WAGES

$ 100.00 US Dollars per day based on a Consolidated Day Rate that includes Overtime

commencing work, whichever first occurs, and shall terminate upon completion of work and repatriation.

MEANS OF PAYMENT OF WAGES

Your wages will be payable by bank transfer to your account at (__) monthly intervals at end of each month /
(__) bi-monthly intervals.

You may make an allotment of part or all of your wages. You may take part of your wages as a cash draw on
ship funds as they are available.

You will receive monthly by email an accounting of the distribution of your earnings. The cost for wire
transfer of your wages will be paid for by the company. Additional costs associated with allotment to your
bank account will be set by the banks and will be debited to your account.

PAID ANNUAL LEAVE

You are entitled to take 2.5 working days as paid leave for each month of employment. You are paid for these
annual leave days in advance, each month as they accrue through your Consolidated Day Rate.

HOURS OF WORK

Your basic wage is based upon working eight hours per day. As you are expected to work twelve hours per
day while in port and at sea, four hours of overtime pay will be included in your Consolidated Day Rate. Your
hours of work will be arranged such as to ensure that you receive a minimum of 10 hours available for rest
in each 24-hour period and a minimum of 77 hours rest in each seven-day period (as per STCW regulation).
This minimum period of rest may not be reduced below 10 hours except in an emergency. Rest periods may
be no greater than 2 per day and one must be at least 6 hours. Work and rest hours will be posted on
board.

You may be required, at the absolute discretion of the Master, to work additional hours during an emergency
affecting the safety of the ship, its passengers, crew or cargo or the marine environment or to give assistance
to other ships or persons in peril. You may also be required to work additional hours for safety drills such as
musters, fire-fighting and lifeboat drills. In such circumstances you will be provided subsequently with (a)
compensatory rest period(s).

NOTICE OF TERMINATION OF EMPLOYMENT

Indefinite Period Agreement

Your employment is for an indefinite period commencing with your Company provided travel to the ship and
extending for a term not exceeding six (6) calendar months, or less as determined by the expiration date of
your mariner documents.

It may be terminated for justified reasons by either party in advance of this point. The length of notice which
you are obliged to give to terminate your employment is 7 (seven) days. The length of notice which you are
entitled to receive from the ship owner to terminate your employment is 7 (seven) days.

Exceptions may be made for compassionate reasons. If a person enters himself as qualified for duty which he
is found incompetent to perform, he may be discharged without such notice.

HEALTH AND SOCIAL SECURITY BENEFITS

The vessel operator is responsible for sick and injured seafarers in accordance with the general maritime law
remedy of Maintenance and Cure. See Vanuatu Maritime Act CAP 131, Regulations 53, 63 and Paragraphs
127, 127A, 128, 129.

If you require medical care while you are on-board this will be provided free of charge, including access to
necessary medicines, medical equipment and facilities for diagnosis and treatment and medical information
and expertise. Where practicable and appropriate, you will be given leave to visit a qualified medical doctor
or dentists in ports of call for the purpose of obtaining treatment.

If you become sick or injured and unable to continue while on a voyage, you will be paid your normal basic
wages until you have been repatriated in accordance with the repatriation provisions set out below. After you
have been repatriated you will be paid 1/3 of your normal basic wage up to a maximum of sixteen (16) weeks
from the day of injury or illness.

In the event of sickness or incapacity, you will be provided with medical care, including medical treatment
and the supply of necessary medicines and therapeutic devices and board and lodging away from home until
your recovery or until your sickness or incapacity has been declared of a permanent character, subject to a
maximum period of 16 (sixteen) weeks. In addition the ship owner will meet the cost of the return of your
property left on board to you or your next of kin.

In the event of your death occurring on board or ashore during a voyage, the ship owner will meet the cost of
burial expenses, or cremation where appropriate or required by local legislation, and the return of your
property left on board to your next of kin.

REPATRIATION

You will be entitled to repatriation, at the expense of the ship owner, if you are away from your country of
residence when this agreement is terminated.

Note: - You may not be entitled to repatriation at the expense of the ship owner in circumstances where you
have been dismissed on disciplinary grounds or have breached your obligations under this Agreement. In
such circumstances the ship owner will still be liable to repatriate you but is entitled to recover from any
wages due to you the cost of doing so.

COMPLAINT PROCEDURES

If you have a complaint regarding your employment or ship owner’s compliance with the ILO MLC 2006 you
should follow the ship owner’s complaints procedure, a copy of which will be provided to you when you join
the vessel.

DISCIPLINARY RULES AND PROCEDURE

The disciplinary rules applicable to you are set out in the Vanuatu Maritime Regulations (CAP 131) Chapter 8, and
the additional provisions listed below.

1. Seafarer will become familiar with and abide by the policies and procedures of the TDI Brooks
International Safety Management Manual, located aboard the vessel.

2. Seafarer has been provided the TDI Brooks employee manual and agrees to abide by the policies and
procedures set forth therein.

3. Seafarers shall conduct themselves in an orderly, faithful, honest and sober manner, and shall
at all times be diligent in their respective duties and obedient to the lawful commands of the
Master, or of any person who shall lawfully succeed him, and their superior officers, in
everything relating to the vessel, its stores and cargo, whether on board, in boats or on
shore. In consideration of this service, to be duly performed, the Company agrees to pay
the undersigned seamen the wages expressed herein and/or set forth in supplemental
provisions and/or agreements.

5. Any seaman who is put ashore at a port other than the one where he signed on these Articles and who
is put ashore for reasons for which he is not responsible, shall be returned as a seaman or otherwise,
but without expense to him (a) at the Shipowner's option, to the port at such seaman's own country;
or (b) to another port agreed upon between the seaman and the Shipowner or Master. However, in
the event such seaman's contract period of service has not expired, the Shipowner shall have the right
to transfer him to another of the Shipowner's vessels to serve thereon for the balance of the contract
period of service, unless otherwise provided for herein.

6. Any seaman whose period of employment is terminated by reason of completion of the voyage for
which he was engaged or of expiration of his contract period of employment, shall be entitled to
repatriation at no expense to him to the port at which he was engaged, or to such other port as may
be agreed upon.
7. If any person enters himself as qualified for duty which he is incompetent to perform, his
rank or rating may be reduced in accordance with his incompetency or he may be
discharged.

8. The Master shall sign and give to a seafarer discharged from his vessel either on his
discharge or payment of his wages, a Certificate of Service containing sufficient
information to facilitate the acquisition of further work or to satisfy the sea -
service requirements for upgrading or promotion and specifying the period of his
service and the time and place of his discharge. In lieu of a Certificate of Service, such an
endorsement may be made in the Seafarer’s Discharge Book.
9. Seaman shall keep their respective quarters clean and in order.
10. No dangerous weapons, narcotics or contraband articles, and no alcoholic beverages, shall
be brought on board the vessel nor allowed in the possession of the crew, and any crew
member bringing the same on board or having the same in his possession on board, shall
be subject to discharge and/or shall be liable for such fines as the Master may direct, and
all such articles shall be confiscated. The amount of any fine levied against the vessel by
the proper authority of the port wherein the vessel is then located, for possession of
narcotics and/or contraband cargo, shall be made good to the Ship owner out of the wages
of the crew member or crew members guilty of such possession.
11. No seaman shall go ashore in any foreign port except by permission of the Master. However,
the Master shall not refuse the reasonable request of any seaman for shore leave for the
purpose of presenting a complaint against the vessel or Master to a Special Agent, a Vanuatu
Consul or other proper Vanuatu official.
12. The ship owner and Master may issue such rules and regulations as may be necessary for the
safe and proper operation of the vessel; provided nothing contained therein shall be
contrary to law.
13. If any seaman considers himself aggrieved by any breach of these Articles, he shall represent
the same to the Master or office in charge of the vessel, in a quiet and orderly manner,
who shall thereupon take such corrective action as the case may require.

IT IS ALSO AGREED THAT

A. Ship owner is a drug-free company and expects its employees to comply with its drug free
policies as a condition of employment. Seaman is subject to drug testing, including random
drug testing, as ship owner requires.
B. One or more performance evaluation will be conducted during the active dates of this signed
agreement and the results of such evaluation(s) may be used to determine the eligibility of the
seafarer for future employment.

C. Original copies of professional documentation (endorsements, certificates, licenses etc.)
required for the employee’s position as listed in Appendix A will be presented at the time of
arrival on the vessel for inspection by the Master. Failure to present the documentation may
result the termination of this agreement and dismissal.

Instruction to the Master

The following professional documents (under Column A) are required for the position of “COOK”.

Masters, please review the Mariner’s certificates and confirm the expiration dates under Column B are
accurate and in date. If correct, sign your initials in Column C. If any of the documents have been
updated or changed and have new expiration dates, please write the date next to your initials. Any new
documents need to be sent to crewdocs@tdi-bi.com.

Once this Appendix page has been completed, scan it and the signature page (page 6) and send them to
crewdocs@tdi-bi.com.
