RE: SURVEY STATUS REPORT FOR YOUR KIBANJA AT


NALUKOLONGO

Please refer to your application for the lease after which a fresh survey of
your Kibanja was executed and markstones planted as per your guidance for
the processing of deed plans. The survey was carried out successfully and
the following were observed;
 The kibanja measures approximately 0.108ha (0.27acres) and is
developed with buildings which measure approximately
0.052Ha/0.13Acres with adequate access along Nalukolongo road.
 However, overlaying the survey observations on the Cadastral map
revealed an overlap with three already surveyed plots, that is 1A,
2B and 975 Nalukolongo Road as shown on the attached diagrams.
Plot 2B is registered to Lui Xiang Yang whose pass port number is
EC9290379 of P.O.Box 31115 Kampala. He also has a
representative, Mr. Martine who can be contacted on 0759401570.
 The other two plots, however, are not in our records.
Based on the above findings, it is advisable that the three plots are physically
inspected to verify the existence of these overlaps.

For Plots 1A and 975, you are advised to carry out an official search in
Kampala City Council Authority Ministry Zonal Office to determine their
registered proprietors and revert to us in writing.

In the interim period however, the following remedies can be considered;

1. The portions of your Kibanja overlapping the surveyed plots can


be cut off to eliminate these overlaps. This will require a written
request to us to trim off the portions of your Kibanja overlapping
these plots so that your deedplans may be processed.

2. You hold a dialogue with the proprietors of the overlapping plots


for possible solutions which may include the following;
i. They may agree to give up these surveyed interests in
your premises if they have no claim over the affected
portions,
ii. Or they may sell those interests to you. In both cases, a
resurvey of these plots shall be necessitated. This will
require;
a. their written consents to us to resurvey their plots,
b. a photocopy of the certificate of the title to their plots
or a set of original deed plans for these plots in case
titles were not issued,
c. And payment of resurvey fees of 1,700,000/= to
Buganda Land Board for each plot.

3. If there is no conflict between the plots, a resurvey of these


neighbouring plots is recommended. This may imply that the plots
were erroneously surveyed.
Conclusively, the process for acquisition of the deed plans to your Kibanja
awaits your response in relation to the above recommendations.
