AN ORDINANCE ESTABLISHING A LGBTQIA+ DESK IN ALL BARANGAYS OF

QUEZON CITY TO BE DESIGNATED AS “BARANGAY LGBTQIA+’s DESK” AND
APPROPRIATING FUNDS THERETO

WHEREAS, Section 1, Article XIII of the 1987 Philippine Constitution, provides

that the enactment of measures that protect and enhance the right of the people
to human dignity, reduce social, economic, and political inequalities, and remove
cultural inequities shall be given highest priority;

WHEREAS, Section 11, Article II of the 1987 Philippine Constitution provides

that, “the State values the dignity of every human person and guarantees full
respect for human rights”;

WHEREAS, Republic Act 7160 (otherwise known as the Local Government Code
of 1991, Sec. 16,) Provides for a Local Government Unit to look into and promote
the general welfare of its constituency;

WHEREAS, City Ordinance SP–2357; S-2014, was legislated for the welfare of
the LGBT Community, also known as the SOGIE Ordinance;

WHEREAS, in furtherance to the above City Ordinance, SP-3081; S-2021, was

passed creating the Pride Councils in each Barangay;

WHEREAS, Lesbian, Gay, Bisexual, Transgender, Queer, Intersex, Asexual, and

+ (LGBTQIA+) plays an important role for the national development;
WHEREAS, there is a steady and alarming rise in violence against members of
the Lesbian, Gay, Bisexual, Transgender, Queer, Intersex, Asexual, and +
(LGBTQIA+) community in the Philippines over the past Twenty (20) years
according to the new conducted by LGBTQIA+ advocacy group;

WHEREAS, the LGBTQIA+ community continues to be oppressed, primarily

because of misconception and impartial judgment of their community;

WHEREAS, this ordinance seeks to eliminate offensive practices of

discrimination against the sex or sexual orientation, gender identity and
expression.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF QUEZON

CITY IN REGULAR SESSION ASSEMBLED;

SECTION 1. SHORT TITLE. This ordinance shall be known as the “Quezon

City Barangay LGBTQIA+’s Desk Ordinance”.

SECTION 2. ESTABLISHMENT AND COMPOSITION OF QUEZON CITY

BARANGAY LGBTQIA+’ DESK. The City Government hereby establishes a
LGBTQIA+ Desk in all Barangayss in Quezon City, which shall be designated as
“Barangay LGBTQIA+ Desk”. There shall be assigned one (1) “LGBTQIA+ Desk
Officer” to facilitate, organize, and coordinate the services and functions of the
Desk, who shall be LGBTQIA+ resident of the said Barangay.

SECTION 3. BARANGAY LGBTQIA+ DESK AND ITS DUTIES,

FUNCTIONS, AND RESPONSIBILITIES. The purpose of the Quezon City
Barangay LGBTQIA+’ Desk is for easier and speedy delivery, facilitation, and
channeling of services and programs which the City Government is bound to
render to the LGBTQIA+ member. It shall primarily serve as the barangay-based
arm of the Quezon City Pride Council (QCPC), and shall have the following
duties and functions:
 a. Monitor and coordinate the implementation of programs of the national and
local government for LGBTQIA+ members undertaken within the barangay
in pursuance of the objectives of the existing national and local laws;
b. Serve as the barangay’s general information and focal person for the
needs of the LGBTQIA+ members residing within the barangay;
c. Record, maintain, and update the record and other relevant data on
LGBTQIA+ members residing in the barangay;
d. Assist in the organization of LGBTQIA+ groups and association and enlist
and/or maintain a registry of all existing LGBTQIA+ associations or
organizations in the Barangay;
e. Receive reports of violation of existing national and local laws pertaining to
promotion of LGBTQIA+ members right and provision of the benefit s and
refer the same to QCPC and/or concerned agencies for the assistance and
appropriate action; and
f. Perform such other functions as may be necessary for the promotion and
protection of the welfare of LGBTQIA+.

SECTION 4. LOCATION AND MANAGEMENT OF THE LGBTQIA+’S DESK.

The Barangay LGBTQIA+’s Desk shall be allowed and given space within the
premises of the Barangay Hall in all Barangays in Quezon City. The concerned
barangay shall be in charge of its management, operation, and administration.

SECTION 5. FUNDING FOR THE LGBTQIA+’S DESK. The funds necessary

for the establishment and continuous implementation of the Barangay
LGBTQIA+’s Desk shall be charged from the 5% of the barangay’s total annual
budget allocated for GAD or any available funds of the barangay and/or may be
subsidized in part by the City Government from the 5% of the General Fund
allocated for GAD or any available funds of the City.

SECTION 6. IMPLEMENTATION. Upon effectivity of this Ordinance, its

provisions shall be implemented by all barangays in Quezon City in full
coordination with the Barangay Community Relations Department (BCRD),
Quezon City Pride Council (BCPC), and LGBTQIA+ Task Force.
 SECTION 7. SEPARABILITY CLAUSE. Should any provision of this
Ordinance be declared unconstitutional or illegal by any court of competent
jurisdiction, those parts that are not so declared shall remain in full force and
effect.

SECTION 8. REPEALING CLAUSE. Any previous Ordinance/s or parts

thereof, which are inconsistent whit this Ordinance are hereby repealed or
superseded accordingly.

SECTION 9. EFFECTIVITY CLAUSE. This Ordinance shall take upon its

approval.
