RE: BOUNDARY OPENING SURVEY REPORT FOR PLOT 1797 BLOCK 12

1.0 INTRODUCTION

We refer to your verbal request for a boundary opening exercise of the subject
plot and the survey of Doreen’s interest thereon according to the plan in relation
to the existing developments. The purpose of the boundary opening was to
establish the position, size, and location of Plot 1797 Block 12 KIBUGA.
The results are laid out in this report. The field work was done on 29/9/2022 and
completed on the same.

2.0 DATA AND CONTROL

Plot 1797 is leasehold in tenure and the UTM coordinates for its plot beacons are
obtained from the Survey and Mappings department in Entebbe. A current print
from the Wakiso Ministry Zonal office was also obtained and reconstructed in
AutoCAD software to produce the necessary data for the plot. This data was later
used to re-establish the corner beacons and boundary lines. The plot as
physically used by you on the ground was also captured with the developments
as well. The GPS receivers: Base and Rover were set up in Real-time Kinematic
mode, with the Base set up at a known Geodetic survey trigonometric point
71Y110 (452981.699m E, 23368.849m N, 1228.069) whose UTM coordinates
were known, a survey equipment (CHC X91+ in RTK mode) was used to
extended control to site from which the survey was based.

3.0 METHODOLOGY

The Base and Rover were set up in Real-time Kinematic mode, the Base setup
was stationed on 71Y110. Control was therefore extended to the site which was
the basis for the boundary opening exercise. Based on the UTM coordinates of
the plot, we re-established the positions of the plot beacons and the plot
boundary lines by setting out the UTM coordinates of the individual corner
beacons. The positions of the beacons for the Plot named 1 through 10 were
determined. The portions occupied by Doreen as well as her neighbours,
Arinaitwe and Nicholas as well as Blackie and Phionah were also captured.

4.0 RESULTS AND OBSERVATIONS

The survey was carried out successfully and the following were noticed;
 2 old mark stones were discovered labelled OLD CM 1 and OLD CM2 on
the attached diagram.
 All the plot beacons were successfully set out.
 The position of plot was established on ground with an area of
2.96Ha/7.31Acres versus the 3.54Ha/8.74Acres reflected on the cadastral
print.
 The land physically used by Arinaitwe and Nicholas was found to measure
approximately 0.83Acres.
 That used by Doreen was found to measure approximately 0.65 Acres.
There is also a portion which was said to have been deducted from her by
the vendor due to failure to meet certain financial obligations on her end.
This was found to measure 0.11acres with a temporary iron sheet house
and hardcore stones laid through it by an unknown fourth party.
 That used by Blackie/Phionah was found to measure approximately
1.67Acres.
 That area which was shown to us as being the original plot boundary of
Plot 779 Block 12 from which Plot 1797 was subdivided was found to
measure 4.04Ha/10Acres approximately.

5.0 CONCLUSION AND RECOMMENDATION


From the above observations, even though the plot is in the correct location, and
the shape is similar, the size of the land differs significantly from that depicted
on the cadastral print. This means that you are occupying less land than what is
in the certificate of title.

The areas occupied by the three parties on ground also differ from those in the
plan which had stipulated that two of the parties receive 80 decimals each and
Blackie/Phionah gets 1.60Acres. Instead, Doreen has 65 decimals and the 11
decimals retained by the vendor is being used by another forth party who
erected an iron sheet building as well as hard core foundation in it. Arinaitwe and
Nicholas are using 83 decimals versus their 80 decimals on the plan and
Blackie/Phionah is using 1.67 Acres versus the 1.60 Acres.
