Informed consent for use of images containing staff or clients

About informed consent


The aim of informed consent is for the subject to truly understand why their photograph/film is
being taken, who will own the photograph/film, where the photograph/film may be used, who may
see the photograph/film and what privacy rights they have.

An informed consent process ensures the rights of the subject are considered, a respectful approach
that EPN (Ecumenical Pharmaceutical Network) brings to all of its work.

Instructions
The photographer should read the ‘Informed consent explanation’ below to the subject and check
whether the subject has (a) understood the information and (b) consents to their image being taken
and used by EPN.
Give examples of how photos are used, for example by explaining a brochure or poster. Offer to put
the person in touch with EPN Secretariat for more information.
The photographer should then either film the subject giving consent (see following page) or complete
and sign the ‘Informed consent checklist’ including the name of the subject, the location and the
date.

Photographs of children
Before taking any photographs/films of children, the photographer must read the informed consent
explanation to the child’s parent or guardian, who must agree to their child being
photographed/filmed.
If the photographer suspects that the person is under 18, the photographer must ask their age and
then seek consent from parents or guardians.

(Read this to the subject – translate if appropriate)

EPN and their partners often take photos/films of the people we work with, in order to promote
the work we do.

I would like to ask your permission for me to take your photograph/film you. If you do not want
me to take your photo or film you, there is no problem.

(IF TAKING PHOTOGRAPHS OF CHILDREN)

I would like to ask your permission for me to take your child’s photo/film your child. If you do
not want me to take your child’s photo/film, there is no problem.

If we take your photo/film you, we may use it in brochures, magazines or on the internet. Your
photo/film may be seen internationally. It may be seen by people you know.

We may also give your photo/film to other organizations we work with, including our donor
organizations.

We cannot pay you for this photo/film and we do not sell photos or films to anyone.

We usually use the name of the person in the photo when we publish the photo. Do you mind if
we use your name? If you would prefer, we do not have to use your real name.

Recording informed consent


Informed consent may be recorded in one of two ways:

1. On film

Use the film mode of your camera or a mobile phone to record the subject giving consent. The
subject should say the following (in whichever language is appropriate).
“My name is ________ and I give EPN permission to use my photograph/film me.”

2. Informed consent checklist

The photographer should complete and sign this checklist (instead of filming subject).
I have given the subject/s an overview of the informed consent process
I have told the subject/s that they are under no obligation to be photographed or filmed
I have explained the ways that EPN may use the photos or film
I have confirmed that the subject is over 18 years of age OR
The subject is under 18 and I have completed the consent process with a parent or guardian
I have informed the subject that they can remain anonymous if they choose
I have explained that the subject will not be paid for their photo and that EPN does not sell
its photographs
I have explained to the subject how their photograph will benefit the work of EPN
I have given the subject EPN contact details for follow-up regarding permissions
