WHEREAS, per PD 449 or Cockfighting Law of 1974, Cockfighting has been and is still
a popular, traditional and customary form of recreation and entertainment among Filipinos
during legal holidays, local fiestas, agricultural, commercial and industrial fairs, carnivals or
expositions;
WHEREAS, the same law further states that by the reason of the afore stated meaning
and connotation of cockfighting in relation to Filipino customs and traditions, it should neither be
exploited as an object of commercialism or business enterprise, nor made a tool of uncontrolled
gambling, but more as a vehicle for the preservation and perpetuation of native Filipino heritage
and thereby enhance our national identity;
WHEREAS PD 449 also allows cockfighting in parks and playgrounds for the benefits of
tourists, visiting guests and dignitaries (PD 449, section 5(e)). Barangay fiestas are among the
occasions wherein there are influx of guests, tourists, and balikbayans that may be provided
with entertainment by cockfighting;
WHEREAS, under the same Code, likewise devolved to the Municipality the power to
regulate cockfighting and the operation of cockpit.
Section I. Title.
This Ordinance shall be known as “An Ordinance Regulating Cockfighting, Prescribing
Guidelines for the Grant of Authority and License, to Establish, Operate, and Maintain a Cockpit
and Other Regulations Relative Thereto in the Municipality of Igbaras, Iloilo or ”Cockfighting
Ordinance of Igbaras” for brevity.
The following terms when used in this Ordinance shall be construed as follows:

and the result of the cockfight by announcing the winner or declaring a tie or no
contest game.
o. Special Cockfights- also known as “pintakasi” or derby for charitable and non-
profit purposes.
p. Weigher- person in charge in collecting weights of the participating gamecocks
from farms of the owners and to submit to the matchmaker.
q. Existing Cockpit Operator/Owner - one who operated and owned a cockpit in the
Municipality of Igbaras without a definite term or period that ceased to operate
only in 2019 with the occurrence of the COVID-19 pandemic.
r. Existing Right to a Cockpit - right granted to operate a cockpit for a certain term
or period prior to and extend after the enactment of this ordinance.
a. Only Filipino citizens, not otherwise prohibited by existing laws shall be allowed
to own, manage and operate cockpits. Cooperatives, partnerships or
corporations which are one hundred percent (100%) Filipino-owned may also
own, manage and operate cockpits. Stockholders, members, partners, and
owners of such entities must also be Filipino citizens.
a. Establishment of Cockpit. Only one (1) cockpit shall be allowed to operate in the
Municipality of Igbaras, Iloilo except that in the case the population is over one
hundred thousand (100,000), two (2) cockpits may be established, maintained
and operated.
b. Cockpit Site and Construction. Cockpit shall be constructed and operated within
the appropriate areas as prescribed or in the absence thereof, it would suffice
that the proposed site is not incompatible with the existing Zoning Ordinance.
Approval or issuance of building permits for the construction of a cockpit shall be
made by the Municipal Building Official in accordance with National Building
Code, Ordinances and Engineering laws and practices. No cockpit shall be
operated within the radius of one hundred (100) meters from schools and other
public buildings and churches existing at the time this Ordinance enacted.
d. The annual permit fee for cockpit personnel shall be paid before they participate
in a cockfight and shall be renewed not later than January 20 of the following
year. No operator or owner of a cockpit shall employ or allow to participate in a
cockfight any of the above-mentioned personnel unless he has registered and
paid the required fee.
e. All business entities operating within the premises of the cockpit must secure a
Business/Mayor’s Permit relative to its operations and pay corresponding
business taxes and permit fees subject to the provisions of the Municipal
Revenue Code.
Section V. Authority and License to Establish, Operate and Maintain a Cockpit (ALEOMC)
Authority and license to establish, operate and maintain a cockpit is a requisite and
necessary before owning maintaining and operating a cockpit. It shall be granted after a
competitive bidding, except as may herein provided.
The authority and license to establish, operate and maintain a cockpit shall be granted
by the Sangguniang Bayan and shall be for a period of twelve (12) years unless terminated by
the Sangguniang Bayan for violation of the provisions of this Ordinance, and/or other related
regulations or as may hereinafter provided.
The grant of authority and license to establish, operate and maintain a cockpit
(ALEOMC) is a requisite before the issuance of a Mayor’s Permit.
A Cockpit Bids and Awards Committee is hereby created tasked to conduct the bidding
for Authority and License to Establish, Operate and Maintain a Cockpit to be composed of the
following:
1. Municipal Mayor, or Representative, as Chairperson
2. Representative of the Sangguniang Bayan as Vice Chairperson
3. Municipal Treasurer as Member
4. Municipal Planning and Development Coordinator as Member; and
5. Municipal Engineer as Member
The foregoing members shall be appointed to the Committee through an executive order
issued by the Municipal Mayor.
The Sangguniang Bayan shall determine its representative to the Cockpit Bids and
Awards Committee.
The CBAC shall then submit to the Sangguniang Bayan the list of qualified bidders and
its recommendations.
The CBAC is given thirty (30) days from its organization to formulate its own
Implementing Rules and Procedure.
The stages of the bidding shall be open to the public. The Sanggunian Bayan shall be
duly notified, and all members thereof shall be considered as accredited observers.

Section VII. Single-stage Competitive Bidding
The grant of Authority and License to Operate a Cockpit (ALEOMC) shall be made
through a single-stage competitive bidding to ensure more beneficial terms to the Municipal
Government. It involves the following processes:
1. Advertisement. The CBAC shall advertise and post the Invitation to Apply for
Eligibility and to Bid (IAEB). The IAEB shall be advertised in a local newspaper
and posted in conspicuous places within this municipality for seven (7) days. It
should contain, among others, the eligibility requirements, the period of accepting
the Letter of Intent, pre-qualification.
2. Minimum Bid Price. The minimum bid price of ALEOMC for twelve (12) years is
seventy thousand pesos (P 70,000,00) for every year of operation. This is over
and above other fees and charges that are hereinunder imposed relative to
cockpit use, operation and maintenance except as may hereinafter provided for
the first grantee of ALEOMC under this Ordinance which is thirteen (13) years.
3. Pre-bid conference. The pre-bid conference is the initial forum where the
representative of the Municipal Government, which is the Cockpit Bids and
Awards Committee, and the prospective bidders discuss the different aspects of
the procedure such as the eligibility requirements and the technical and financial
components of the contract. A pre-bid conference is held before eligibility check
and must be conducted not later than ten (10) calendar days after deadline for
the period of accepting the Letter of Intent.
4. Receipt of Letter of Intent and Eligibility Documents. The CBAC shall receive the
Letter of Intent (which should state the proposed period of operation which in no
case shall exceed twelve (12) years and eligibility documents from prospective
bidders. Applicants must submit the following documentary requirements:
8. Issuance of License. The Sangguniang Bayan shall, after receipt of the result of
the bidding and the recommendation from the CBAC, proceed to enact ordinance
granting the authority and license to establish, operate and maintain operate a
cockpit (ALEOMC) subject to the period in the winning bid and such applicable
other terms and conditions.
9. Time and Manner of Payment by Winning Bidder of the Bid Price. The winning
bidder shall pay fifty percent (50%) of the bid price within thirty (30) days from
receipt of the ordinance granting the authority and license to establish, operate
and maintain operate a cockpit (ALEOMC), and the remaining fifty percent (50%)
shall be paid within the period of one year, either in cash or check payable to the
Municipal Government of Igbaras. Failure to pay foregoing amounts within the
period provided shall be a cause for the suspension or revocation of the license,
at the discretion of the Sangguiang Bayan.
a. An annual Business tax equivalent to Fifty Percent (50%) of One (1%) percent of
the gross income from the receipts generated from the preceding calendar year
that shall be due on or before January 30 of the year.
b. A Mayor’s permit (Business License) fee in the amount of PHP 5,000.00/annum
that shall be paid on or before January 30 of the year.
c. A permit fee to hold cockfight during barangay fiesta…… PHP 500.00/day for
hack fights.
d. Soltada Fee- there shall be a deduction from the bet of the winner of every fight,
as follows:

e. No person shall be allowed to practice his profession or function as cockpit
official without paying the fees provided hereunder, which shall be renewed
within the first twenty (20) days of the year:
f. The fees collected herein are without prejudice to other taxes which may be
imposed under the Local Tax Code and other existing tax ordinance and law.
Except as may herein after provided, Cockfights shall be allowed only in a licensed
cockpit during Sundays and legal holidays and during local fiestas for not more than three (3)
days, subject to the succeeding provisions of this section. It may also be held during municipal
agricultural, commercial or industrial fair, carnival or exposition for a similar period of three days
as provided by existing laws, provided, that no cockfighting on the occasion of such fair, carnival
or exposition shall be allowed within the month of a local fiesta or for more than two occasions.
Regular cockfights – Regular cockfights may be held only on Sundays and other legal
holidays.
Special Cockfights – pintakasi, derbies and other cockfights may be held provided that
prior approval from the Office of the Mayor is first secured. Application for the holding of these
cockfights shall be filed at least fifteen (15) days before the activity with payment of
corresponding fees.
Only licensed cockpit or cockfighting officials are allowed to officiate cockfights in the
barangays during fiestas under this section.
Excluded from this privilege are urban Barangays in Igbaras, specifically, Barangays 1,
2, 3, 4 and 5, and the Barangay where the licensed cockpit may be situated.
The penalties are without prejudice to actions that may be taken by the
cockpit management, such as ban from cockpit premises.
A. Preference for the issuance of ALEOMC shall be given to the existing cockpit
owner/operator. Immediately upon effectivity of this ordinance, existing cockpit
operator shall be notified of such preference, and will be given three (3) months
from such notice to submit all the requirements as new applicants in order to
qualify. If the existing cockpit operator qualifies, he will be granted ALEOMC for
the period of thirteen (13) years which includes construction or relocation of
cockpit if needed for a price of Seventy Thousand (P70,000.00) Pesos per year.
B. If the existing cockpit owner/operator fails to qualify or does not avail of reference
as stated in Section A hereof, Invitation to Bid (ITB) notice by posting and
publication shall be given to all interested parties to apply or bid for ALEOMC
within a period of three (3) months from such notice. All applicants shall be
considered new applicants for ALEOMC hence shall comply with the
requirements herein provided new applicants.
D. Failure to operate within one year by the existing cockpit operator who availed of
the privilege under Section VIII or the first grantee of ALEOMC through a bidding
under this Ordinance shall be a ground for revocation of the ALEOMC by the
Sangguniang Bayan.
E. The grantee of authority and license to establish, operate and maintain a cockpit
(ALEOMC) shall be entitled to participate in subsequent biddings after the
expiration of its own authority and license to establish, operate and maintain a
cockpit (ALEOMC).
G. The bid price of the authority and license to establish, operate and maintain a
cockpit may be increased by the Sangguniang Bayan in subsequent authority
and license to establish, operate and maintain a cockpit (ALEOMC). through a
Resolution.
H. The Sangguniang Bayan may grant provisional authority and license to establish,
operate and maintain a cockpit (ALEOMC) for a period not exceeding one year at
a time, including but not limited to an immediate grantee of an authority and
license to establish, operate and maintain a cockpit (ALEOMC), even without
bidding, among others, to avoid a hiatus of cockpit operation in this jurisdiction.
I. The vehicles of cockpit goers and visitors are not allowed to be parked on public
roads and sidewalks in the vicinity of the cockpit during cockfights. Parking area
should be provided by cockpit operators. Cockpit operators should provide
additional parking areas in case the vehicles of the cockpit goers cannot be
accommodated in the original /initial parking areas required under Section VII
paragraph 4, A 7(b)
The provisions of Presidential Decree No. 449, otherwise known as the Cockfighting
Law of 1974, and such other laws shall apply to all matters regarding the operation of cockpits
in this Municipality.
If for any reason, any provision, section or part of this ordinance shall be held to be
unconstitutional or invalid, other parts or provision thereof which are not affected shall continue
be in full force and effect.
Ordinances, rules and regulations, or part thereof, whose provisions are in conflict with,
or contrary, to the provision of this ordinance are hereby repealed, amended or modified
accordingly.
This ordinance shall take effect after a period of fifteen (15) days following its
publication, or from the last day of posting for three (3) consecutive weeks in at least three (3)
conspicuous places within the Municipality, whichever occurs later.
