Sir/ Madam :

Reference is made to the Owner's letter with Ref. No. MRTT-REC-LTR-21-0264


dated 03 March 2021 regarding the above captioned subject.

In addressing the two (2) items raised by the Owner in the aforesaid letter, kindly
refer to the Contractor's comments in respect thereto:

1. Base Course:

The Contractor would like to requests the Owner to provide the parameters and
basis of its recommendation in relation to the base course requirements in order
for the Contractor to revisit its technical and design considerations accordingly.
The submitted cross-section between ballasted and ballastless is already
satisfying design requirements.

2. Derailment Containment:

The Contractor (Rotem) reiterates that derailment protection is not considered


in the design of ballasted track. Such a structure is not a requisite in any
ballasted track worldwide. The Contractor's basis for designing the tracks is in
accordance with AREMA wherein it does not require for such requirement, and
likewise based from good Industry practice. If the Owner insists in the inclusion
of this item, we request that we be advised on how this will be installed, for our

Owner to show any engineering code or any basis that would fully support their
request for the same.

We trust the Owner has been clarified about the foregoing items and issue the
necessary approval thereto. The Owner should have final decision on the above
matters to prevent further delays.

Gentlemen:

We refer to your letter with Reference No. REC-21-102 dated February 11, 2021 regarding
the subject matter.

The Owner acknowledges receipt of the document and has reviewed it accordingly. We
note that the Contractor submitted their quantification for the Civil part of the Ballast to
Non-ballast variation. However, we wish to clarify that the Owner has outstanding issues
raised thru the following correspondence.

- MRT7-REC-LTR-20-1328 dated November 18, 2020.


- MRT7-REC-LTR-20-1464 dated December 20, 2020.
- MRT7-REC-LTR-21-0132 dated January 31, 2021.

The Contractor failed to address two (2) items mentioned in the above documents for the
Ballasted Track cross-section which are the following:
1. Base Course
2. Derailment Containment
