BAC RESOLUTION NO. 01 S, 2023

DECLARATION OF FAILURE OF BIDDING FOR THE CONSTRUCTION OF

COVERED PATHWAY AT BARANGAY MATANGAD, GITAGUM, MISAMIS
ORIENTAL

WHEREAS, The Local Government of Gitagum, through the Bids and Awards Committee
(BAC), published its Request for Quotation (RFQ) for the Construction of Covered Pathway
with an Approved Budget for the Contract (ABC) in the amount of Sixty Five Thousand One
Hundred Thirteen Pesos and Fifty Centavos Only (P65,113.50) was posted at the Philippine
Government Electronic Procurement System (PhilGEPS) website and at least three
conspicuous places in Gitagum from December 8, 2022, to December 16, 2022, with
reference no. 9327643;

WHEREAS, the RFQ indicates that the deadline for submission of bid documents for the
subject procurement is on December 16, 2022, at 5:00 PM;

WHEREAS, as of February 10, 2023, no prospective suppliers responded to the Request for
Quotation (RFQ);

WHEREAS, Section 35.1.a) of 2016 Revised Implementing Rules and Regulation of

Republic Act 9184 provides that:

“The BAC shall declare the bidding a failure when:

a. No bid are received

c. All bids fails to comply with all the bid requirements or fail post-qualifications,

NOW, THEREFORE, WE, the Bids and Award Committee, resolves

1. To declare a failure of bidding on the posting of Request for Quotation (RFQ) for the
Construction of Covered Pathway with an Approved Budget for the Contract (ABC)
in the amount of Sixty-Five Thousand One Hundred Thirteen Pesos and Fifty
Centavos Only (P65,113.50)
2. To recommend to the Head of Procuring Entity (HoPE), the 1 st Failure of Bidding and
to repost the same Request for Quotation (RFQ) as per Section 35 of RA 9184;
