DECLARING ORDINANCE NO.4, S2O2I OF THE SANGGUNIANG

BAYAN OF ASINGAN, PANGASINAN, ENTITLED .-AN
ORDINANCE APPRO}'ING THE TRICYCLE ROUTE PLAN (TRP)
OF TIIE MUNICIPALITY OF ASINGAN, PANGASINAN' AS
WITHIN THE CONFERRED POWERS OF THE SANGGUNIANG
BAYAN TO ENACT

WHEREAS, the Sangguniang Bayan of Asingan, Pangasinan submitted its

Municipal Ordinance No. 4, 5-2021 to the Sangguniang Panlalawigan for review and
evaluation pursuant to Section 56 of R.A. No. 7160, otherwise known as the Local
Govemment Code of l99l;

WHEREAS, the Committee on Laws and Ordinances of the Sangguniang

Panlalawigan with the technical assistance of the Provincial Legal Officer, have
conducted initial review and study on said municipal ordinance and found out that the
same was enacted pursuant to Sections 447 (a) (vi), (v) and (vi) ofRA No. 7160,

WHEREAS, the Sangguniang Bayan is invited to consider the DOTr Department

Order No. 2017-01 1, which directs LGUs to prepare their respective LPTRPs. Under said
Order, LPTRP refe* to a plan detailing the route nelwork, mode and required number of
units per mode of delivering public land transporu;ervices". Based on LPTRP Manual
by the DOTr, DILG, and the LTFRB, tricycles are covered by the LPTRP because they
are considered as non-fixed route passenger public transportation; The LPTRP, in turn,
must be approved by the LTFRB and be consistent with Asingan's Comprehensive Land
Use Plan and Zoning Ordinance;

WIIEREAS, subject ordinance shall take effect after the requirement of posting
pursuant to Section 59 of RA 7160 is complied with;

WHEREFORE, in view of the foregoing, on motion ol SP Members Salvador S.

Perez, lr. and Noel C. Bince and co-sponsored by SP Members Sheila Marie S. Perez-
Galicia, Jerome Vic O. Espino and Jeanne Jinky C. Zaplan.duly seconded, it was -

RESOLVf,D, by the Sangguniang Panlalawigan in session assembled, to declare

Municipal Ordinance No. 4, Series of 2021 of the Sangguniang Bayan of Asingan,
Pangasinan, entitled "An Ordinance Approving the Tricycle Route Plan (TRP) of the
Municipality ofAsingan, Pangasinan" as within the conferred powers ofthe Sangguniang
Bayan to enact as within the confened powers ofthe Sangguniang Bayan to enact;

RESOLVED FURTHE& that a copy of this resolution be fumished the Office of

the Sangguniang Bayan ofAsingan, Pangasinan, for its information and guidance.
