NOTICE OF DELAY DUE TO FAILURE TO PROVIDE RIGHT OF ACCESS TO THE SITE.

Dear Sir,

Further to Clause 2.2 of the Conditions of Contract we hereby issue the Engineer with due notice that
despite us having provided all required Contract Documents including the Performance Security, the
right of access to and possession of the site within the times stated in the Appendix to Tender continues
to be denied us.

We hereby issue notice to the Engineer that we will no longer be able to comply with the project
programme as a result of this failure to provide access and possession of the Site and until such time as
the access is provided, time is considered to be at large. Once we are allowed access to and
possession of the Site, we shall review the programme and re-issue for agreement with the Engineer. All
time and cost implications will be fully detailed at that time.

The Engineer’s urgent attention is requested.
