1 INTRODUCTION
Ballast water is essential to control trim, list, draught, stability, or stresses of the vessel. However, ballast
water may contain aquatic organisms or pathogens which, if introduced into the sea including estuaries,
or into freshwater courses, may create hazards to the environment, human health, property, or
resources, impair biological diversity or interfere with other legitimate uses of such areas. This plan is
written in accordance with the requirements of Regulation B-1 of the International Convention for the
Control and Management of Vessels' Ballast Water and Sediments, 2004 (the Convention) and the
associated Guidelines.
The purpose of the plan is to meet the requirements for the control and management of vessel’s ballast
water and sediments in accordance with the Guidelines for Ballast Water Management and the
Development of Ballast Water Management Plans (G4) resolution MEPC.127 (53). It provides standard
operational guidance for the planning and management of vessel’s ballast water and sediments and
describes safe procedures to be followed.
The selection of appropriate methods of Ballast Water Management should consider the need to ensure
that Ballast Water Management practices used to comply with the Convention do not cause greater harm
to the environment, human health, property or resources of any States and the safety of vessels, than
they prevent.
The system should only be operated in accordance with the system design criteria and manufacturer’s
operational and maintenance instructions. When the system encounters malfunctions or failure, these
are to be recorded in the ballast water record book.

1.2 PURPOSE
The ballast water management plan aims to assist governments, appropriate authorities, vessel Masters,
operators, owners, port authorities as well as other interested parties, in preventing, minimising and
ultimately eliminating the risk of introducing harmful aquatic organisms and pathogens from vessel’s
ballast water and associated sediments while protecting vessel’s safety. Good record keeping is critical to
the success of a sound ballast water management program.
The appointed ballast water management officer is responsible for ensuring the maintenance of
appropriate records and that the ballast water management and treatment procedures are followed and
recorded. It is the owners/managers or master’s responsibility to regularly review the plan and ensure
that the information contained therein is accurate and updated.

3 BALLAST WATER MANAGEMENT OPERATION

3.1 GENERAL
Ballast Water Management System (BWMS) means any system which processes ballast water such that
it meets or exceeds the ballast water performance standard in regulation D-2. The BWMS includes ballast
water treatment equipment, all associated control equipment, monitoring equipment and sampling
facilities.
BWMS means equipment which mechanically, physically, chemically, or biologically processes, either
singularly or in combination, to remove, render harmless, or avoid the uptake or discharge of harmful
aquatic organisms and pathogens within ballast water and sediments. Ballast water treatment equipment
may operate at the uptake or discharge of ballast water, during the voyage, or at a combination of these
events.
It must be ensured that the ballast water treatment system installed is approved in accordance with
Regulation D-3 of the Convention. “All systems (type) approved by (or on behalf of) the relevant
administration and physically inspected by Class surveyor on behalf of the administration after installation
should fulfil this requirement.”
The system should only be operated in accordance with the system design criteria and manufacturer's
operational and maintenance instructions. When the system encounters malfunctions or failure, these
are to be recorded in the ballast water record book.

3.3 OPERATION OF THE TREATMENT EQUIPMENT

3.3.1 DIRECTIVES & STANDARDS


The Pure Ballast System is designed, tested, and found to comply with:
1) IMO Resolution MEPC.300(72) - 2018 Guidelines for Approval of Ballast Water Management Systems
(G8).
2) The United States Coast Guard Standards for Living Organisms in Ships’ Ballast Water Discharged in
U.S. Waters (§162.060).
3.4 DESCRIPTION
Pure Ballast Treatment System adopts dual mechanisms of Filtering and UV disinfection to process the
organisms in water. UV reactor is the key part of the system. Its technology is environment-friendly, non-
toxic, and harmless. The system directs UV rays at the incoming fluid to deactivate the growth of micro-
organisms.
The system is characterized with simple running and easy maintenance, and it has realized local and
remote automatic control, with a friendly man-machine interface, easy to operate. It is flexible and easy
for installation on small-tonnage ships while on large-tonnage ships multi units could be installed in
parallel, occupying small space.
Selected BWTS system (Pure Ballast 3.2 500 Std) maximum capacity is 500 m3/hr. Therefore No.1 & No.2
Fire, Ballast Pump can be simultaneously operated only at flow rate of 400 m3/hr.

3.6 BALLASTING DESCRIPTION


Before Ballasting operation, UV Lamps are warmed up for 90 seconds. Cooling water is pumped through
the UV Reactor to secure that the UV Lamps are not overheated. When lamps are ready, ballast pumps
are started. During ballasting the ballast water will first be filtered through a 20-micron filter mesh. This
filter removes larger particles including most of the zooplankton. This also reduces the amount of
sediment build-up in the ballast water tanks. The organisms and sediments caught in the filter are flushed
overboard via regular filter backflush operations. After the filtration process, the water is finally led to
the UV reactor, which produces radicals and UV light that breaks down and neutralize the organisms.

3.7 DE-BALLASTING DESCRIPTION


During de ballasting, the filter is bypassed, and the ballast water is once again run through the UV reactor.
The reason for treating the water a second time during de ballasting is to secure that the treatment is
fully effective. The minor part of the organisms, which were only injured during ballast, will be rendered
totally harmless during the de ballast.

4 PRECAUTIONARY PRACTICES

4.1 MINIMIZING TRANSFER OF HARMFUL AQUATIC ORGANISMS


Wherever possible, ballast water should be taken outside of port waters and as far from the coast as
practicable. Consideration should also be given to the use of dockside water supplies (water not taken
directly from the harbour, such as fresh water, potable water etc.) as source for ballast water.
When loading ballast water, every effort should be made to avoid the uptake of potentially harmful
aquatic organisms, pathogens and sediments that may contain such organisms. The uptake of ballast
water should be minimized or, where practicable, avoided in areas and situations such as:
1. Areas identified by the port state in connection with warnings provided by ports concerning ballast
uptake and any other port contingency arrangements in the event of emergency situations.
2. In darkness when organisms may rise in the water column.
3. In very shallow water.
4. Where propellers may stir up sediment.
5. Areas with current large phytoplankton blooms (algal blooms such as red tides).
6. Nearby sewage outfalls.
7. Where a tidal stream is known to be more turbid.
8. Where tidal flushing is known to be poor.
9. in areas close to aquaculture.
10. Where dredging is or recently has been carried out.
If it is necessary to take on and discharge ballast water in the same location, care should be taken to avoid
unnecessary discharge of ballast water that has been taken up in another location.

4.2 NON-RELEASE/MINIMAL RELEASE OF BALLAST WATER


The requirements for ballast water management differs from one port state to another. Some have no
requirements; some require reporting of ballast water practise and record book, and others require
ballast water exchange before arrival in their waters. In case the ballast water exchange is requested by
the port states, this will be applicable to ballast tanks planned to be discharged in their waters. For some
loading conditions, not all tanks need to be discharged, hence these will not have to be exchanged prior
to arrival.

4.3 DISCHARGE TO RECEPTION FACILITIES


If the reception facilities for ballast water and/or sediments are provided by a port state, they should,
where appropriate, be utilised.

5 SEDIMENT MANAGEMENT
Water taken up as vessels’ ballast can contain solid alluvial matter that, once the water is becalmed in a
vessel’s ballast tank, will settle out onto the bottom of the tank and other internal structures. Aquatic
organisms can also settle out of the ballast water and can continue to exist within the sediment. These
organisms can survive for long periods after the water they were originally in has been discharged. They
may thereby be transported from their natural habitat and discharged in another port or area where they
may cause injury or damage to the environment, human health, property, and resources.

5.1 GENERAL REQUIREMENTS


All practical steps should be taken during ballast uptake to avoid sediment accumulation, it is however
recognised that sediment will be taken onboard and settle on tank surfaces. The volume of the sediment
should be monitored on a regular basis. Sediment in ballast tanks should be removed in a timely basis
and as found necessary. The frequency and timing of removal will depend on factors such as sediment
build up, vessel’s trading pattern, availability of reception facilities, workload of the vessel’s personnel
and safety considerations.

5.2 DISPOSAL OF SEDIMENTS TO SHORE


Removal of sediment from ballast tanks should preferably be undertaken under controlled conditions in
port, at a repair facility or in dry dock. The removed sediment should preferably be disposed of in a
sediment reception facility if available, reasonable, and practicable. One should be aware that sediments
lying undisturbed for some time may give off toxic gases and appropriate measures must be taken to
protect the crew carrying out the job.

5.3 DISPOSAL OF SEDIMENTS AT SEA


When sediment is removed from the vessel’s ballast tanks and is to be disposed of by that vessel at sea,
such disposal should only take place in areas outside 200nm from land and in water depths of over 200m.
Part of the mud may be removed by water movement within a tank to bring sediments to suspension. In
double bottom tanks this is achieved by filling clean water 0.5-1meter sounding in mild weather
conditions and keeping it for about 6 hours before pumping it out.
In addition, the Master may decide to store the sediments onboard the vessel when this will not hamper
the security and operational maintenance of the vessel, her cargo, and the crew. The sediments must
then be disposed of as described in 5.2 and above in this paragraph.
Special care is to be taken if ballast water has been carried in spaces designated for other purposes, such
as fuel, oil, freshwater tanks etc. Disposal of the sediments then depends upon the final mixture, e.g., if
ballast water is carried in the fuel tanks, more stringent requirements than described above are to be
considered.

6 BALLAST WATER SAMPLING


Sampling of ballast water is primarily a matter for the authorised inspection officers during port state
control. For crew members there is unlikely any need to take samples except at the express request and
under the supervision of authorised inspection officers.

6.1 GENERAL
The table below indicates sampling and access points in pipelines and tanks, to enable crew members to
quickly assist the authorised officers of a party that have reasons to obtain samples.

6.2 SAMPLING FOR COMPLIANCE WITH THE PERFORMANCE STANDARD


Compliance with ballast water performance standard (D-2) should be assessed at ballast water discharge,
as near to the point of discharge as practicable, during ballast water discharge whenever this is possible.
In-tank sampling to provide an indication of compliance with standard D-2 should only be used if ballast
water treatment process occurs on uptake, prior to or whilst ballast water is in the tank. If any part of the
treatment or neutralisation process is applied during the ballast water discharge, then in-tank sampling

7 METHODS OF COMMUNICATION
This section contains procedures to assist the Master in coordinating the discharge of ballast in waters of
a coastal state, local government, or other involved parties. The quick and effective communication
between the vessel and coastal state or other involved party becomes vital in mitigating the effects of an
unnecessary delay.
The requirements and roles of the various national and local authorities involved vary widely between
states and even from port to port. Approaches to the responsibility for ballast water exchange also vary.
In most coastal states, responsibility for compliance with port state requirements is placed on the vessel
owner and the vessel. The port state authorities should be contacted for specific ballast water discharge
requirements and reporting, prior to the vessel's arrival in port state's territorial waters.
Therefore, the Master with the responsible officer should timely obtain all necessary information and
prepare the vessel, accordingly, taking into consideration the safety and operational restrictions as
described in this plan and relevant sections. Information on specific port state procedures can be obtained
by consulting the company and local agent for latest information and requirements.

8 CONTINGENCY MEASURES
The goal of this guidance is to support ships and port states to apply sound and practical measures in the
case of a ship unable to manage ballast water in accordance with its approved Ballast Water Management
plan to meet the D-1 or D-2 standard, with a view to ensuring the protection of the marine environment
and ship, safety and minimizing any impacts on the continuity of port and ship operations. Ballast water
exchange is carried out as described in the approved ballast water management plan for D-1.
Implementation of Contingency measures:

In the case of non-compliant ballast water, communication between the ship and the port state should
occur. The ship and the port State should consider the following as possible contingency measures:

1. Actions predetermined in the Ballast Water Management plan of the ship.


2. Discharging ballast water to another ship or to an appropriate shipboard or land-based reception
facility, if available.
3. Managing the ballast water or a portion of it in accordance with a method acceptable to the port
State.
4. Ballast water exchange carried out to an approved plan in accordance with regulation B-4 to meet
the standard in regulation D-1. The ship and the port State should consider the potential disruption
to the cargo handling operation plan of the ship and the potential impact to relating parties including
port operators and cargo owners.
5. Operational actions, such as modifying sailing or ballast water discharge schedules, internal transfer
of ballast water or the retention of ballast water on board the ship.
Having considered all the options in paragraph above, the ballast water may be discharged in the port or
any suitable area, as acceptable to the port State. Port State consideration may include environmental,
safety, operational and logistical implications of allowing or disallowing the discharge. The discharge of
ballast water is subject to any conditions of the port State. The port State should report information on
the use of contingency measures in accordance with the experience-building phase (EBP) associated with
the BWM Convention (resolution MEPC.290(71)).
In any case, the ship is required to do its best to correct malfunction of the Ballast Water Management
system as soon as possible and submit its repair plan to the port State control authorities and the flag
State.
The port State, the flag State and the ship should work together to agree on the most appropriate solution
to allow for the discharge of ballast water found to be non-compliant.

PART 1: Reporting – In case of BWMS failure.


1. The responsible officer should report to the Company using the BWMS failure reporting form.
2. The company should report the BWMS failure to the Flag Administration, the BWMS manufacturer
and, if the failure is significant, the Class Society.
3. Based on feedback from the Flag Administration and the BWMS manufacturer, the company should
agree on a BWMS Repair Plan which would include all relevant supporting information, including
historical failure and a schedule with a specific timeline for the repair to be completed (see Part 3
for guidance on the BWMS Repair Plan).
4. The company should submit a Ballast Water Contingency Measure Request Form to the Port State
authority where the ballast water is intended to be discharged. The Ballast Water Contingency
Measure Request Form should include a copy of the BWMS Failure Reporting Form, the BWMS
Repair Plan and any other relevant documentation regarding the incident (see Annex I: Ballast Water
Contingency Measure Request Form).
5. Based on the previous points, the company will confirm to the ship which Contingency Measure is
to be undertaken and provide any additional guidance or instructions necessary to fulfil the
requirements of the Port State authority, Flag Administration or Class Society, as necessary.

PART 2: Contingency Measures


Following contingency measures are to be taken in the event a BWMS fails. Each contingency measure is
given a distinct numbering that will be used in a BWMS repair plan and BWMS failure report as well as
the Ballast Water Contingency Measure Request Form.

ECM.1 Repair BWMS at the ballast loading port


This option should be considered if a minor defect of the BWMS is identified and can either be resolved
by the crew or with shore support at the ballast loading port. Service centres for the BWMS used within
a company’s fleet should be known in advance so that emergency contact may be made with the
manufacturer’s agents in each port as required.
If the BWMS treats on uptake, then this measure may require a ballast water exchange through the
BWMS enroute, as per ECM.3.2, to the ballast discharge location to ensure all ballast is treated or to
discharge and load ballast at the terminal to ensure all ballast on board has been successfully treated by
the BWMS.

ECM.2 Repair the BWMS en route


If insufficient time is available at the ballast loading port to fully complete a repair, consideration should
be given to undertaking the repair while en route. The ballast water on board will then have to be treated
by the BWMS to ensure all ballast on board is compliant. This may require the vessel to undertake a
ballast water exchange through the BWMS as per ECM.3.2.

ECM.3 Ballast water exchange (BWE) options


It is important to note that compliance with Regulation D-1 may not be required to be recorded on the
ship’s International Ballast Water Management Certificate (together with Regulation D-2 compliance)
when the relevant ballast water exchange procedure has been included as a contingency measure in the
approved BWMP.

ECM.3.1 Mid- Ocean ballast water exchange – without BWMS


In the event the BWMS cannot be repaired at the ballast loading port or en route, and with an
inoperable BWMS, the BWE should be conducted in accordance with the BWM Convention Regulations
B-4 and D-1 as follows:
Regulation B-4 – Ballast Water Exchange
A ship conducting Ballast Water exchange to meet the standard in regulation D-1 shall:
1. Whenever possible, conduct such Ballast Water exchange at least 200 nautical miles from the
nearest land and in water at least 200 metres in depth, considering the Guidelines developed by the
Organization.
2. In cases where the ship is unable to conduct Ballast Water exchange in accordance with paragraph
1.1, such Ballast Water exchange shall be conducted considering the Guidelines described in
paragraph 1.1 and as far from the nearest land as possible, and in all cases at least 50 nautical miles
from the nearest land and in water at least 200 metres in depth.
Regulation D-1 – Ballast Water Exchange Standard
1. Ships performing Ballast Water exchange in accordance with this regulation shall do so with an
efficiency of at least 95 percent volumetric exchange of Ballast Water.
2. For ships exchanging Ballast Water by the pumping-through method, pumping through three times
the volume of each Ballast Water tank shall be considered to meet the standard described in
paragraph 1. Pumping through less than three times the volume may be accepted provided the ship
can demonstrate that at least 95 percent volumetric exchange is met.
When undertaking BWE the procedure should follow that specified in the relevant section of the ship’s
BWMP and be specific to the vessel. The USCG BWE standard in 151.2025, ‘Ballast water management
requirements’:
Perform complete ballast water exchange in an area 200 nautical miles from any shore prior to
discharging ballast water. Policy Letter 18-02 states clearly that for BWE to be acceptable to the COTP
then the exchange must occur in area 200 miles from any shore.

ECM.3.2 Mid- Ocean ballast water exchange – through the BWMS


If the BWMS has been repaired but there remains untreated (non-compliant) ballast water on board, the
untreated ballast water may be treated en route by undertaking a ballast water exchange through the
BWMS. As the ballast water being discharged may contain invasive species from the ballast loading port
(depending on the BWMS design) then it is recommended to follow the procedures details in ECM.3.1 in
regards the Regulation B-4 and D-1 Convention requirements as well as §151.2025, as necessary. In most

cases when a BWMS is used in conjunction with BWE, then the sequential method of BWE will have to be
utilised.
This contingency measure may also be considered when a BWMS has been by-passed during uptake due
to challenging water quality in the ballasting port.

ECM.4 Ballast water exchange in a designated ballast water exchange area


Some States have designated BWE areas that should be used as instructed by the Port State authority
upon communication of the BWMS failure.

ECM.5 Shore-based mobile treatment systems at the ballast discharge port


Several entrepreneurs are developing mobile shore-based treatment options to act as contingency
measures or more permanent options for vessels without BWMS installed. These options are broadly
grouped into three categories:
ECM5.1 Using specifically designed ballast water treatment boat or barge that would either provide the
vessel with treated ballast water and/or receive untreated ballast water for treatment. This option is
closely aligned to the US requirements, §151.2025(a)(5).
ECM5.2 A mobile treatment facility transported on a barge or truck at the ballast discharge port to
receive untreated ballast water from the ship.
ECM5.3 A small mobile ballast water treatment equipment that can be deployed on a ship by a small
riding crew to inject and then mix an active substance into the ballast tanks prior to discharge. A small
time would need to be allocated to allow the active substances to work and then a neutralising agent
would need to be added prior to discharge.
Communication with the Port State will be necessary to determine if this option exists and the necessary
connections and piping required to be able to utilise these options.

ECM.6 Discharge to a port reception facility at the ballast discharge port


This is one of the options specifically mentioned in the USCG requirements, §151.2025(a)(5). However,
except for Flotta Oil Terminal, Scapa Flow, very few ports have the capability to receive and then treat
ballast water. Some ports are in the process of implementing a system for receiving and treating ballast
water using the methods described in ECM.5 above.

ECM.7 Retain ballast water on board


Not discharging ballast water into Port State waters is one of the options specifically mentioned in the
USCG requirements, §151.2025(a)(4) and may also be an option in other countries and ports.

ECM.8 Use water from a public water supply (PWS)


This is one of the options specifically mentioned in the USCG requirements, §151.2025(a)(2).
The sub-section states that:
Vessels using water from a PWS as ballast must maintain a record of which PWS they received the water
from as well as a receipt, invoice, or other documentation from the PWS indicating that water came from
that system. Furthermore, they must certify that they have met the conditions in paragraphs (a)(2)(i) or
(ii) of this section, as applicable, and describe in the BWM plan the procedures to be used to ensure
compliance with those conditions, and thereafter document such compliance in the BW record book.
Vessels using water from a PWS must use such water exclusively unless the usage is in accordance with
§ 151.2040 of this subpart. Vessel’s using PWS water as ballast must have either:
(i) Previously cleaned the ballast tanks (including removing all residual sediments) and not subsequently
introduced ambient water; or
(ii) Never introduced ambient water to those tanks and supply lines.
It should be noted that only water from a US or Canadian PWS would be acceptable to the USCG. The
receipt of delivery of the PWS should be kept on board and provided to the COTP as necessary.
ECM.9 Partial ballast water discharge at 12nm from nearest land (US only)
Specific to the US, experience to date suggests that some COTPs are allowing tankers to partially discharge
greater than 12nm from nearest land and then undertake a partial loading operation in the US port.

PART 3: BWMS Repair Plan


The BWMS Repair Plan should be prepared by the BWMS manufacturer in consultation with the company.
The BWMS Repair Plan should provide a schedule with a specific timeline from the BWMS manufacturer
as to when the BWMS will be repaired. The schedule for repairs is important as it will allow the owner
and the Port State to determine whether this is short term fix or a longer-term issue that may impact
future port calls.
As a minimum, the BWMS Repair Plan should provide details of
 The BWMS, its repairs and all previous maintenance and failure history
 The length of time the system has been inoperable
 The suspected cause of failure
 Repairs that have already been completed
 Details relating to the attempts to repair the BWMS
 The schedule for the proposed repair (corrective action)
 Communications between the company and the manufacturer
 Other relevant operational data.

10 DUTIES OF BALLAST WATER MANAGEMENT OFFICER


The ballast water management officer is responsible for implementing the procedures of the ballast water
management plan. Duties of the ballast water management officer:
1. Ensure the safety of the vessel and crew.

4. Ensure adequate personnel and equipment are available for the execution of the planned ballast
water management operations.
5. Ensure all required ballast water management records are maintained and up to date,

Should there be any doubt or if the management plan is not in line with the schedule, the Master shall be
advised accordingly.

11 CREW TRAINING & FAMILIARIZATION


It is essential that the Master, vessel's officer, and crew understand the need for ballast water
management. If crew members understand the reasons for the treatment or exchange of ballast water
and associated sediments, they are more likely to ensure that it is carried out effectively and efficiently.
Owners, managers, operators, and others involved in officer and crew training for ballast water
management should consider that, the Training for vessels' master’s and crews as appropriate should
include instructions on the requirements of the Convention, the ballast water and sediment management
procedures and the ballast water record book, drawing particular attention to matters of vessel safety,
maintenance of records and reporting requirements in accordance with the Convention.
Vessels' officers and crew must be aware of what is expected of them and should be familiarised and
trained in the following:
1. Vessel’s pumping arrangements including ballast arrangements.
2. Location of air and sounding pipes of all ballast tanks.
3. Positions of all ballast tank suctions and pipelines.
4. Overboard discharge arrangements and openings for release of water on deck.
5. Inspection and maintenance for ensuring that sounding pipes are clear and that air pipes and
non-return devices are in good order.
6. Times and circumstances required to undertake the various ballast water exchange operations.
7. Methods used for ballast water exchange at sea, the related safety precautions and associated
hazards and Location and suitable access points for sampling purposes.

The Master and ballast water management officer should ensure that the personnel assigned key
responsibilities in any ballast management procedures are suitable and well trained according to the
above. Special attention should be given to the safety aspects related with the subject procedures.
Provisions for crew training and familiarisation include the following:
1. General requirements for ballast water management.
2. Training and information on ballast water management practices.
3. Ballast water treatment systems installed onboard.
4. Ballast water exchange methods.
5. General safety considerations.
6. The ballast water record book and maintenance of records.
7. Safety aspects associated with the systems and procedures used onboard the vessel which affect the
safety or human health of crew and passengers and/or the safety of the vessel.
8. Precautions for entering tanks for sediment removal.
9. Procedures for the safe handling and packaging of sediment; and
10. Storage of sediment

12 RECORDING REQUIREMENTS
Below are the data record and documentation requirements of the BWMS:
1. The ballast water management officer is to ensure that the Ballast Water Record Book and any other
necessary documentation and forms are kept up to date.
2. The Ballast Water Record Book may be an electronic record system or may be integrated into
another record book or system.
3. The Ballast Water Record Book entries shall be maintained on board the vessel for a minimum period
of two years after the last entry has been made. Thereafter the record book should be maintained
in the company’s control for a minimum period of three years.
4. In the event of discharging of ballast water pursuant to regulations A-3, A-4, or B-3 or in the event of
accidental or exceptional discharge of ballast water not otherwise exempted by the Convention, an
entry shall be made in the Ballast Water Record Book describing the circumstances, and the reason
for the discharge.
5. Each operation concerning ballast water shall be fully recorded without delay in the Ballast Water
Record Book.
6. When the systems encounter failure and/or malfunctions, these are to be recorded in the Ballast
Water Record Book.
7. The control equipment of the ballast water treatment system can store data for at least 24 months.
The requirements for type approval and the control equipment should be able to display or print a
record for official inspections as required.
In the event the control equipment is replaced, means should be provided to ensure the data recorded
prior to replacement remains available on board for 24 months.

13 DESCRIPTIONAL OF THE METHODS USED ON BOARD FOR BALLAST WATER


MANAGEMENT AND SEDIMENT CONTROL

13.1 Procedures for ballast water exchange


When exchanging ballast at sea, safety and operational information and restrictions must be always
considered.

13.2 Procedures for ballast water treatment systems

13.2.1 BALLASTING DESCRIPTION


During ballasting, the ballast water is pumped from the sea chest to the filter, that removes larger
particles and organisms. This also reduces the amount of sediment build-up in the ballast water tanks.
The organisms and sediments caught in the filter are flushed overboard via regular filter backflush
operations. The water is finally led to the UV reactor, which produces radicals and UV light that breaks
down and neutralize the organisms.

13.2.2 DE-BALLASTING DESCRIPTION


During de-ballasting process, the water from ballast pump is passed through the UV reactor, but the filter
is bypassed since the water has already been filtered during ballasting. The reason for treating the water
a second time during DE ballasting is to secure that the treatment is fully effective. The minor part of the
organisms, which were only injured during ballast, will be rendered totally harmless during the DE ballast.

13.2.3 TANK STRIPPING


Stripping can be performed to empty the ballast tanks. A stripping process is like a DE ballast process; in
both processes the filter is bypassed
When the lamps are ready, the operator is requested to start a stripping pump. Pump used can either be
a dedicated stripping pump or a ballast water pump. Power optimization is not active. Minimum flow
includes the driving water.

INTRODUCTION
In accordance with regulation B-2 of the Annex to the International Convention for the Control and
Management of Ships’ Ballast Water and Sediments, a record is to be kept of each ballast water operation.
This includes discharges at sea and to reception facilities.
BALLAST WATER AND BALLAST WATER MANAGEMENT
“Ballast water” means water with its suspended matter taken on board a ship to control trim, list, draught,
stability, or stresses of a ship. Management of ballast water shall be in accordance with an approved Ballast
Water Management Plan and consider Guidelines developed by the IMO.
Entries in the Ballast Water Record Book
Entries in the Ballast Water Record Book shall be made on each of the following occasions:
1) When Ballast Water is taken on board:
 Date, time and location port or facility of uptake (port or lat/long), depth if outside port
 Estimated volume of uptake in cubic metres
 Signature of the officer in charge of the operation.
2) Whenever Ballast Water is circulated or treated for Ballast Water Management
purposes:
 Date and time of operation
 Estimated volume circulated or treated (in cubic metres)
 Wi-tether conducted in accordance with the ballast water management plan
 Signature of the officer in charge of the operation.
3) When ballast water is discharged into the sea:
 Date, time and location port or facility of discharge (port or lat/long)
 Estimated volume discharged in cubic metres plus remaining volume in cubic metres
 Whether approved ballast water management plan had been implemented prior to discharge.
 Signature of the officer in charge of the operation.
4) When ballast water is discharged to a reception facility:
 Date, time, and location of uptake
 Date, time, and location of discharge

THE MARINE ENVIRONMENT PROTECTION COMMITTEE,

RECALLING Article 38(a) of the Convention on the International Maritime Organization


concerning the functions of the Marine Environment Protection Committee conferred upon it by
the international conventions for the prevention and control of marine pollution,

RECALLING ALSO that the International Conference on Ballast Water Management for
Ships held in February 2004 adopted the International Convention for the Control and
Management of Ships’ Ballast Water and Sediments, 2004 (the Ballast Water Management
Convention) together with four Conference resolutions,

NOTING that Regulation A-2 of the Ballast Water Management Convention requires that
discharge of ballast water shall only be conducted through Ballast Water Management in
accordance with the provisions of the Annex to the Convention,

NOTING FURTHER that Regulation B-1 of the Annex to the Ballast Water Management
Convention provides that each ship shall have on board and implement a ballast water
management plan approved by the Administration, taking into account Guidelines developed by
the Organization,

NOTING ALSO that resolution 1 adopted by the International Conference on Ballast


Water Management for Ships invites the Organization to develop these Guidelines as a matter of
urgency,

HAVING CONSIDERED the draft Guidelines for ballast water management and
development of ballast water management plans developed by the Ballast Water Working Group
and the recommendation made by the Sub-Committee on Bulk Liquids and Gases at its
ninth session,

1. ADOPTS the Guidelines for ballast water management and development of ballast water
management plans, as set out in the Annex to this resolution;

2. INVITES Governments to apply the Guidelines as soon as possible, or when the


Convention becomes applicable to them; and

3. AGREES to keep the Guidelines under review.

THE DEVELOPMENT OF BALLAST WATER MANAGEMENT PLANS (G4)

1 INTRODUCTION

1.1 Ballast water is essential to control trim, list, draught, stability, or stresses of the ship.
However, ballast water may contain aquatic organisms or pathogens which, if introduced into the
sea including estuaries, or into fresh water courses, may create hazards to the environment,
human health, property or resources, impair biological diversity or interfere with other legitimate
uses of such areas.

1.2 The selection of appropriate methods of ballast water management should take into
account the need ensure that Ballast Water Management practices used to comply with this
Convention do not cause greater harm than they prevent to the environment, human health,
property or resources of any States and the safety of ships.

1.3 The objectives of these Guidelines are to assist Governments, appropriate authorities,
ships masters, operators and owners, and port authorities, as well as other interested parties, in
preventing, minimizing and ultimately eliminating the risk of introducing harmful aquatic
organisms and pathogens from ships' ballast water and associated sediments while protecting
ships’ safety in applying the International Convention for the Control and Management of Ships’
Ballast Water and Sediments (hereinafter referred to as the “Convention”).

1.4 These guidelines consist of two parts:

Part A – “Guidelines for Ballast Water Management”, which contains guidance on


the general principles of Ballast Water Management; and

Part B – “Guidelines for the development of Ballast Water Management Plans”,


which contains guidance on the structure and content of Ballast Water
Management Plans required by Regulation B-1 of the Convention.

2 DEFINITIONS

2.1 For the purposes of these Guidelines, the definitions in the Convention apply.

2.2 Ballast Water Tank means any tank, hold, or space used for the carriage of ballast water.

3 APPLICATION

3.1 The Guidelines apply to all ships and to Flag Administrations, port States, coastal States,
ship owners, ship operators, ships’ personnel involved in Ballast Water Management, ship
designers, ship builders, classification societies as well as other interested parties.

1 SHIP OPERATIONAL PROCEDURES

1.1 Precautionary practices

Avoiding unnecessary discharge of ballast water

1.1.1 If it is necessary to take on and discharge ballast water in the same port to facilitate safe
cargo operations, care should be taken to avoid unnecessary discharge of ballast water that has
been taken up in another port.

1.1.2 Managed ballast water which is mixed with unmanaged ballast water is no longer in
compliance is no longer in compliance with Regulations D-1 and D-2 of the Annex to the
Convention.

Minimizing the uptake of harmful aquatic organisms, pathogens and sediments

1.1.3 When loading ballast, every effort should be made to avoid the uptake of potentially
harmful aquatic organisms, pathogens, and sediment that may contain such organisms. The
uptake of ballast water should be minimized or, where practicable, avoided in areas and
situations such as:

.1 in areas identified by the port State in connection with advice provided by ports
under paragraph 2.2.2;

.2 in darkness when organisms may rise up in the water column;

.3 in very shallow water;

.4 where propellers may stir up sediment; or

.5 where dredging is or recently has been carried out.

1.2 Ballast water management options

1.2.1 Ballast Water Exchange

1.2.1.1 Ballast water exchange is to be conducted in accordance with Regulation B-4 of the
Convention and in accordance with the Guidelines for Ballast Water Exchange.

1.2.1.2 The voyage should be planned taking into account when ballast water exchange in
accordance with Regulation B–4 of the Convention can be carried out.

1.2.1.3 Because of the possibility that partially exchange may encourage re-growth of
organisms, ballast water exchange should only be commenced in any tank if there is sufficient
time to complete the exchange to comply with the standard in Regulation D-1 and the ship can
comply with the distance from land and minimum water depth criteria in Regulation B-4. As
many complete tanks should be exchanged to the standard in Regulation D-1 as the time allows,

if for any tank the standard in Regulation D-1 can not be fully met the exchange should not be
commenced for that tank.

1.2.1.4 If ballast water exchange is not undertaken for the reasons in Regulation B-4.4, i.e. if the
master reasonably decides that such exchange would threaten the safety or stability of the ship,
its crew, or its passengers because of adverse weather, ship design or stress, equipment failure, or
any other extraordinary condition, then details of the reasons ballast water exchange was not
undertaken are to be recorded in the Ballast Water Record Book.

1.2.1.5 A port State may designate areas in which exchange may be conducted taking into
account the Guidelines on designation of areas for ballast water exchange. Designated areas
should only be used for those ballast water tanks that are intended to be discharged in the port of
that State and that could not be exchanged in accordance with Regulation B-4.1 of the
Convention.

1.2.2 Ballast Water Management Systems

1.2.2.1 Ballast Water Management Systems installed for compliance with Regulation B-3 are to
be approved in accordance with Regulation D-3. Such systems are to be operated in accordance
with the system design criteria and the manufacture’s operational and maintenance instructions.
The use of such systems should be detailed in the ship’s Ballast Water Management Plan. All
failures and malfunctions of the system are to be recorded in the Ballast Water Record Book.

1.2.3 Discharge to ballast water reception facilities

1.2.3.1 If ballast water reception facilities provided by a port State are utilized,
Regulation B-3.6 applies.

1.2.4 Prototype ballast water treatment technologies

1.2.4.1 Prototype ballast water treatment technologies should be used within a programme
approved by the Administration in accordance with Regulation D-4.

1.3 Sediment management

1.3.1 Regulation B-5 requires that all ships shall remove and dispose of sediments from spaces
designated to carry ballast water in accordance with the ballast water management plan.

1.3.2 All practical steps should be taken during ballast uptake to avoid sediment accumulation,
however, it is recognized that sediment will be taken on board and will settle on tank surfaces.
When sediment has accumulated, consideration should be given to flushing tank bottoms and
other surfaces when in suitable areas, i.e. areas complying with the minimum depth and distance
described by Regulations B-4.1.1 and B-4.1.2.

1.3.3 The volume of sediment in a ballast tank should be monitored on a regular basis.

1.3.4 Sediment in ballast tanks should be removed in a timely basis in accordance with the
Ballast Water Management Plan and as found necessary. The frequency and timing of removal

will depend on factors such as sediment build up, ship’s trading pattern, availability of reception
facilities, work load of the ship’s personnel and safety considerations.

1.3.5 Removal of sediment from ballast tanks should preferably be undertaken under controlled
conditions in port, at a repair facility or in dry dock. The removed sediment should preferably be
disposed of in a sediment reception facility if available, reasonable and practicable.

1.3.6 When sediment is removed from the ship’s ballast tanks and is to be disposed of by that
ship at sea, such disposal should only take place in areas outside 200 nm from land and in water
depths of over 200 m.

1.3.7 Regulation B-5 requires that ships constructed in or after 2009 should, without
compromising safety or operational efficiency, be designed and constructed with a view to
minimize the uptake and undesirable entrapment of sediments, facilitate removal of sediments,
and provide safe access to allow for sediment removal and sampling, taking into account the
Guidelines for sediments control on ships (G12). This also applies to ships constructed prior
to 2009, to the extent practicable.

1.4 Additional Measures

1.4.1 Ships to which additional measures apply, under Regulation C-1, should take them into
account in the ships voyage planning. Actions taken to comply with any additional measures
should be recorded in the Ballast Water Record Book.

1.5 Exemptions

1.5.1 Regulation A-4 provides that an exemption may be granted from the requirements of
Regulations B-3 or C-1 by a Party or Parties to a ship in specific circumstances. Applications for
and the granting of such exemptions should be completed in accordance with the Guidelines for
risk assessment (G7).

1.5.2 Ships granted an exemption referred to in paragraph 1.5.1 above should record the
exemption in the Ballast Water Record Book and what actions have been taken with regards to
the ships ballast water.

2 RECORDING PROCEDURES

2.1 Procedures for ships

2.1.1 To facilitate the administration of ballast water management and treatment procedures on
board each ship, a responsible officer is to be designated in accordance with Regulation B-1 to
ensure the maintenance of appropriate records and to ensure that ballast water management
and/or treatment procedures are followed and recorded.

2.1.2 When carrying out any ballast water operation the details are to be recorded in the
Ballast Water Record Book together with any exemptions granted in accordance with
Regulation B-3 or C-1.

2.1.3 Where a port State requires information on ships ballast operations, relevant
documentation, which takes account of the information requirements of the Convention, should
be made available to the port State.

2.2 Procedures for port States

2.2.1 Port States should provide ships with details of their requirements concerning ballast
water management including:

.1 the location and terms of use of areas designated for ballast water exchange under
Regulation B-4.2 of the Convention;

.2 any additional measures determined under Regulation C-1 of the Convention;

.3 warnings concerning ballast uptake and any other port contingency arrangements
in the event of emergency situations; and

.4 the availability, location, capacities of reception facilities that are provided for the
environmentally safe disposal of ballast water and/or sediments, under Article 5
and Regulation B-3.6.

2.2.2 To assist ships in applying the precautionary practices described in section 1.1 of Part A,
port States are required by Regulation C-2 of the Convention to endeavour to notify mariners of
area(s), where ships should not uptake Ballast Water due to known conditions. Similar
notification should be given for areas where the uptake of ballast water should be minimized,
such as:

.1 areas with outbreaks, infestations or known populations of harmful organisms and


pathogens;

.2 areas with current phytoplankton blooms (algal blooms, such as red tides);

.3 nearby sewage outfalls;

.4 areas where a tidal stream is known to be the more turbid;

.5 areas where tidal flushing is known to be poor;

.6 nearby dredging operations; and

.7 nearby or in sensitive or estuarine sea areas.

3 TRAINING AND EDUCATION

3.1 Regulation B-6 requires that officers and crew shall be familiar with their duties in the
implementation of Ballast Water Management particular to the ship on which they serve.
Owners, managers, operators, and others involved in officer and crew training for ballast water
management should consider the following:

3.2 Training for ships’ masters and crews as appropriate should include instructions on the
requirements of the Convention, the ballast water and sediment management procedures and the
Ballast Water Record Book particularly having regard to matters of ship safety and maintenance
of records in accordance with the information contained in these Guidelines.

3.3 The Ballast Water Management Plan should include training and education on ballast
water management practices and the systems and procedures used on board the ship.

PART B – GUIDELINES FOR THE DEVELOPMENT OF BALLAST WATER


MANAGEMENT PLANS

1 INTRODUCTION

1.1 These Guidelines have been developed to assist with the preparation of a ship’s Ballast
Water Management Plan (hereafter referred to as the “Plan”). The Plan must be approved by the
Administration in accordance with Regulation B-1 of the Convention.

1.2 This Part is comprised of three primary sections:

.1 General: this section provides the objectives and a general overview of the
subject matter and introduces the reader to the basic concept of the Guidelines and
the Plan that is expected to be developed from them. This section also contains
guidance on updating and use of the Plan.

.2 Mandatory provisions: this section provides guidance to ensure that the


mandatory provisions of Regulation B-1 of the Annex to the Convention are met.

.3 Non-mandatory provisions: this section provides guidance concerning the


inclusion of other information in the Plan. This information, although not
required under Regulation B-1 of the Convention, may be found useful by local
authorities in ports visited by the ship, or may provide additional assistance to the
ship’s master.

1.3 The format for a Ballast Water Management Plan is given in Appendix 1.

2 GENERAL

2.1 Concept of the Guidelines

2.1.1 These Guidelines are intended to provide a basis for the preparation of the Plans for
individual ships. The broad spectrum of ships for which Plans are required makes it impractical
to provide specific guidelines for each ship type. For a Plan to be effective and to comply with
Regulation B-1 of the Annex of the Convention, it must be carefully tailored to the particular
ship for which it is intended. Properly used, the Guidelines will ensure that all appropriate issues
that may be applicable to a particular ship are considered in developing the Plan.

2.1.2 The issues that may require consideration include but are not limited to: type and size of
ship, volume of ballast carried and total capacity of tanks used for ballast, ballast pumping

capacity, ship and crew safety issues, voyage type and length, the ship’s typical operational
requirements, and ballast water management techniques used on board.

2.2 Concept of the Plan

2.2.1 The Plan is required to be onboard the ship and available to guide personnel in safe
operation of the Ballast Water Management system employed on a particular ship. Effective
planning ensures that the necessary actions are taken in a structured, logical, and safe manner.

2.2.2 For the Plan to accomplish its purpose, it must be:

.1 realistic, practical, and easy to use;

.2 understood by ship’s personnel engaged in ballast water management, both on


board and ashore;

.3 evaluated, reviewed, and updated as necessary; and

.4 consistent with the operational ballasting requirements of the ship.

2.2.3 The Plan envisioned by Regulation B-1 of the Annex to the Convention is intended to be
a simple document. Inclusion of extensive background information on the ship, its structure, etc.,
should be avoided, as this is generally available elsewhere. If such information is relevant, it
should be kept in annexes, or an existing document or manual reference should be made to the
location of the information.

2.2.4 The Plan is a document to be used on board by the ship’s personnel engaged in ballast
water management. The Plan must therefore be available in a working language of the ship’s
personnel. A change in the personnel and or the, working language or would require the issuance
of the Plan in the new language(s).

2.2.5 The Plan should be readily available for inspection by officers authorized by a Party to
the Convention.

2.3 Exemptions

2.3.1 Regulation A-4 allows that exemption may be granted to a ship from Regulation B-3
or C-1.

2.3.2 Details of exemptions should be retained with the Plan.

2.3.3 Any exemption granted is to be recorded in the Ballast Water Record Book.

2.4 Additional Measures

2.4.1 The Convention, in Regulation C-1 Additional Measures, gives a Party individually or
jointly with other Parties, the right to introduce measures in addition to those in Section B. Such
Additional Measures are to be communicated to the Organization at least 6 months prior to the
projected date of implementation.

2.4.2 The Plan should be accompanied by a most recent list of Additional measures, as
communicated by the Organization relevant to the ship’s trade. The Plan should contain details
and advice on the actions a ship must take to comply with any additional measures that may be
required in accordance with Regulation C-1 and for any emergency or epidemic situations.

2.5 Review of the Plan

2.5.1 Regular review of the Plan by the owner, operator, or master should be conducted to
ensure that the information contained is accurate and updated. A feedback system should be
employed which will allow quick capture of changing information and incorporation of it into
the Plan.

2.5.2 Changes to the provisions of this Plan will need Administration approval.

3 MANDATORY PROVISIONS

3.1 This section provides individual guidelines for the seven mandatory provisions of
Regulation B-1 of the Annex to the Convention. In addition, it provides information to assist
ships personnel in managing ballast water and sediments.

3.2 Regulation B-1 of the Annex to the Convention provides that the Plan shall be specific to
each ship and shall at least:

.1 detail safety procedures for the ship and the crew associated with Ballast Water
Management as required by the Convention;

.2 provide a detailed description of the actions to be taken to implement the Ballast


Water Management practices required by the Convention;

.3 detail the procedures for the disposal of sediments at sea and to shore;

.4 include the procedures for co-ordinating shipboard Ballast Water Management


that involves discharge to the sea with the authorities of the State into whose
waters such discharge will take place;

.5 designates the officer on board in charge of ensuring that the Plan is properly
implemented;

.6 contain the reporting requirements for ships provided for under the Convention;
and

.7 be written in the working language of the ship. If the language used is not
English, French or Spanish, a translation into one of these languages should be
provided.

3.3 The Ballast Water Management Plan should give guidance on the ballast handling
procedures to be followed, including:

.1 uptake of ballast water;

.2 step-by-step procedures and sequences for the Ballast Water Management System
used; and

.3 any operational or safety restrictions including those associated with the Ballast
Water Management System used. This will also assist ship’s personnel when
responding to enquiries from inspection officers authorized by a Party.

3.4 Safety aspects of the Ballast Water Management system used should include, as
applicable, guidance on:

.1 stability to be maintained at all times to values not less than those recommended
by the Organization (or required by the Administration);

.2 approved longitudinal stress and, where applicable, torsional stress values are to
be maintained within permitted values;

.3 transfer or exchange of ballast that can generate significant structural loads by


sloshing action in partially-filled tanks. If these operations include partially-filled
tanks, consideration should be given to carrying out the operation in favourable
sea and swell conditions such that the risk of structural damage is minimized;

.4 wave-induced hull vibrations when carrying out ballast water exchange;

.5 forward and aft draughts and trim, with particular reference to bridge visibility,
slamming and minimum forward draft;

.6 the effects of any potential hazards and occupational health that may affect ship’s
personnel shall also be identified together with any safety precautions that need to
be taken; and

.7 the possible effects of tank over pressurization.

3.5 If a ship is able to complete at least 95 per cent volumatic exchange in less than three
pumped volumes, documentation indicating that this ballast water exchange process has been
approved under Regulation D-1.2 should be provided in the Plan.

3.6 The Plan should also include procedures for the disposal of sediments and in particular:

.1 on the sediment removal or reduction at sea, and when cleaning of the ballast
tanks to remove sediments;

.2 regarding the safety consideration to be taken if tank entry is required to remove


sediments; and

.3 regarding the use of port reception facilities for sediments.

3.7 The Plan should clearly identify the officer in charge of ballast water management and
outline his/her duties which should include:

.1 ensuring that the Ballast Water Management performed follows the procedures in
the Plan;

.2 ensuring that the Ballast Water Record Book and any other necessary
documentation are maintained; and

.3 being available to assist the inspection officers authorized by a Party for any
sampling that may need to be undertaken.

3.8 The Plan should contain guidance on the recording requirements according to ship’s
Ballast Water Record Book provided for under this Convention including details of exemptions
granted to the ship.

3.9 In addition to the above, the Plan should include the following:

.1 A foreword which should provide the ship’s crew with explanations on the need
for ballast water management and for record keeping. The foreword should
include a statement that, “This Plan must be kept available for inspection on
request by an authorized authority”.

.2 Ship particulars including at least:

.1 ships’ name, flag, port of registry, Gross Tonnage, IMO number*, length
(BP), beam, international call sign; deepest ballast drafts (normal and
heavy weather);

.2 the total ballast capacity of the ship in cubic meters and other units if
applicable to the ship;

.3 a brief description of the main ballast water management method(s) used


on the ship; and

.4 identification (rank) of the officer in charge for implementing the Plan.

.3 Information on Ballast Water Management System used on board, including:

.1 ballast tank arrangement;

.2 ballast capacity plan;

.3 a ballast water piping and pumping arrangement, including air pipes and
sounding arrangements;

.4 ballast water pump capacities;

.1 A list or diagrams indicating the location of sampling and access points in


pipelines and ballast water tanks, to enable crew members to assist the
authorized officers of a Party that have reason to obtain samples.

.2 This section should make clear that sampling of ballast water is primarily a
matter for the authorized inspection officers, and there is unlikely to be
any need for crew members to take samples except at the express request,
and under the supervision, of the authorized inspection officers.

.3 The authorized inspection officers should be advised of all safety


procedures to be observed when entering enclosed spaces.

.5 Provisions for crew training and familiarization, including:

.1 requirements of a general nature regarding Ballast Water Management;

.2 training and information on ballast water management practices;

.3 ballast water exchange;

.4 ballast water treatment systems;

.5 general safety considerations;

.6 the Ballast Water Record Book and maintenance of records;

.7 the operation and maintenance of installed ballast water treatment systems;

.8 safety aspects associated with the particular systems and procedures used
onboard the ship which affect the safety or human health of crew and
passengers and/or the safety of the ship;

.9 precautions for entering tanks for sediment removal;

.10 procedures for the safe handling and packaging of sediment; and

.11 storage of sediment.

4 NON-MANDATORY INFORMATION

4.1 In addition to the provisions required by Articles and regulations of the Convention, the
owner/operator may include in the Plan, as appendices, additional information such as: provision
of additional diagrams and drawings, shipboard equipment and reference materials. National or
regional requirements that differ from the Convention may also be recorded for reference.

4.2 Non-mandatory information may also include manufactures manuals (either as extracts or
complete) or reference to the location on board of such manuals and other relevant material.

STANDARD FORMAT FOR THE BALLAST WATER MANAGEMENT PLAN

PREAMBLE

The ballast water management plan should contain the information required by Regulation B-1
of the Convention.

For guidance in preparing the plan the following information is to be included. The plan should
be specific to each ship.

INTRODUCTION

At the beginning of each plan, wording should be included to reflect the intent of the following
text.

1 This Plan is written in accordance with the requirements of Regulation B-1 of the
International Convention for the Control and Management of Ships’ Ballast Water and
Sediments, 2004 (the Convention) and the associated Guidelines.

2 The purpose of the Plan is to meet the requirements for the control and management of
ship’s ballast water and sediments in accordance with the Guidelines for Ballast Water
Management and the Development of Ballast Water Management Plans
resolution MEPC XX(YY) (The Guidelines). It provides standard operational guidance for the
planning and management of ships’ ballast water and sediments and describes safe procedures to
be followed.

3 This Plan has been approved by the Administration and no alteration or revision shall be
made to any part of it without the prior approval of the Administration.

4 This Plan may be inspected on request by an authorized authority.

Note: The Plan is to be written in the working language of the crew, if the text is not in
English, French, or Spanish, the plan is to include a translation into one of these languages.

1 Contingency measure means a process undertaken on a case-by-case basis after a


determination that ballast water to be discharged from a ship is not compliant, in order to allow
ballast water to be managed such that it does not pose any unacceptable risks to the
environment, human health, property and resources.

Purpose

2 The goal of this Guidance is to support ships and port States to apply sound and
practical measures in the case of a ship unable to manage ballast water in accordance with its
approved Ballast Water Management plan to meet the D-1 or D-2 standard, with a view to
ensuring the protection of the marine environment and ship, safety and minimizing any impacts
on the continuity of port and ship operations.

Implementation of contingency measures

3 In the case of non-compliant ballast water, communication between the ship and the
port State should occur. The ship and the port State should consider the following as possible
contingency measures:

.1 actions predetermined in the Ballast Water Management plan of the ship;

.2 discharging ballast water to another ship or to an appropriate shipboard or


land-based reception facility, if available;

.3 managing the ballast water or a portion of it in accordance with a method


acceptable to the port State;

.4 ballast water exchange carried out to an approved plan in accordance with


regulation B-4 to meet the standard in regulation D-1. The ship and the
port State should consider the potential disruption to the cargo handling
operation plan of the ship and the potential impact to relating parties including
port operators and cargo owners; or

.5 operational actions, such as modifying sailing or ballast water discharge


schedules, internal transfer of ballast water or the retention of ballast water
on board the ship. The port State and the ship should consider any safety
issues and avoid possible undue delays.

4 Having considered all of the options in paragraph 3 above, the ballast water may be
discharged in the port or any suitable area, as acceptable to the port State. Port State
consideration may include environmental, safety, operational and logistical implications of
allowing or disallowing the discharge. The discharge of ballast water is subject to any
conditions of the port State.

5 The port State should report information on the use of contingency measures in
accordance with the experience-building phase (EBP) associated with the BWM Convention
(resolution MEPC.290(71)).

6 In any case, the ship is required to do its best to correct malfunction of the Ballast
Water Management system as soon as possible and submit its repair plan to the port State
control authorities and the flag State.

7 The port State, the flag State and the ship should work together to agree on the most
appropriate solution to allow for the discharge of ballast water found to be non-compliant.

8 The ship and the port State should take appropriate measures, bearing in mind that
ballast water sampling is still under development, as noted in the Guidance on ballast water
sampling and analysis for trial use in accordance with the BWM Convention and Guidelines (G2)
(BWM.2/Circ.42/Rev.1) and the agreement on non-penalization during the EBP
(MEPC.290(71)).

Review

9 The guidance on contingency measures should be kept under review in the light of
experience gained through the EBP.
