A RESOLUTION RECOMMENDING TO THE SANGGUNIANG BARANGAY OF BARANGAY CATUMSAN, ARTECHE,

EASTERN SAMAR, THE ENACTMENT OF AN ORDINANCE REGULATING THE SALE OF CIGARETTES AND
ALCOHOLIC BEVERAGES TO MINORS AND THE DESIGNATION OF SMOKING AREA

WHEREAS, under Section 9 of Republic Act 9211, otherwise known as the Tobacco Regulation Act of
2003, it is unlawful for any retailer of tobacco products to sell or distribute tobacco products to any minor, for
any person to purchase cigarettes or tobacco products from a minor, for a minor to sell or buy cigarettes or
any tobacco product and for a minor to smoke cigarettes or any other tobacco products;

WHEREAS, Section 6 of the same law mandates the designation of smoking and non-smoking areas;

WHEREAS, President Rodrigo R. Duterte issued Executive Order No. 26, dated May 16, 2017, providing
for the establishment of smoke-free environment in public and enclosed places;

WHEREAS, explicitly stated under Section 3 of the said EO that it is unlawful and prohibited for any
person to sell, distribute or purchase tobacco products to and from minors, for a minor to smoke, sell or buy
cigarettes or any tobacco products, ordering, instructing or compelling a minor to use, light up, buy, sell,
distribute, deliver, advertise or promote tobacco products and selling or distributing tobacco products in
school, public playground, youth hostels and recreational facilities for minors, including those frequented by
minors or within 100 meters from any point of the perimeter of these places, among others;

WHEREAS, the EO likewise provides for the standards for designated smoking areas;

WHEREAS, Presidential Decree No. 1619 penalizes the use or possession or the unauthorized sale to
minors of volatile substances for the purpose of inducing intoxication or in any manner changing, distorting or
disturbing the auditory, visual or mental process;

WHEREAS, Arteche is declared as a smoke-free municipality so all barangays must follow such policy;

NOW THEREFORE, upon proper motion duly seconded,

BE IT RESOLVED by this Body in a meeting duly convened to recommend to the Sangguniang Barangay
of Barangay Catumsan, Arteche Eastern Samar the enactment of an ordinance regulating the sale of cigarettes
and alcoholic beverages to minors and the designation of smoking area;

RESOLVED FURTHER, that copies of this Resolution be forwarded to all concerned for their information
and consideration.

A RESOLUTION RECOMMENDING TO THE SANGGUNIANG BARANGAY OF BARANGAY CATUMSAN, ARTECHE,

EASTERN SAMAR, THE ENACTMENT OF A ROAD CLEARING ORDINANCE.

WHEREAS, the DILG issued Memorandum Circular No. 121 dated July 29, 2019 regarding the
presidential directive during the 4th State of the Nation Address enjoining all local officials to exercise their
powers essential to reclaim public roads which are being used for private ends;

WHEREAS, DILG Memorandum Circular No. 27 dated February 7, 2020, re Continued Implementation
of the Presidential Directive to Clear Roads of Illegal Obstructions (Road Clearing 2.0), mandates local
government units to enact or review existing ordinances that provide for the conduct of road clearing
operations and prohibition of road obstructing structures and constructions;

WHEREAS, the said circular defined road obstructions as structures, materials, or activities within the
road right-of-way that impede the free and clear passage of motor vehicles or pedestrians and/or pose danger
or cause injury to motorists, pedestrians, or occupants of nearby structures;

WHEREAS, DILG Memorandum Circular No. 2020-145 dated October 27, 2020, provides for the
resumption of road clearing operation in accordance with the respective community quarantine classification
of LGUs;

WHEREAS, in compliance with the abovementioned issuances and to ensure the safety of motorists,
pedestrians and the community as a whole, there is a need to enact an ordinance which will set the
prohibitions, penalties and other provisions for road clearing operation;

NOW THEREFORE, upon proper motion duly seconded,

BE IT RESOLVED by this Body in a meeting duly convened to recommend to the Sangguniang Barangay
of Barangay Catumsan Arteche, Eastern Samar the enactment of a road clearing ordinance;

RESOLVED FURTHER, that copies of this Resolution be forwarded to all concerned for their information
and consideration.
