CRIMINAL COMPLAINT AFFIDAVIT

I, Jocelyn F. Bayani, 36 years old, married, and resident of P-2 Barangay Bagong Silang I, Labo,
Camarines Norte, after having been duly sworn to in accordance with the law, do hereby deposes
and say THAT.

At about nine o’clock in the evening (9:00PM) on September 5, 2022, while I was selling fried
chicken at the corner of the rotunda in our barangay, a man came and asked me how much a
whole fried chicken costs.
“220 sirs” I answered him, he suddenly spoke and told me “That chicken is expensive, are you
from here? Do you want me to catch you stupid!”,

That I just didn’t answer him and continued to fry the chicken orders of the buyers at that time.
He suddenly took two fried chickens that were on display and threw them at me while yelling
“YOU ARE RUDE! ARE YOU DISRESPECTING ME?” I answered him “no sir” but he gets
even angrier. He walked towards me and suddenly punched me in the face causing me to fall
to the ground.

As I stood up, he kicked me in my left side of the body and I fell again. After that, he
approached me and said “You will call the police, then call!, I am not done with you yet. I will
kill you! and he quickly left away from where we were.

The said man’s assault on me was seen and witnessed by Jay Fransisco who also rushed me
to the Talobatib hospital (A - joint sworn statement of the witness) I was treated there and
I stayed for five days (B – MEDICAL CERTIFICATE)

Because of what he did to hurt, threaten, embarrass and identify himself as a policeman, I
want to file a corresponding criminal case against this man, who was later identified as
FERNANDO DELA CRUZ, 40 years old, security guard, resident of Lag-on Daet, Camarines
Norte.

In addition to this, I also want him to pay for the expenses I incurred in the treatment which
reached five thousand pesos (C- Hospital Bills)

As proof that all my statements are true and that no one forced, threatened or promised me
anything in return to do this, I will sign my name written below this September 5, 2022, here in
the province of Camarines Norte.
