Notice of Force Majeure Event

Dear Mr. González,

Acting pursuant to the terms of the Contract Clause 34, item ref. 34.3, and in relation with
the specific circumstance described within item ref. 34.1.2.4, this is to inform the Owner
about the complete stoppage of all working activities related to the Project the Contractor
is being experiencing from the early morning of today Wednesday on March 21 st 2018, as
a result of a strike imposed by the local Union “Unidos pero No Pegados”, represented by
Mr. Casco Fernández, raised for reasons not attributable to the Contractor.

In this regard, we hereby report the Contractor´s personnel and equipment currently at-
tending on site, along with the remaining members of the Contractor’s Group, being collec-
tively referred to as the “Affected Parties” of the Force Majeure Event:

1- Contractor’s manpower & equipment list on stand-by, deployed on Site as per Notice to
Proceed XXXXX dated February 1st 2018:

EQUIPMENT:
a. No. 4 (four) backhoes;
b. No. 5 (five) trucks;
c. No. 3 (three) 200 ton cranes;

LABOR:
a. No. 450 (for hundred-fifty) direct personnel deployed on site,
b. No. 10 (ten) indirect personnel working at the site offices.

2- Contractor’s Subcontractor “XXXXX” assigned to the erection activities as per the

awarded Subcontract ref. XXXX dated XXXX, and related personnel and equipment
deployed on site.

The extent of the delay impacts of the referenced Force Majeure event along with the po -
tential disruptions on the performance of the Contractor’s obligations still cannot properly
assessed at this stage, hence they will be communicated once their effects will cease.

However, we confirm that the Contractor is undertaking its best efforts in order to mitigate
any detrimental effect arising out from the Force Majeure event to the extent as reasonably
possible and in accordance with item 34.4 of Clause 34.

Based on the above, pursuant to item 15.3.2 of Clause 15, the Contractor is kindly re -
questing the Owner the issuance of a Change Order caused by a Force Majeure Event in
accordance with the provisions of item 34.6 of Clause 34.

Meanwhile the Contractor shall keep the Owner informed about any further developments
of the matter.
