“AN ORDER ORGANIZING THE BARANGAY DEVOLUNTION TRANSITION


COMMITTEE
(DCT)"

WHEREAS, Section 6, Article X of the Constitution provides that local government unit
(LGU) shall have a just share, as determined by law, in the national taxes which shall
automatically released to them;

WHEREAS, Section 2 (a) of the Local Government Code (LGC) of 1991 (Republic Act 7160)
provides that the State shall provide for a more responsive and accountable local structure
instituted through a system of decentralization whereby local governments units (LGU) be given
more powers, authority, responsibilities, and resources. The process of decentralization proceed
from the national government (NG) to the local government units LGUs;

WHEREAS, Section 3 (d) of the LGU further provides that the “vesting of duty, responsibility
and accountability in local government unit shall be accompanied with provision for reasonably
adequate resources to discharge and effectively carry out their functions; hence shall have power
to create and broaden their own sources of revenue and the right to a just share in national taxes
and a equitable share in the proceeds of the utilization and development of the national wealth
within their respective areas;

WHEREAS, The Supreme Court (SC) decision in the consolidated cases of Congressman
Hermilando I. Mandanas, et al. vs. Executive Secretary Paquito N. Ochoa, Jr. el al. clarifies the
basis for the computation of local government shares and ordered the NG to include all
collection of national taxes in the computation of the base amount for the just share of the LGU;

WHEREAS, Executive Order No. 138, s. 2021 order the full devolution of functions, service
and facilities by the national government (NG) to local government unit (LGU) no later than the
FY 2024. These shall include those devolved responsibilities indicated in Section 17 of RA 7160
and other existing laws which subsequently devolved functions of the NG to LGUs. These fully
devolved responsibilities shall be funded from the shares of the LGUs in the proceeds of the
national taxes and other local revenues;

WHEREAS, Section 10 of the Executive Order No. 138, s. 2021 orders all local government
unit to
prepare their Devolution Transition Plan (DTPs) in close coordination that are critical to them;

WHEREAS, the DBM-DILG Joint Memorandum Circular (JMC) No. 2021-2021 requires all
LGUs to prepare their DTPs to ensure a dated strategic perspective and systematic and coherent
actions towards their full assumption of devolved functions and service starting FY 2022;

WHEREAS, Section 4.1 of the DBM-DILG JMC No. 2021-1 dated August 11, 2021 mandates
that the Local Chief Executive (LCE) concerned shall (i) spearhead the preparation of the LGU
DTPs and ensure that this is approved within the timeframe indicated in the JMC and (ii)
organized the LGU Delovution Transition Committee (LGU DTC) which shall be responsible for
the preparation of the LGU DTP and in monitoring the implementation thereof.

NOW THEREFOR, I, CINDERELA DUMAGAN-HIYAS, by virtue of the power vested in


me by law as Punong Barangay of Talandang do hereby order the following;

SECTION 1. COMPOSITION. The LGU Devolution Transition Committee (DTC) shall be


composed of the following:

SECTION 2. FUNCTIONS. The Barangay Devolution Transition Committee shall have the
following fuctions:

a. The Barangay DTC shall facilitate a process where barangay officials and other
stakeholders in consultation with city/municipality offices concerned prepares
Attachment 1-B (Annex E-3) and submits it to the Punong Barangay for Review and
Approval

b. the Barangay DTC through the Barangay Secretary shall consolidate the outputs on

Attachment 1-B (Annex E-2) and submit it to the Punong Barangay for Review and
Approval.

c. the Punong Barangay shall approve the Attachment 1-B (Annex E-2) and submit it to
the Sangguniang Barangay for approval together with Attachment 2-B. phasing of full
assumption of Devolution Functions, Service and Facilities for Barangays (Annex F-2) and
Attachment 3-B. Capacity Development Requirements for Barangay (Annex G-2), the Three (3)
attachments, taken together , constituents the barangay DTP.

SECTION 3. EFFECTIVITY. This Executive Order shall take effect immediately.

AN ORDER ESTABLISHING VIOLENCE AGAINST WOMEN AND THEIR CHILDREN (VAW-C) DESK
AND DESK OFFICER IN BARANGAY TALANDANG, TUGBOK DISTRICT, DAVAO CITY.

WHEREAS, Republic Act No. 9710 otherwise known as the Magna Carta of Women provides for a comprehensive
women’s human rights law that seeks to eliminate the discrimination against women by recognizing, protecting,
fulfilling and promoting the rights of Filipino Women, especially those in marginalized sector,

WHEREAS, Section 9 of RA 9710 mandates that all local government units shall established a Violence Against
Women’s Desk in every Barangay to ensure that violence against women and children cases are fully addressed in a
gender-responsive matter.

WHEREAS, A joint memorandum Circular No. 2010-2 of DILG, DSWD, DepEd, DOH and Philippine
Commission on Women Provides the guidelines and procedures pursuant to provisions of Implementing Rules and
Regulations of RS 9710 that there is a need to established Violence Against Women and their Children (VAW-C)
Desk in every Barangay which will be open 24 hours to attend and act upon all VAW-C cases referred to or brought
before the Barangay.

NOW THEREFORE, by the virtue of the power vested in me by the law, I GIL. L. LOPEZ Punong Barangay of
Barangay Talandang, Tugbok District, Davao City do hereby order that:

Section 1: Establishment of Violence Against Women and their Children (VAW-C) in


Barangay Talandang, Tugbok District, Davao City and designating Mrs.
Julleth B. Rillo as the VAW Desk Officer there at.

Section 2: Duties and Funtions. The VAW Desk shall have the following duties and
Functions:

1. Respond to Gender-Based Violence cases brought before the Barangay.


2. Record the member of Gender-Based Violence handled by the Barangay and submit a
quarterly report on all cases of VAW to the DILG and CSWDO;
3. Keep VAW case record confidential and ensure that only authorized necessary personnel can
access it;
4. Assist the victims of VAWC in securing Barangay Protection Order (BPO) and access
necessary services;
5. Develop the Brangay’s gender responsive plan in addressing gender-based violence,
including support services, capacity building and referral system;
6. Coordinate with the referred cases to the government agencies, non-government organizations
(NGO) institutions and other service providers as necessary;
7. Address other forms of abused committed against women, especially senior citizens, person
with disability and other marginalized groups;
8. Provide coordinated linkage with other agencies and institutions in the planning
9. Monitoring and evaluations of plans for Children;
10. Lead advocacies on the elimination of VAWC in the community amd;
11. Perform other related functions as may be assigned.

Section 3: Effectively. This order shall take effect immediately.

AN ORDER ORGANIZING THE BARANGAY TANOD IN BARANGAY TALANANG,


TUGBOK DISTRICT DAVAO CITY.

WHEREAS, Section 391 (16) of Republic Act 7160, otherwise knownas the Local Government
Code of 1991, provides for the organization ocommunity brigades, barangay tanods or
community service units as maybe necessary. The States recognizes the integral role of Barangay
Tanod in governance and maintenance of peace and security at the barangay level;

WHEREAS, the Department of the Interior and Local Government issued Memorandum
Circular No. 2003-42 on March 10, 2003, provides for the “Guidelines on Professionalizing the
Barangay Tanod” with the primordial concern of making these Barangay Tanods as agents for
peace and development consistent to the thrust of the present administration
towards building a strong republic.

WHEREAS, the Department of the Interior and Local Government issued Memorandum

Barangay Tanod” with the primordial concern of making these Barangay Tanods as agents for

NOW THEREFORE, I GIL L. LOPEZ, Punong Barangay of Barangay Talandang, by virtue of the
powers vested in me by the law, I do hereby order:

Section 1. The reconstitution of the Barangay Council for the Protection of Children (BCPC)

Section 2. The BCPC shall be composed of the following:

the barangay;
3. Organize the BADAC Auxiliary Team to compose an ideal number of 25 members per 2,000
population of the barangay representingstreets, puroks, subdivision or sitios
4. Orient the BADAC Auxiliary Team of their roles and functions and in formulating plan of
action to address the problem;
5. Equip Barangay Tanods and BADAC Auxiliary Team on their roles and functions on the
campaign against street-level illegal drug trade through seminars and trainings;
6. Coordinate and collaborate with other institutions implementing programs and projects on
drug users and pushers;

7. Continuously gather and update data on all drug related incidents and its effect on the peace
and order situation in the barangay bincluding listing of suspected drug users and pushers;
8. Submit a monthly report to the Municipal Anti-Drug Abuse Council copy furnished the DILG
Municipal Field Office;
9. Refer suspected drug users to the MADAC and other institution for corresponding counseling
and/or rehabilitation;
10. Conduct an Information, Education Campaign (IEC) on illegal drug demand reduction;
11. Monitor disposition and progress of drug related cases filed; and
12. Perform other related functions.

Effectively. This Executive Order shall take effect immediately.

AN ORDER EXTABLISHING AND ORGANIZING THE GENDER AND DEVELOPMENT


(GAD) FOCAL POINT SYSTEM OF BARANGAY TALANDANG, TUGBOK, DISTRICT,
DAVAO CITY AND DEFINING ITS DUTIES AND FUNCTIONS.

WHEREAS, Section 14, Article II of the Constitution provides that the State recognizes the role of
women in nation building, and shall ensure the fundamental equality before the law of women and men;

WHEREAS, pursuant to Section 36 of RA 9710, otherwise known as the Magna Carta of Women
(MCW)all government departments, including their attached agencies, offices, bureaus, state universities
and colleges, government institution shall adopt gender mainstreaming as a strategy to promote women’s
human rights and eliminate gender discrimination in their systems, structures, policies, programs,
processes and procedures;

WHEREAS, Section 37-C of the Implementing Rules and Regulations (IRR) of the MCW provides for
the creation or strengthening or GAD Focal Point System or a similar GAD mechanism in LGUs and
other instrumentalities of the government to catalyze and accelerate gender mainstreaming within the
agency or LGU; .

WHEREAS; PCW-DILG-DBM-NEDA JMC 2013-01 sets the Guidelines on the Localization of the
Magna Carta of Women; WHEREAS; There a need to Institutionalize and organize the GAD Focal Point
and define its functions and responsibilities.

NOW THEREFORE, I, HON. CINDERELA DUMAGAN -HIYAS, Punong Barangay of Barangay


Talandang, by virtue of the power vested upon me by law, do hereby order the following;

SECTION 1, ORGANIZATION OF GAD FOCAL POINT SYSTEM. The GAD Focal Point System
(GFPS) of the Barangay Talandang is hereby organized:

Barangay Talandang shall be established and shall be composed of the following.

SECTION 3. General Functions of the GAD Focal Points. – The GAD Focal Points System shall perform
the following:

General Functions:

1. Ensure and sustain the Barangay’s critical consciousness in supporting gender and development,
women’s empowerment and responding to gender issues;

2. Take the lead role in direction-setting, advocacy, planning, monitoring and evaluation, and technical
advisory in mainstreaming GAD perfectives in the Barangay Programs, projects, activities and processes;

Specific Functions:

1. Lead in mainstreaming GAD perspective in Barangay policies, plans and programs. In the process, they
shall ensure the assessment of the genderresponsiveness of systems, structures, policies, programs,
processes and procedures of the LGU based on the priority needs and concerns of each constituent and
employees, and the formulation of recommendations including their implementation:

2. Assist in the formulation of new policies such as the GAD code in advancing Women’s Empowerment
and gender equality;

3. Lead in setting up appropriate systems and mechanisms to ensure the generation, processing, review,
and updating of sex-disaggregated data or barangay GAD data base to serve as basis in performance-
based and gender-responsive planning and budgeting;

4. Coordinate efforts of different divisions/offices/units of the agency or LGU and advocate for the
integration of GAD perspectives in all their systems and processes:

5. Spearhead the preparation of the Annual and Performance-based GAD plan and budget (GPB) in
response to the gender issues and or concerns of their locality and in the context of their LGU mandate;
and consolidate the same following the form and procedures prescribed by the PCW, DBM and NEDA in
Joint Circular 2011-1. The GFPS shall likewise be responsible for submitting the consolidated GPBs of
the LGU;

6. Lead in monitoring the effective implementation of the GAD-related policies and the annual GAD
Plans, programs and Budget of the Barangay;

7. Lead the preparation and on-time submission of the annual Barangay GAD accomplishment report
(GAD AR) and other GAD reports, that may be required under the MCW and the JMC to the
City/Municipality Planning and Development Office to ensure the alignment of the Barangay GAD PPAs
with the priorities of the City/Municipality and thereafter to the DILG city/municipal LGOO for review
and approval.

8. Strengthen the linkages with other LGUs concerned agencies or organizations working on Women’s
Rights and gender and development to harmonize and synchronize GAD efforts at various levels of
governance;

9. Promote and actively pursue the participation of Women and gender advocates, other civil society
groups and private organizations in the various stages of development planning cycle ; giving special
attention to the marginalized sectors ; and

10. Ensure that all personnel of the Barangay (e.g. treasurer, secretary) are capacitated on GAD. Along
this line , the Barangay GFPS will recommend and plan an appropriate capacity development program on
gender and development for its employees as part of and implemented under its regular human resource
development program.

SECTION 4. Meeting The GFPS shall meet quarterly or as often as may be necessary.

SECTION 5. Repealing Clause- All related issuances in conflict herewith are superseded by this Order,
and/or modified accordingly.

SECTION 6. Effectively – This Executive Order shall take effect immediately and shall remain in force
and effect unless otherwise revoked by the undersigned.

AN ORDER CREATING THE BARANGAY INVENTORY TEAM (BIT) IN CONNECTION


WITH THE SYNCHRONIZED BARANGAY AND SANGGUNIANG KABATAAN ELECTIONS

WHEREAS, Republic Act No. 11935, also known as “An Act Postponing the
December 2022 Barangay and Sangguniang Kabataan Elections, Amending for the Purpose
Republic Act No. 9164, as Amended, Appropriating Funds Therefor, and for Other
Purposes”

WHEREAS, Section 1 of the said Act provides that the Synchronized Barangay and
Sangguniang Kabataan Elections shall be held on the last Monday of October 2023;

WHEREAS, the Department of the Interior and Local Government (DILG) issued
Memorandum Circular No. 2023- 047 dated March 21, 2023, on the Conduct of Inventory
and Turnover of all Barangay and Sangguniang Kabataan (SK) Properties, Financial
Records, Documents (PFRDs) and Money Accountabilities by all Incumbent Barangay and
SK Officials;

WHEREAS, the said Circular mandates all Punong Barangays to convene and create
their respective Barangay Inventory Team (BIT), through an Executive Order and submit a
copy of the same to the concerned City/Municipal Mayor and the City Director/C/MLGOO;

WHEREAS, the BIT shall be created primarily for purposes of conducting the initial
and inventory, and turnover of BPFRDs and money accountabilities; and ensuring an
orderly and smooth transition of barangay governance to the newly elected or re-elected
incoming barangay officials;

NOW, THEREFORE, I, CINDERELA DUMAGAN-HIYAS , Punong Barangay of


Barangay Talandang, City of Davao, by virtue of the powers vested in me by law, do hereby
order the creation of the Barangay Inventory Team, with the following provisions:

SECTION II. ROLES AND RESPONSIBILITIES OF THE BIT:

The Team shall undertake the following:

1. Conduct an Inventory of Properties and Money Accountabilities:

1.1 Conduct an initial inventory of all Barangay Properties, Financial


Records and Documents (BPFRDs);

1.2 Accomplish the prescribed Turnover Form No.1;

1.3 Furnish the City Mayor, Local COA and the DILG Davao City Director
copy of the initial inventory of BPFRDs

1.4 Conduct final inventory of BFRDPs, to include an inventory of money,


e.g. cash on hand and in bank, used and unused checks and loans, if
any, using Turnover Form No. 2.

2. Conduct of Turnover Ceremony and Submission of Report:

2.1 Organize and conduct a Turnover Ceremony, to include a briefing on


the State of Barangay Governance, Financial Performance Report and
Key Challenges, among other information and accomplishments to the
new set of barangay officials;

2.2 Notify/Inform the City Officials, DILG Davao City Director, local COA
and barangay residents of the conduct of the turnover ceremony;

2.3 Submit a report and the accomplished Turnover Form No. 2 and other
relevant documents on the conduct of a turnover ceremony to the
Local COA, and the DILG Davao City Director;

3. Ensure completeness of the following:

3.1 All barangay financial, legislative and administrative records;

3.2 Transcript, minutes of meetings, list and status of complaints filed


before the Lupong Tagapamayapa;

3.3 Updated Registry of Barangay Inhabitants (RBI) and Members of the


Barangay Assembly;

3.4 All other documents involving barangay transactions;

4. See to it that all supplies and properties of the barangay, that are in actual
possession or entrusted to the concerned barangay officials and
employees, are properly accounted and listed in the prescribed Turnover
Forms.

SECTION 1. It shall be unlawful for any minors Seventeen (17) years and below to be
loitering outside of their residents 7:00 o’clock in the evening to 4:00
in the morning unless they are in the company with their parents of
guardians.

SECTION 2. It shall be unlawful for any persons above Eighteen (18) years old to be
loitering around after 10:00 o’clock in the evening to 4:00 in the
morning unless they are students attending evening classes and going
home from work/duty.

SECTION 3. It shall be unlawful for any person or group of persons from Eighteen (18)
years old above to be staying late at night after 10:00 o’clock in the
evening to 4:00 o’clock in the morning loitering the streets, plaza,
purok center and at stores having fun with their groups, such as shouting, nabbing
unnecesarry voices, creating public disturbance and alike or voices during
time of emergencies such as sickness, thief / robbery,
insurgencies or person who have overtime job/night shift or reporting
for duty es exempted.

SECTION 4. Violators under Section 1 Provisions on this Ordinance shall upon conviction,
be fined as follows:

1st Offense - Php50.00 / child / minoR

2nd Offense - 100.00 / child/ minor

3rd Offense - 200.00 / child / minor

Two days imprisonment or both upon the discretion of the court.

SECTION 5. Any person’s violating the provisions of this Ordinance under Section 2 shall upon
conviction, be fined as follows:

1st Offense - Php100.00 / child / minor

2nd Offense - 200.00 / child/ minor

3rd Offense - 300.00 / child / minor

WHEREAS, Local Government Units were authorized to participate in implementing


infrastructure programs and provided with greater authority to approve contracts to
implement projects falling within their respective jurisdiction;

WHEREAS, Resolution No. 03-2024 of the Government Procurement Policy Board


(GPPB) adopted and confirmed the composition of the Bids and Awards Committee (BAC)
in LGUs including the Barangay, as follows:

“At least five (05), but not more than seven (07), regular members of the
Sangguniang Barangay who shall elect among themselves who shall act as the Chairman
and Vice Chairman.”

WHEREAS, the assumption of the new set of Barangay Officials necessitates the
reorganization of the new members of the Bids and Awards Committee;

NOW, THEREFORE, by virtue of power vested upon me by R.A. 7160, otherwise


known as the Local Government Code of 1991, I, GIL L. LOPEZ, Punong Barangay of
Barangay Talandang, City of Davao, do hereby order the designation of the following
Barangay Officiials to the BIDS AND AWARDS COMMITTEE:

SECTION I. COMPOSITION:

The following shall compose the BAC of Barangay Talandang, Tugbok, Davao City:

Chairman: Hon. Jean B. Hilario Sangguniang Barangay Member


Vice Chair: Hon. Normie E. Onas Sangguniang Barangay Member
Members: Hon. Rodolfo E. Ferolino Sangguniang Barangay Member
Hon. Jerry U. Tero Sangguniang Barangay Member
Hon. Glenn L. Lopez Sangguniang Barangay Member
Ms. Jennifer M. Palco Barangay Secretary

SECTION 2: All members be furnished a copy of this order.

SECTION 3. Effectivity. This Executive Order shall take effect immediately.
