CONSTITUTION AND BY-LAWS

Article I
NAME AND DOMICILE

Sec. I The organization shall be known as Bachelor of Science in Criminology


(BSCRIM) or is also known as CRIMINOLOGY Department.
Sec. II The CRIMINOLOGY Department shall have domicile in South Central
Mindanao College of Science and Technology, Purok Rosal, Barangay
New Isabela, Tacurong City.

ARTICLE II-A
ACADEMIC POLICIES

Sec. I. The Criminology students shall maintain their academic grades and to
avoid the following deficiency:
a. 1 major subject failed – not allowed to enroll the requisite.
b. 2 major subjects failed – advise to lessen the number of subject
units
c. 3 major subjects failed – subject for course shifting or for transfer to
other institution.
Sec. II Incoming 2nd year Criminology students are required to take the qualifying
exam. The students should passed the qualifying exam with the passing
score of 75. Failed to passed the qualifying exam are not allowed to enroll
the course.
Sec. III Students must undergo 3 days training before deploying for their On-the-
Job Training (OJT).
Sec. IV 4th year criminology students are required to take the Pre-Board Exam as
part of the preparation of their upcoming board examinations.

ARTICLE II-B
DECLARATION OF PRINCIPLES AND OBJECTIVE

Sec. I The CRIMINOLOGY DEPARTMENT shall maintain their integrity and


autonomy in all official dealings and undertakings not for jeopardize the
interest and welfare of its constitution.
Sec. II The CRIMINOLOGY DEPARTMENT shall guarantee and promote the
autonomy of its members to ensure their fullest development as self-
reliant organization and make them more effective partners in the pursuit
of social, educational, moral and spiritual and physical development.

Sec. III In adherence to the principle of transparency, the CRIMINOLOGY
DEPARTMENT guarantee equal access to all members to its financial
papers, attendance lists, financial debts or liabilities, documents,
communication, internal and external affairs as well as its financial records
except such matters that will prejudice the legitimate interest of the
organization.
Sec. IV The general objectives of the organization is to establish unity and
cooperation among its members. CRMINOLOGY DEPARTMENT
especially aims to:
a. Discuss, tackle and solve issues which concern among the
members of the department through counseling or open forum and
conventions.
b. Support its members in their school activities, academically and
spiritualually.
c. Promote mutual understanding, cooperation and smooth
relationship with other lawful organization.

ARTICLE III
MEMBERSHIP

Sec. I Student enrolled in SCMCST College Bachelor of Science in Criminology


is automatically a member and shall be subjective to pay fifty pesos (Php
50.00) as a membership fee every semester (Php 25.00) for the midterm
and another (Php 25.00) for the upcoming final term.
Sec. II All members shall be subjective to pay the fines that are being imposed by
the organization. Otherwise, they are not covered of any fines that have
been implemented by the organization as stated in Article XI, Section II of
these constitution and By-laws.

ARTICLE IV
THE RIGHTS AND RESPONSIBILITIES OF MEMBERS

Sec. I All members shall have equal rights to:


a. Access all matters related to the affairs of the CRIMINOLOGY
DEPARTMENT.
b. Seek and give support from their redness and grievances; and
c. Avail the relation advantage of collective bargaining power.
d. Share opinions and knowledge in terms of tackling activities or
upcoming events related to financial, activities and schedules.
e. Volunteer themselves in terms of giving help for the department.
f. Make clarifications regarding the documents handed by the
criminology department officers.
g. All members of the CRIMINOLOGY DEPARTMENT must submit a
medical certificate to assure the health of its members.

Sec. II It should be the moral responsibilities of the organization’s officer to:
a. Respect and uphold all the provisions promulgated by
CRIMINOLOGY DEPARTMENT;
b. Disseminate widely through accessible means the policies to be
promulgated by CRIMINOLOGY DEPARTMENT;
c. Collect funds from individual members;
d. To be a role model I terms of the following rules and regulations of
the Department.

ARTICLE V
STRUCTURE OF THE ORGANIZATION

Sec. I The CRIMINOLOGY DEPARTMENT shall be composed of the following


officers: President, Vice President, Secretary, Treasurer, Auditor, Public
Information Officer (PIO), 2 Business Managers, 2 Sergeant at arms, and
Classroom Representative.

ARTICLE VI
QUALIFICATION OF THE OFFICERS

Sec. II The following are the qualifications of the elected officers:


1. PRESIDENT

a. He/She must be a bonafide student of SCMCST and is officially


enrolled in BSCRIMINOLOGY.
b. He/She must have a good character and unable to commit any
violation or offense against the rules and regulation of the
school.
c. He/She must possess the internal and external attitude of being
everyone’s role model.
d. He/She must have the power to control the unpleasant attitude
of its members in a pleasant way.

2. VICE PRESIDENT

a. He/She must be a bonafide student of SCMCST and is officially


enrolled in BSCRIMINOLOGY.
b. He/She must have a good character and unable to commit any
violation or offense against the rules and regulation of the
school.
c. He/She must possess the internal and external attitude of being
everyone’s role model.
d. He/She must have the power to control the unpleasant attitude
of its members in a pleasant in coordination with the president.

3. SECRETARY

a. He/She must be a bonafide student of SCMCST and is officially
enrolled in BSCRIMINOLOGY.
b. He/She must have good communication and interpersonal skills.
c. He/she must have the capacity in doing transactions and in
making a communication letter to all the MSO undertakings.
d. He/She must possess the ability in terms of keeping all the
records of the department.

4. TREASURER

a. He/She must be a bonafide student of SCMCST and is officially


enrolled in BSCRIMINOLOGY.
b. He/She is capable to keep the fund secure and safe.
c. He/She must take charge in disbursing the money of the
organization.
d. He/She must secure and keep all the transaction records in
terms of financial.
e. He/She must report with to president and secretary the cash on
hand.

5. AUDITOR

a. He/She must be a bonafide student of SCMCST and is officially


enrolled in BSCRIMINOLOGY.
b. He/She must be good in auditing.
c. He/She must have a copy of financial records that is being kept
by the secretary.

6. PUBLIC INFORMATION OFFICER

a. He/She must be a bonafide student of SCMCST and is officially


enrolled in BSCRIMINOLOGY.
b. He/She must be engaged in public speaking and must have the
capacity to act as a spoke person of the organization.
c. He/She must have the capacity to publish the activities of the
organization through the existing media of the campus.
d. He/She must have a copy of the important transaction records
with department officers for her publication and verification of its
members.

7. BUSINESS MANAGERS

a. He/She must be a bonafide student of SCMCST and is officially


enrolled in BSCRIMINOLOGY.
b. He/She must be good in money budgeting.
c. He/She must keep all the records of his/her transactions to be
submitted to the treasurer for recording.

8. SERGEANT @ ARMS

a. He/She must be a bonafide student of SCMCST and is officially


enrolled in BSCRIMINOLOGY.

b. He/She must have the capability to implement and maintain
discipline within the organization.
c. He/She must have the ability to make the meetings flow
peacefully.

9. CLASSROOM REPRESENTATIVES

a. He/She must be a bonafide student of SCMCST and is officially


enrolled in BSCRIMINOLOGY.
b. He/She must be elected as the classroom president and has a
capacity to lead and disseminate information to its prospective
department.

ARTICLE VII
DUTIES AND REPONSIBLITIES OF THE DEPARTMENT OFFICERS

1. PRESIDENT

a. He/She must carry out policies and implements the rules and
regulations promulgated by the organization in accordance with the
Constitution and By-laws.
b. He/She shall signal transactions of the organization, bean-ex-officio
member of all communities and the final approving authority in the
operation of the organization.
c. He/She shall presides in all meetings of the organization.
d. He/She shall sign all resolutions, communications and papers of
the organization.
e. He/She must have the responsibility to handle its members in a
unite way.

2. VICE PRESIDENT

a. He/She must preside in all meetings and assume the duties of the
president in case of absence, capability, resignation and such time
a new president has been elected and qualified and he/she shall
serve only in the remaining term of the president.
b. He/She shall have to do all the duties and responsibilities of the
president.

3. SECRETARY

a. He/She shall act as a rapporteur of the organization, certifying the


correctness of all proceedings and the reports of the organization.
b. He/She shall report or submit to the organization all the minutes of
the meetings and records upon termination of his/her term of office.
c. He/She shall check and hold the attendance of the activities,
meetings and affairs and submit to the treasurer of the organization
for the finalization of the copy.

d. He/She must have his/her 2nd copy of all total financial records of
the treasurer in case the members will ask for verification.

4. TREASURER

a. He/She shall primarily be responsible of all the properties, funds


and accounts of the organization.
b. He/She shall disburse funds in accordance with Section 5, Article
III.
c. He/She must keep all the records that flow in the organization
supported with receipts.

5. AUDITOR

a. He/She shall audit all funds and financial properties of the


organization in partnership with the secretary.
b. He/She shall see to it that all transactions are in accordance with
rules and regulations and other policies promulgated or adopted by
the organization.

6. P.I.O

a. He/she shall make an announcement of the notices issued by the


secretary.
b. He/she shall prepare and publish the activities of the organization
through the existing media of the campus.
c. He/She shall make and keep the members informed of the activities
and other matters pertaining to the general welfare of the members.
d. He/She shall act as a spoke person of the organization in
announcing. regarding pertinent decisions and statements.
e. He/She must act as the spoke person of the president.

7. BUSINESS MANAGERS

a. They shall assist the president in all activities undertaken by the


organization.
b. They shall act as procurement officers of the goods and services of
the organization’s projects, programs and activities.
c. They shall always coordinate with the treasurer for the assurance of
the records of the goods purchased.

8. SERGEANT @ ARMS

a. They shall assist the president in maintaining the peace and order
during meetings and other business proceedings of the
organization.
b. They shall discipline members in terms of joining school activities or
department activities.

ARTICLE VIII
THE REPRESENTATIVES

CLASSROOM REPRESENTATIVES
a. He/She shall coordinate to the criminology department officers in
the dissemination of information and announcements.
b. He/She shall attend every meeting of the organization.
c. He/She shall update his/her classmates regarding the
developments and undertakings of the organization.

ARTICLE IX

ELECTION OF OFFICERS

Sec. I The general election of officers shall be held in the first month of the
academic year.
Sec. II Only CRIMINOLOGY students of SCMCST shall be qualified for election
in any position in the organization. Only the third year and fourth year
students are qualified to be elected as presidents and the students from
any year level are qualified for other positions.
Sec. III Special elections shall be announced upon the request of 2/3 of its
members and officers.

ARTICLE X
DISQUILIFICATION OF OFFICERS

Sec. I Any officers may be disqualified with the following grounds:


a. Disloyalty and continuous disregard of his/her duties and functions;
b. Insubordination;
c. Continuous negligence and violation to school rules and
regulations; and
d. Majority opposes require dismissal or expulsion from college.
Sec. II Any officers who have committed three consecutive absences in all
meetings will be subjected for disqualification. An officer being late for 15
minutes in any meetings is equivalent to one absent except if there is a
valid reason.
Sec. III Any officers subjected for disqualification is given due process before the
DEPARTMENT officers will vote for his/her removal. At least 2/3 of votes
of all DEPARTMENT officers are required to impeach any officer.

ARTICLE XI
MEETINGS

Sec. I Regular meetings of officers and classroom representatives shall be held


every last Friday of the month. General assembly shall be done once in
every semester.
Sec. II A special officers meetings or general meetings may be called by the
president upon the request of at least 2/3 of the members of the
organization’s officers for important and special matters and same may
held only upon notice is disseminated to all members by the Public
Information Officer.
Sec. III The attendance of 50% plus one member is necessary to constitute to
undertake an official act of the organization.

ARTICLE XII
RULE OF ORDER

Sec. I The fundamental laws governing the organization and its even
Constitution and By-Laws.
Sec. II The parliamentary procedure shall be used in the conduct of meetings.
Sec. III The minutes of the meeting shall be kept accurately in the book of minute
which then duly assigned by the organization’s secretary may exhibited
whenever it is so deemed necessary duly signed by the officers.
Sec. IV Order of the business in any meeting shall be strictly followed in
accordance with the agenda prepared by the secretary.

ARTICLE XIII
FUNDS AND DISBURSEMENTS OF THE ORGANIZATION

Sec. I There shall be a membership fee in the amount of fifty pesos (Php 50.00)
to be collected by the treasurer of the organization.
Sec. II All money collected by the organization shall be deposited in the bank
account of the organization with the signature of the President, Treasurer
and Adviser and shall be treated as special fund to be withdrawn for
special purposes only upon approval of the officers.
Sec. III The President, Secretary, Treasurer and the Adviser of the organization
shall sign expenditures base from the organization’s guidelines on budget
and auditing rules and regulations.

Sec. IV All collections and contributions duly approved by the CRIMINOLOGY
DEPARTMENT OFFICERS shall be liquidated and presented to the
members with receipts, records and papers as supporting details.
Sec. V Deficit shall not be tolerated.
Sec. VI Donations coming from the outside sources and civic organization shall be
presented to the members with the receipt or paper during liquidation.
Sec. VII All fines collected by the treasurer from the members, record shall be
signed by the president, secretary, treasurer and adviser and fund
collected will be conjoined to all the total fund of the department.
Sec. VIII There shall be a ledger or balance sheet to be presented by the treasurer
to the president and adviser of all the records and even all the bank
transactions of all the funds collected and distributed by the department.

ARTICLE XIV
DUTIES OF THE MEMBERS

Sec. I During the 15th and 30th of the month, the department officers will roved to
Conduct Inspection haircut. Male students must follow the proper haircut
that is white side wall/Army cut.
Sec. II CRIMINOLOGY students must follow the appropriate prescribed uniform
and must wear it on their scheduled days.
Sec. III there must be no CRIMINOLOGY students who will be engaged with
gangsters/fraternity and even forming illegal groups inside and outside the
school campus.
Sec. IV A good CRIMINOLOGY student must possess the ability of knowing how
to respect others especially its co-bodies.
Sec. V SCMCST student have given one-day freedom of wearing a freestyle
every Wednesday but CRIMINOLOGY student must wear an appropriate
attire during wash day.
Sec. VI There must be no CRIMINOLOGY students allowed to wear slippers,
sleeveless, shorts, earrings for male, piercing, wearing of caps during
exam week inside the classroom and during school activities.

ARTICLE XV
GENERAL PROVISIONS

Sec. I No members shall be exempted in paying membership fee, contributions


and even the fines properly imposed by the organization.
Sec. II A copy of the organization’s financial report of any position or statement
shall be displayed or announced to the members every meeting every end
of the month.

Sec. III All elected and appointed officers shall be included during the induction
ceremony and acquaintance party.
Sec. IV Uniform for identification, all CRIMINOLOGY students of SCMCST shall
wear the complete prescribed uniforms for proper identification as stated
in the student handbook:
a. Men in Monday and Friday shall wear their GOA uniform/general
Office Attire, black shoes (wetlook), black slacks, black socks, and
criminology belt and must wear his I.D all the time.
b. Men in Tuesday and Thursday must wear their Type B prescribe
maroon polo shirt, blacks slacks, black socks, criminology belt,
black shoes (wetlook) and must wear his I.D all the time.
c. Ladies in Monday and Friday shall wear their GOA Uniform/General
Office Attire, black shoes (wetlook), black slacks, black socks, and
criminology belt and must wear her I.D all the time.
d. Ladies in Tuesday in Thursday must wear their Type B prescribe
maroon polo shirt, black slacks, black socks, criminology belt, black
shoes (wetlook) and must wear her I.D all the time.
Note: The above prescribe uniforms shall be worn every day except for
Wednesday (Freestyle/ Wash Day).
Sec. V Collection of fines shall be imposed by the organization with the following
offenses.
Minor Offense/Minor Activities: (Php 15.00)
a. Parking of Motorcycles
b. Flag Ceremony every Monday
Major Offense/Major Activities: (Php 25.00)
a. Monthly Department Meetings
b. School Activities
c. Department Activities
d. Criminology Trainings

ARTICLE XVI
DISCIPLINARY MEASURES AND GUIDELINES

“CRIMINOLOGY STUDENTS”
The following is a list of categorized offenses for the information and guidance of
the criminology students.
Category A
a. Not wearing the prescribed school uniform with I.D.
b. Truancy/frequent absences
c. Littering
d. Use the indecent blasphemous words
e. Wearing of indecent/improper attire

Category B
a. Smoking inside the campus
b. Gambling in any form
c. Entering the school premises under the influence of liquor
d. Bringing of any alcoholic beverage inside the campus
e. Assaulting the duly constituted authorities and fellow students – bullying
f. Preventing other students, faculty, employees or other school officials from
discharging their duties and obligation
g. Threatening
h. Misuse of identification card
i. Unauthorized use of school properties/facilities
j. Violation of any valid order of any school authority
k. Erasure or alteration of official and approved notices
l. Disturbances or disruption of classes and meetings.

Sanction/Penalties
1st Offense 1 day suspension from classes
2nd Offense 2 days suspension from classes
3rd Offense 5 days suspension from classes
4th Offense 10 days suspension from classes

Category C
a. Vandalism
b. Stealing/Theft or any attempt thereof
c. Cheating in any form
d. Forgery, alteration or misuse of documents, records or credentials
e. Display or distribution of pornographic materials inside and outside the
campus
f. Malversation of funds
g. Defamation committed against any student, faculty, and personnel by telling,
publishing or circulating false report
h. Destruction of school properties.
Sanction/Penalties
1st Offense 5 days suspension from classes and payment
of actual damage inflicted
2nd Offense 15 days suspension from classes
3rd Offense Suspension for 1 semester

a. Hazing
b. Assaulting/inflicting physical injuries
c. Brawling
d. Instigating, participating in concerted activities leading to stoppage of classes
e. Unlawful possession or carrying/use of firearms, explosives or any weapons.
f. Drug use and drug pushing
g. Immorality
h. Engaging lewd or indecent acts or display of affection in public
i. Sexual harassment/molestation

Sanction/Penalties

1st Offense 10 days suspension from classes and payment


of actual damage inflicted
2nd Offense Suspension for 1 semester
3rd Offense Expulsion

Suspension – is a penalty in which the school is allowed to deny or deprive an erring


student of attendance in classes for a period not exceeding twenty percent (20%) of the
prescribed class days for the school year term.
Expulsion – is an extreme administrative sanction debarring offending students from all
public and private school in the Philippines. It is the most severe penalty available to
schools, and may be imposed without the approval of the DepEd Secretary, CHED
Chair of Tesda Director General.

ARTICLE XVII
AMENDMENTS AND REVISIONS

Sec. I Any amendment to revision of this constitution and by-laws maybe


proposed by the organization officers upon a vote 2/3 of all its members,
or by constitutional convention.
Sec. II The officers may, by majority vote to 2/3 of all its members calling such
convention to all its members in action.
Sec. III Any amendment to, or revision of this constitution and by-laws shall be
valid when ratified by the majority of the votes cast in the plebiscites which
shall not be held not later than thirty (30) days after the approval of such
other revision of amendments.

ARTICLE XVIII
SEPARABILITY CLAUSE

If, for any reason, any section of this Constitution and by-laws is declared
invalid or illegal, the remainder thereof shall not be affected by such
declaration.

ARTICLE XIX
EFFECTIVITY

This constitution and by-laws shall take effect soon as approved and ratified by
the plebiscite called for this purpose by majority votes of the members under that
organization election code.

CRIMINOLOGY MAJOR ACTIVITIES

A. CRIMINOLOGY ACCEPTANCE TRAINING (Every end of the first


semester for the first year criminology students and for the incoming fourth
year students in their OJT Preparation and their open collar)

Objectives:

a. To impart knowledge to the first year criminology students in terms


of the basic principle of military leadership;
b. Developed their fundamental skills on leadership, courtesy and
discipline; and
c. Foster life-long learning experiences that will contribute to their
personal and professional guidance and supervision.

B. CRIMINOLOGY DEPARTMENT DAY (Every first week of second


semester)

Objectives

a. To impart knowledge to the students regarding different


subjects/topics in the field of criminology;
b. To develop their interpersonal skills and be engaged in
collaborative process; and
c. To help develop a high performance team through heartening
shared commitment to common purpose and objective of the
organization and a culture of mutual respect and responsibility.

C. REVEILLE (Failure to attend the activity will pay the fines of fifteen pesos
(Php 15.00)

Objectives:

a. To impart proper discipline to the students; and


b. To maintain and ensure the mental and physical fitness of every
criminology students.
