DEED OF EXTRA-JUDICIAL SETTLEMENT OF REAL PROPERTY

WITH WAIVER AND RENUNCIATION OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS:

WHEREAS, OTHELO T. TABABA SR., died intestate at Antipolo

Community Hospital, San Jose, Antipolo City on 24 December 2011, leaving no will
nor debts settled to date but leaving a parcel of land;

WHEREAS, at the time of his death, he left as forced heirs, the following and
to wit:

OLIVIA D. TABABA, of legal age, Filipino, single, and with residence

and postal address at Block 18 Lot 34 Shearwaters St. Ph. 4, Vista Verde,
Country Homes, Muntingdilaw, San Jose, Antipolo City;

OPHELIA D. TABABA, of legal age, Filipino, single, and with

residence and postal address at Block 18 Lot 34 Shearwaters St. Ph. 4, Vista
Verde, Country Homes, Muntingdilaw, San Jose, Antipolo City;

OTHELO D. TABABA JR., of legal age, Filipino, single, and with

residence and postal address at Block 18 Lot 34 Shearwaters St. Ph. 4, Vista
Verde, Country Homes, Muntingdilaw, San Jose, Antipolo City; and

ODESA D. TABABA, of legal age, Filipino, single, and with residence

and postal address at Block 18 Lot 34 Shearwaters St. Ph. 4, Vista Verde,
Country Homes, Muntingdilaw, San Jose, Antipolo City;

VIRGINIA D. TABABA, of legal age, Filipino, widow, and with

residence and postal address at Block 18 Lot 34 Shearwaters St. Ph. 4, Vista
Verde, Country Homes, Muntingdilaw, San Jose, Antipolo City.

WITNESSETH:

THAT we are the legitimate children and spouse, respectively, of OTHELO

TAMISEN TABABA SR., who died on 24 December 2011 in Antipolo City; copy of
his death certificate is hereto attached as Annex “A”;

THAT said deceased died without any will or testament and without any
outstanding debts in favor of any person or entity;

 THAT said deceased, at the time of his death, left a certain real property,
situated in Antipolo City and more particularly described as follows, to wit:

TECHNICAL DESCRIPTION

A parcel of land (Lot 34 Block 18 of the consolidation-

subdivision plan, Psd-04-002098, being a portion of the
consolidation of Lots 2172, 2200, 2201, 2205, 2208, 2209, 2211,
2237, 2187, 2242, 2253, 2290, & 2291 Cad-29 Antipolo Cad.
Lots 1-18 (LRC) Psd-140748, Lot 2212-B (LRC) Psd-1537313,
Lot 2240-A (LRC) Psd-227260 & Lot 2199-A (LRC) Psd-133416
& Lots 2200-A & 2200-B (LRC) Psd-205594, LRC Record No. )
situated in the Municipal of Antipolo, Province of Rizal.
Bounded on the SE., along line 1-2 by Road Lot 4; on the SW.,
along line 2-3 by Lot 35, Blk-18; on the NW., along line 3-4 by
Legal Easement; & on the NE., along Line 4-1 by Lot 33, Blk-18
of the consolidation/subdivision plan. Containing an area of
TWO HUNDRED SEVENTY (270) SQUARE METERS. More or
less.

WHEREAS, in view of the above facts and circumstances, we are therefore co-
owners and to terminate co-ownership over the same, we hereby adjudicate over the
same in pro-indiviso sharing pursuant to Section 1, Rule 74 of the Rules of Court of
the Philippines, subject to the liabilities imposed by Section 4, of the same rule.

WAIVER OF RIGHTS

WHEREAS, We, OLIVIA D. TABABA, OPHELIA D. TABABA,

OTHELO D. TABABA JR., and ODESA D. TABABA (whose personal
circumstances is mentioned above) has agreed and covenanted to CEDE,
TRANSFER and CONVEY unto our co-heir VIRGINIA D. TABABA (whose
personal circumstances are mentioned above), their heirs and assigns the full
ownership and possession of the above-described property.

NOW, THEREFORE, for and in consideration of the foregoing premises, We

waived and renounced as by these presents, We hereby WAIVE and RENOUNCE our
share, right and participation over the above-described property in favor of
VIRGINIA D. TABABA their heirs and assigns the full ownership and possession
of the above-described property.
