
the country, trained and conditioned for actual fighting or for propagation and
breeding purposes for eventual use in cockfighting.
h. Gaff and Blade Inspector- a person knowledgeable in securing the knife/blade
being used in cockfighting to avoid syndicate and foul fights during the events.
i. Gaffer (Taga-tari) – a person knowledgeable in the art of arming fighting cocks
with gaffs on their both legs.
j. Gater- persons who screens and receives admission-tickets issued by the
cashier to ticket buyers as a condition to gain access inside the cockpit.
k. Matchmaker- a person in charge looking for a pair of match during hack fights
and search for the same weight of fighting cocks to be matched during derbies.
l. Pit Manager- a person who professionally or regularly manages a cockpit and
cockfights therein, who may or may not be the owner of the cockpit.
m. Promoter- a person licensed by the municipality such, who is engaged in the
convening, meeting, holding and celebration of especially programmed and
arranged cockfighting like derbies or competition, special matched set to or
encounters, pintakasi and ordinary fights or hack fights.
n. Referee (Sentenciador)- a person who watches and oversees the proper gaffing
of fighting cocks, determines the physical condition of fighting cocks while
cockfighting is in progress, the injuries sustained by the cocks and their capability

to continue fighting and decide and makes known his decision by sign gestures
and the result of the cockfight by announcing the winner or declaring a tie or no
contest game.
o. Special Cockfights- also known as “pintakasi” or derby for charitable and non-
profit purposes.
p. Weigher- person in charge in collecting weights of the participating gamecocks
from farms of the owners and to submit to the matchmaker.
q. Existing Cockpit Operator/Owner - one who operated and owned a cockpit in the
Municipality of Igbaras without a definite term or period that ceased to operate
only in 2019 with the occurrence of the COVID-19 pandemic.
r. Existing Right to a Cockpit - right granted to operate a cockpit for a certain term
or period prior to and extend after the enactment of this ordinance.

Section III. Ownership, Operation and Management of Cockpits.

a. Only Filipino citizens, not otherwise prohibited by existing laws shall be allowed
to own, manage and operate cockpits. Cooperatives, partnerships or
corporations which are one hundred percent (100%) Filipino-owned may also
own, manage and operate cockpits. Stockholders, members, partners, and
owners of such entities must also be Filipino citizens.

b. In addition to full Filipino ownership above-stated, operation and management of


cockpit in Igbaras shall be awarded only to natural person who are residents of
Igbaras or has Igbarasnon parentage or roots or by affinity; or stockholders or
members of juridical persons enumerated above who are residents of Igbaras or
who have Igbarasnon parentage or roots or by affinity.

Section IV. Regulatory Acts.

a. Establishment of Cockpit. Only one (1) cockpit shall be allowed to operate in the
Municipality of Igbaras, Iloilo except that in the case the population is over one
hundred thousand (100,000), two (2) cockpits may be established, maintained
and operated.

b. Cockpit Site and Construction. Cockpit shall be constructed and operated within
the appropriate areas as prescribed or in the absence thereof, it would suffice
that the proposed site is not incompatible with the existing Zoning Ordinance.
Approval or issuance of building permits for the construction of a cockpit shall be
made by the Municipal Building Official in accordance with National Building
Code, Ordinances and Engineering laws and practices. No cockpit shall be
operated within the radius of one hundred (100) meters from schools and other
public buildings and churches existing at the time this Ordinance enacted.

c. Cockfighting Officials. Gaffers, referees, bet takers, promoters, cockpit manager,


cashier/montonan, matchmaker, gaff and blade inspector, and weigher shall not
act as such in any cockfight herein authorized, without first securing a license
renewable every year from the municipality. Only licensed cockpit officials and
employees shall officiate in all kinds of cockfighting authorized in this Ordinance.

d. The annual permit fee for cockpit personnel shall be paid before they participate
in a cockfight and shall be renewed not later than January 20 of the following
year. No operator or owner of a cockpit shall employ or allow to participate in a
cockfight any of the above-mentioned personnel unless he has registered and
paid the required fee.

e. All business entities operating within the premises of the cockpit must secure a
Business/Mayor’s Permit relative to its operations and pay corresponding

business taxes and permit fees subject to the provisions of the Municipal
Revenue Code.

Section V. Authority and License to Establish, Operate and Maintain a Cockpit (ALEOMC)

Authority and license to establish, operate and maintain a cockpit is a requisite and
necessary before owning maintaining and operating a cockpit. It shall be granted after a
competitive bidding, except as may herein provided.

The authority and license to establish, operate and maintain a cockpit shall be granted
by the Sangguniang Bayan and shall be for a period of twelve (12) years unless terminated by
the Sangguniang Bayan for violation of the provisions of this Ordinance, and/or other related
regulations or as may hereinafter provided.

The grant of authority and license to establish, operate and maintain a cockpit
(ALEOMC) is a requisite before the issuance of a Mayor’s Permit.

Section VI. The Cockpit Bids and Awards Committee (CBAC)

A Cockpit Bids and Awards Committee is hereby created tasked to conduct the bidding
for Authority and License to Establish, Operate and Maintain a Cockpit to be composed of the
following:
1. Municipal Mayor, or Representative, as Chairperson
2. Representative of the Sangguniang Bayan as Vice Chairperson
3. Municipal Treasurer as Member
4. Municipal Planning and Development Coordinator as Member; and
5. Municipal Engineer as Member

The foregoing members shall be appointed to the Committee through an executive order
issued by the Municipal Mayor.

The Sangguniang Bayan shall determine its representative to the Cockpit Bids and
Awards Committee.

The CBAC shall then submit to the Sangguniang Bayan the list of qualified bidders and
its recommendations.

The CBAC is given thirty (30) days from its organization to formulate its own
Implementing Rules and Procedure.

The stages of the bidding shall be open to the public. The Sanggunian Bayan shall be
duly notified, and all members thereof shall be considered as accredited observers.

A.
Section VII. Single-stage Competitive Bidding

The grant of Authority and License to Operate a Cockpit (ALEOMC) shall be made
through a single-stage competitive bidding to ensure more beneficial terms to the Municipal
Government. It involves the following processes:

1. Advertisement. The CBAC shall advertise and post the Invitation to Apply for
Eligibility and to Bid (IAEB). The IAEB shall be advertised in a local newspaper
and posted in conspicuous places within this municipality for seven (7) days. It
should contain, among others, the eligibility requirements, the period of accepting
the Letter of Intent, pre-qualification.

2. Minimum Bid Price. The minimum bid price of ALEOMC for twelve (12) years is
seventy thousand pesos (P 70,000,00) for every year of operation. This is over
and above other fees and charges that are hereinunder imposed relative to
cockpit use, operation and maintenance except as may hereinafter provided for
the first grantee of ALEOMC under this Ordinance which is thirteen (13) years.

3. Pre-bid conference. The pre-bid conference is the initial forum where the
representative of the Municipal Government, which is the Cockpit Bids and
Awards Committee, and the prospective bidders discuss the different aspects of
the procedure such as the eligibility requirements and the technical and financial
components of the contract. A pre-bid conference is held before eligibility check
and must be conducted not later than ten (10) calendar days after deadline for
the period of accepting the Letter of Intent.

4. Receipt of Letter of Intent and Eligibility Documents. The CBAC shall receive the
Letter of Intent (which should state the proposed period of operation which in no
case shall exceed twelve (12) years and eligibility documents from prospective
bidders. Applicants must submit the following documentary requirements:

a. New Applicant for ALEOMC

1) Registration of Business from either the Securities and


Exchange Commission (for Partnership and Corporation),
Cooperative Development Authority (for Cooperatives) or
Department of Trade and Industry for (for Single Proprietors)
2) Proof of Ownership of the Land or Lease Contract if being
leased
3) Proof of Financial Capacity, Company Profile, Development
Program
4) Clearances (Barangay and Mayor’s Clearance)
5) Land Reclassification if required (for Agricultural Land)
6) Zoning Clearance and Building Permit
7) Cockpit Building Plan and Design
a) Must be at least one thousand (1,000)-seater minimum
capacity
b) Must have a parking area of at least two thousand
square meters (2,000 sqm)
c) Must have a convenient gaffer’s section
d) Must have cock houses that can accommodate at least
five hundred (500) fighting cocks;
e) Must have separate and adequate comfort rooms for
male and female

b. For Renewal of ALEOMC

a) Clearances from the Treasurer’s Office on Payment of Dues


(Local Business, Tax, Real Property Tax, etc.)
b) Proof of Ownership or Lease Contract
c) Audited Financial Statement
d) Certification for the Municipal Engineer as to the Worthiness
of the Structure
e) Sanitary, Health and Fire Clearances

5. Eligibility Check. Eligibility Check is a procedure to determine if an applicant is


eligible to participate in the bidding. In determining a prospective bidder’s
eligibility, the CBAC shall use non-discretionary “pass/fail” criteria, as stated in

the IAEB. Essentially, this means that the absence, incompleteness, or


insufficiency of a document shall make a prospective bidder ineligible to
participate in the bidding.
6. Submission, Receipt, Opening and Examination of Bids. The Bid must be
received from the bidder in a sealed or any such appropriate container, to the
CBAC on or before the deadline as stated in the ITB, any bid submitted after the
deadline for submission and receipt of bids prescribe by the LGU shall be
declared “Late” and shall not be accepted by the CBAC.

7. CBAC Recommendation Submission to the Sangguniang Bayan. The CBAC


shall submit the result of the bidding and its recommendation within fifteen (15)
days from the opening of bids.

8. Issuance of License. The Sangguniang Bayan shall, after receipt of the result of
the bidding and the recommendation from the CBAC, proceed to enact ordinance
granting the authority and license to establish, operate and maintain operate a
cockpit (ALEOMC) subject to the period in the winning bid and such applicable
other terms and conditions.

9. Time and Manner of Payment by Winning Bidder of the Bid Price. The winning
bidder shall pay fifty percent (50%) of the bid price within thirty (30) days from
receipt of the ordinance granting the authority and license to establish, operate
and maintain operate a cockpit (ALEOMC), and the remaining fifty percent (50%)
shall be paid within the period of one year, either in cash or check payable to the
Municipal Government of Igbaras. Failure to pay foregoing amounts within the
period provided shall be a cause for the suspension or revocation of the license,
at the discretion of the Sangguiang Bayan.

10. The provisions of Republic Act 9184 otherwise known as Government


Procurement Reform Act if applicable are suppletory to this Ordinance.

SECTION VIII. Transfer of Rights on Authority and License to Establish,


Operate and Manage a Cockpit (ALEOMC)

a. Rights to ALEOMC is transferable provided the same is done to qualified person


or entities as prescribed in Section III.
b. In the event of transfer, the transferee is subrogated to the rights and privileges
and obligation of the ALEOMC grantee and only for the remaining period of the
ALEOMC.
c. The transfer shall be submitted to the Sangguniang Bayan for
confirmation/approval within two (2) months from perfection of agreement or
transfer by concerned parties.

SECTION IX. Fees and Charges.

The following fees and charges are hereby imposed:

a. An annual Business tax equivalent to Fifty Percent (50%) of One (1%) percent of
the gross income from the receipts generated from the preceding calendar year
that shall be due on or before January 30 of the year.
b. A Mayor’s permit (Business License) fee in the amount of PHP 5,000.00/annum
that shall be paid on or before January 30 of the year.
c. A permit fee to hold cockfight during barangay fiesta…… PHP 500.00/day for
hack fights.

e. No person shall be allowed to practice his profession or function as cockpit
official without paying the fees provided hereunder, which shall be renewed
within the first twenty (20) days of the year:

f. The fees collected herein are without prejudice to other taxes which may be
imposed under the Local Tax Code and other existing tax ordinance and law.

g. A surcharge equivalent to 25% of the amount collectible as fees shall be charged


for failure to remit the same to the Office of the Municipal Treasurer or its duly
authorized representative within the period required.

Section X. Conduct of Cockfights.

Except as may herein after provided, Cockfights shall be allowed only in a licensed
cockpit during Sundays and legal holidays and during local fiestas for not more than three (3)
days, subject to the succeeding provisions of this section. It may also be held during municipal
agricultural, commercial or industrial fair, carnival or exposition for a similar period of three days
as provided by existing laws, provided, that no cockfighting on the occasion of such fair, carnival
or exposition shall be allowed within the month of a local fiesta or for more than two occasions.

Regular cockfights – Regular cockfights may be held only on Sundays and other legal
holidays.

Special Cockfights – pintakasi, derbies and other cockfights may be held provided that
prior approval from the Office of the Mayor is first secured. Application for the holding of these
cockfights shall be filed at least fifteen (15) days before the activity with payment of
corresponding fees.

There shall be a beneficiary who may be an educational or charitable institution, civil


society organization or non-stock, non-profit organization, for each special cockfight, the amount
to be given to such beneficiary shall not be less than five percent (5%) of the gross receipts.

No cockfighting shall be held on December 30 (Rizal Day), June 12 (Philippine


Independence Day), November 30 (National Heroes Day), Holy Thursday, Good Friday,
Election or Referendum Day and on such days prohibited by laws, decrees and promulgations.

Cockfighting in the Barangays - Notwithstanding the foregoing, cockfights shall be


allowed in the Barangay on the occasion of barangay fiestas. For this purpose, a makeshift
cockfighting arena shall be established/put up where it shall be held. A permit from the Mayor’s
Office shall be secured first after paying at the Treasurer’s Office
When a permit is granted to the Barangay to hold cockfighting outside of the regular
cockpit pursuant to this section, that makeshift cockpit shall be considered as a license cockpit
for that day but until four o’clock in the afternoon only. In case of simultaneous fiesta
celebrations, one of the barangays, to be determined by the Mayor, may schedule the
cockfighting on the day before the fiesta.

Only licensed cockpit or cockfighting officials are allowed to officiate cockfights in the
barangays during fiestas under this section.

Excluded from this privilege are urban Barangays in Igbaras, specifically, Barangays 1,
2, 3, 4 and 5, and the Barangay where the licensed cockpit may be situated.

SECTION XI. PROHIBITIONS.

The following are hereby prohibited:

1. Illegal gambling within the entire cockpit premises.


2. Carrying of firearms or deadly weapons, except for security personnel
within the entire cockpit premises.
3. Entry or presence of minors in the premises of the cockpit arena.

SECTION XII. PENAL PROVISIONS.

A. Violations shall be penalized in accordance with appropriate laws and


ordinances.

B. Additionally, If the violation is committed by the licensee or arises out of the


negligence or tolerance of the licensee or persons acting in his behalf, the
Municipal Government may suspend or revoke the license.

The penalties are without prejudice to actions that may be taken by the
cockpit management, such as ban from cockpit premises.

SECTION XIII. MISCELLANEOUS AND TRANSITORY PROVISIONS.

A. Preference for the issuance of ALEOMC shall be given to the existing cockpit
owner/operator. Immediately upon effectivity of this ordinance, existing cockpit
operator shall be notified of such preference, and will be given three (3) months
from such notice to submit all the requirements as new applicants in order to

qualify. If the existing cockpit operator qualifies, he will be granted ALEOMC for
the period of thirteen (13) years which includes construction or relocation of
cockpit if needed for a price of Seventy Thousand (P70,000.00) Pesos per year.

This preferential privilege to the existing cockpit operator is nontransferable. Only


the right to ALEOMC granted by the Sangguniang Bayan is transferable as
provided for in Section VIII of this Ordinance

B. If the existing cockpit owner/operator fails to qualify or does not avail of reference
as stated in Section A hereof, Invitation to Bid (ITB) notice by posting and
publication shall be given to all interested parties to apply or bid for ALEOMC
within a period of three (3) months from such notice. All applicants shall be
considered new applicants for ALEOMC hence shall comply with the
requirements herein provided new applicants.

C. The following are requirements that all applicants must submit:

 Citizenship (Sec. III a)


 Igbarasnon resident, parentage, by consanguinity or affinity (Sec. III
b)
 Documentary requirements (Sec. VII par. 4 a)

D. Failure to operate within one year by the existing cockpit operator who availed of
the privilege under Section VIII or the first grantee of ALEOMC through a bidding
under this Ordinance shall be a ground for revocation of the ALEOMC by the
Sangguniang Bayan.

E. The grantee of authority and license to establish, operate and maintain a cockpit
(ALEOMC) shall be entitled to participate in subsequent biddings after the
expiration of its own authority and license to establish, operate and maintain a
cockpit (ALEOMC).

F. Notwithstanding the completion of authority and license to establish, operate and


maintain a cockpit (ALEOMC). to the grantee thereof, bidding of subsequent
authority and license to establish, operate and maintain a cockpit (ALEOMC)
shall be done not later than one (1) year before the expiration of the authority and
license to establish, operate and maintain a cockpit (ALEOMC) of an earlier
grantee, but the authority and license to establish, operate and maintain a cockpit
(ALEOMC). shall not begin until the expiration of term of authority and license to
establish, operate and maintain a cockpit (ALEOMC) of such preceding grantee.

G. The bid price of the authority and license to establish, operate and maintain a
cockpit may be increased by the Sangguniang Bayan in subsequent authority
and license to establish, operate and maintain a cockpit (ALEOMC). through a
Resolution.

H. The Sangguniang Bayan may grant provisional authority and license to establish,
operate and maintain a cockpit (ALEOMC) for a period not exceeding one year at
a time, including but not limited to an immediate grantee of an authority and
license to establish, operate and maintain a cockpit (ALEOMC), even without
bidding, among others, to avoid a hiatus of cockpit operation in this jurisdiction.

I. The vehicles of cockpit goers and visitors are not allowed to be parked on public
roads and sidewalks in the vicinity of the cockpit during cockfights. Parking area
should be provided by cockpit operators. Cockpit operators should provide
additional parking areas in case the vehicles of the cockpit goers cannot be

accommodated in the original /initial parking areas required under Section VII
paragraph 4, A 7(b)

Section XIV. Applicability Clause.

The provisions of Presidential Decree No. 449, otherwise known as the Cockfighting
Law of 1974, and such other laws shall apply to all matters regarding the operation of cockpits
in this Municipality.

Section XV. Separability Clause.

If for any reason, any provision, section or part of this ordinance shall be held to be
unconstitutional or invalid, other parts or provision thereof which are not affected shall continue
be in full force and effect.

Section XVI. Repealing Clause.

Ordinances, rules and regulations, or part thereof, whose provisions are in conflict with,
or contrary, to the provision of this ordinance are hereby repealed, amended or modified
accordingly.

Section XVII. Effectivity Clause.

This ordinance shall take effect after a period of fifteen (15) days following its
publication, or from the last day of posting for three (3) consecutive weeks in at least three (3)
conspicuous places within the Municipality, whichever occurs later.
