Dear Mr. Doe

On behalf of Ms. Jane Doe, the mother of your child John Doe Jr., the
undersigned counsel hereby puts this letter in writing to serve as a formal
demand for support as part of your obligation to John Doe Jr. as provided by
law.

The law has defined Support under Article 194 of the Family code to wit;
“Support comprises everything indispensable for sustenance, dwelling,
clothing, medical attendance, education and transportation, in keeping with
the financial capacity of the family.”
“The education of the person entitled to be supported referred to in the
preceding paragraph shall include his schooling or training for some
profession, trade or vocation, even beyond the age of majority. Transportation
shall include expenses in going to and from school, or to and from place of
work”

Article 195 on the other hand provides for the person who is entitled to
support one another, which includes but not limited to parents and their
children, whether legitimate or illegitimate.

Furthermore, any unreasonable deprivation of your child’s basic needs is


a criminal act punishable as child abuse punishable under Sec. 3. b(3) of R.A.
7610, also known as Special Protection of Children Against Child Abuse,
Exploitation and Discrimination Act. It states:
"(b) "Child abuse" refers to the maltreatment, whether habitual or not, of the
child which includes any of the following:

(1) xxx
(2) xxx
(3) Unreasonable deprivation of his basic needs for survival, such as food
and shelter;".

My client is asking for a monthly support of Php XX,XXX.XX, which shall


be paid at the first day of each month. The amount shall cover your share of the
expenses for your common child’s basic needs, education including
transportation as well as miscellaneous expenses that he may incur.

Please take note that the amount being demanded by my client may
change in the future depending on your child’s needs and additional amount
may be demanded in case of emergencies and other unforeseen situations.

As you failed to comply with your obligation to provide support for the
past Two (2) years from the date of APRIL 2020 until the present date, my client
is also asking for the amount of Php XX,XXX.XX which shall cover your share of
the expenses for the support of your common child, covering the aforementioned
time periods

Consider this correspondence as your final warning and prudent


opportunity to comply with your obligations to provide adequate support for
your child.

We hope that you make the right decision to attend to this matter
seriously and act upon it wisely and prudently to avoid needless inconvenience.
Ignoring this demand letter gives us no recourse but to initiate a formal
legal action to safeguard the interest of my client.
