AFFIDAVIT OF JUSTIFICATION/EXPLANATION

I, BARBIE CRUZ, 71 years old, American Citizen, formerly married to

Ken Cruz
, with residence address at Daraga, Albay, after having been duly
sworn to in accordance
with law, do hereby depose and say that:

1. I am a natural born Filipino citizen by birth;

2. I lost my Filipino citizenship when I was naturalized as a citizen

of the United States
of America on March 28, 1979.

3. I intend to stay in the Philippines for good. I would also like to

retain and reacquire
my Philippine citizenship under Republic Act No. 9225.

4. As requirement for my petition with the Bureau of Immigration, I

have executed my
Oath of Allegiance on August 14, 2017, under Doc No. 407, Page No.
83, Book No.
12, Series of 2017 before notary public Harvey Specter.

5. My Oath of Allegiance was not taken before the Bureau of

Immigration Legal
Officer in Metro Manila because I already have a difficulty in walking
and currently
supported by a wheelchair. Hence, travelling by air or by land
from Legazpi to
Manila would be very difficult on my part and hazardous to my health.

6. That I am executing this affidavit to attest to the truth of

AFFIDAVIT OF WITNESS

I, MAGDALENA M. SEBASTIAN, 73 years of age, Filipino

Citizen, widow, and a resident of Vincenzo Sagun, Zamboanga del Sur,
Philippines, after having been duly sworn in accordance with law do
hereby depose and state that, to wit:
1. I am the mother of ALEXANDER SEBASTIAN;

2. When my husband passed away, I succeeded taking care of the

land allegedly owned by ERLINDA LILIBETH G. ENCALLADO,
without any financial benefit;

3. However, due to my age and health issues, I could no longer

perform the task for quite some time;

4. It is only my son who took care of me on account of my illness

whenever he arrives from work ever since my husband passed
away;

5. On July 2022, I was never approached nor engaged with any

conversation with the alleged owner regarding any issue related
to the charges against my son;

6. That I am executing this affidavit to attest to the truth of the

foregoing and for whatever legal purpose this may serve.
