CONSTRUCTION AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT AGREEMENT, made this ___8th____ of ____December____, _2022_, by and between:

The DPWH QUEZON CITY 2ND DISTRICT ENGINEERING OFFICE, represented herein by chief
engineer, ENGR. DE RAMON P. DEVANADERA, married, Filipino citizen, of legal age, hereinafter
referred to as “PROCURRING ENTITY”;
-and-

CLOUD NINE CONSTRUCTION SUPPLIES AND AGGREGATES, single proprietorship, doing


business in the Quezon City under this firm name, in accordance with the provisions of existing laws, with
principal address at Solano, Nueva Vizcaya represented herein by its proprietorship/manager, ENGR. DAN
ASLEY G. ARCEGA, single, Filipino citizen, of legal age, herein referred to as “CONTRACTOR;”

WITHNESSETH:

WHEREAS, the PROCURRING ENTITY is desirous that the CONTRACTOR execute the Works under
Contract ID 19CC0218 – Construction of multi-purpose building (Barangay Hall) U.P. Village, Quezon City,
Metro Manila, hereinafter called the “Works,” and the PROCURING ENTITY has accepted the Calculated Bid of
the CONTRACTOR for the execution and completion of the Works at the calculated unit bid prices shown in the
attached Bill of Quantities, or a total Contract price of Six Million Pesos and 92/100 (P6,000,000.00)

TERMS AND CONDITION

CONTRACTOR’S SCOPE OF WORK: The supply of labor, materials and other incidentals necessary for the
completion of all excavation works to include the supply of cement, but excluding installation of hollow blocks, in
accordance to the plans and specifications.

DURATION OF THE CONTRACT: Three Hundred Ten (310) Calendar days commencing on December 15, 2022.

TERMS OF PAYMENT: Progress payment of works accomplished by the CONTRACTOR will be paid at the end of
every thirty days, pro-rata to his accomplishment.

To guarantee workmanship and materials supplied, retention money of 10% of the CONTRACTOR’S progress
payments will be deducted and the sum of which will be released only after CONTRACTOR’S completion of work
as certified by the PROCURRING ENTITY or his representative. The CONTRACTOR warranties his work for a
period of six (6) months after issuance of certificate of completion and acceptance by the PROCURRING ENTITY.

LIQUIDATED DAMAGES. In the event that the CONTRACTOR failed to complete his works within the agreed
contract duration or extension thereof, the CONTRACTOR agrees to pay the PROCURRING ENTITY the sum of
Pesos: Twenty Thousand Pesos (Php 20, 000.00) for each and every calendar day of delay as liquidated damages
and not by the way of penalty and the PROCURRING ENTITY may deduct from any amount due or to become
due to the CONTRACTOR.
The Parties to this agreement hereby agree to the full performance of the covenants herein this 8th day of
December, 2022 in Quezon City, District 6
