Unit 01: Interpret Consecutively and Simultaneously (Whispered) in the Public Services
Context of English Law (K/602/2328)

CANDIDATE'S PROMPT NOTES

Candidates have five minutes to study these notes

You are asked to interpret on two occasions. It is essential to interpret accurately and fully, demonstrating a
professional and confident manner, including objective understanding of the cultures and conventions
involved.

At the beginning of each role play, it will be assumed that the participants have already been introduced to
each other and the interpreter's role has been explained.

In the process of the role play the interpreter will be expected to intervene appropriately if and when
necessary (for example to ask for clarification or to alert the parties to a missed cultural inference) and to
explain in both languages why s/he is doing so.

For examination purposes, you must speak sufficiently loudly during the ‘whispered’ section to allow for a
clear recording of your interpreting.

1ST SCENARIO (PART A) - Approximately 15 minutes

Consecutive interpreting technique (i.e. interpreting after an interlocutor has stopped speaking) to be used
for approximately 10 minutes in total and whispered technique (i.e. interpreting whilst an interlocutor is
speaking) from the Other Language into English for approximately 5 minutes.

CONTEXT: A person has witnessed an incident of indecent exposure. The police are interviewing the
witness.

Interlocutor i) English-speaking police constable

Interlocutor ii) Other Language-speaking victim

2ND SCENARIO (PART B) - Approximately 15 minutes

Consecutive interpreting technique (i.e. interpreting after an interlocutor has stopped speaking) to be used
for approximately 10 minutes in total and whispered technique (i.e. interpreting whilst an interlocutor is
speaking) from English into the Other Language for approximately 5 minutes.

CONTEXT: A public defence solicitor is meeting with a client who has been charged with assault. The
client is concerned about client confidentiality and legal professional privilege.

DPSI Oral Timings

Unit 01 (Part A and Part B) will take approximately 30 minutes. If the examination exceeds 40 minutes,
it will be stopped by the Oral Examiner and will not be marked beyond this point.

WHISPERED INTERPRETING

At this point the police constable will ask the interpreter: “Do you want to
move?”. The witness will then take about five minutes to explain what
happened. During this time the interpreter will move to give the police
constable whispered simultaneous interpretation.

Most likely if we manage to arrest him he will be charged with exposure under the
Sexual Offences Act 2003. // If he is found guilty on a summary conviction then it
would be imprisonment for a term not exceeding 6 months, // or a fine not exceeding
the statutory maximum, or both. // If he is convicted on indictment then it would be
imprisonment for a term not exceeding 2 years.

can afford to pay. // You do realise that assault is quite a serious charge. // It is not a
victimless crime where no one has been hurt. // It can lead to a custodial sentence,
particularly if there are aggravating circumstances, // and if there are no mitigating
circumstances in your favour.

client confidentiality and legal professional privilege. During this time the

Correct. Let me explain why I couldn’t tell the police anything you haven’t authorised
me to disclose.
As I said, I am a solicitor. Except in exceptional circumstances, solicitors are under a
duty to keep the affairs of their clients confidential, and the circumstances in which
they are able to disclose client communications are strictly limited. The obligations
extend to all matters revealed to a solicitor, from whatever source, by a client or
someone acting on the client's behalf.
Solicitors also have a duty of full disclosure to their clients, which means I have an
obligation to you, to make sure you are fully aware of the facts. The only exception to
this is really where disclosure of information would prejudice an existing or proposed
investigation.

Any general communications between us can never be disclosed by me unless
statute permits this, either expressly or by necessary implication. You could also
waive this protection, but I cannot.
Communications between us are protected by what is known as ‘legal professional
privilege’. This is a privilege against disclosure, ensuring clients know that certain
documents and information provided to lawyers cannot be disclosed to a third party.
It recognises the client's fundamental human right to be candid with his legal adviser,
without fear of later disclosure to his prejudice. It is an absolute right and cannot be
overridden by any other interest.
This privilege does not extend to everything lawyers have a duty to keep confidential.
It protects only those confidential communications falling under either of the two
heads of privilege – ‘advice privilege’ or ‘litigation privilege’.
All of this is for your protection. Until found guilty in a court of law, you are presumed
to be innocent, and this presumption applies to everyone.
Having said all this, I would warn you that if you tell me you are guilty then you
cannot ask me to stand up and tell the court that you are innocent.

The advisor will now ask the interpreter to move back.

One reason would be that if you plead guilty at the earliest opportunity, the penalty is
likely to be less than if you are found guilty by a judge or jury. // Do you still want to

Unit 02: Provide a Sight Translation into English in the Public Services
Context of English Law (K/602/2393)

Time allowed: 10 minutes

INSTRUCTIONS TO CANDIDATES

Study the following text for five minutes. The examiner will then ask you to
give an accurate and complete oral translation and will allow you up to five
minutes to do this. Candidates are not allowed to take notes or to annotate or
mark the text in any way.

CONTEXT:
A person whose first language is not English is carrying out comparative research in
relation to deaths in police custody. You are asked to provide a sight translation of
his email request for information.

Pension Scams

Pension fraudsters promise to convert pension benefits into cash before age 55

Criminals are believed to be fraudulently using the pension process in a number of

ways. These include failing to advise members of the tax implications of receiving
cash from their pension; failing to advise members of the full extent of fees to be paid
in relation to any future investment; and falsely representing anticipated levels of
returns when investments are either non-existent or incapable of providing such a
return.

The industry estimates that the current loss to the UK from this fraud type is £600
million.

The criminals have a variety of tricks to catch you out. They may:

 claim that you can access the money you have paid into your pension before age
55
 approach you out of the blue over the phone, via text message or in person door-
to-door
 entice you with upfront cash
 offer a free ‘pension review’ or try to lure you in with so-called ‘one-off’ investment
opportunities.

Check the facts before you make an irreversible decision. A lifetime’s savings can be
lost in a moment.

CONTEXT:
You are asked to provide a written translation of the following information leaflet about
the new General Data Protection Regulation which is coming into force.

Data Protection – New Rules for the New Age

The UK, together with the other countries of the European Union, has agreed a new
legal framework for the protection of personal data in the form of the General Data
Protection Regulation which will apply throughout Europe.

The Regulation applies to those maintaining records of personal data as well as those
involved in processing data. It is important to note that, for these organisations, the
new rules will result in a greater level of legal liability than the current national rules.

In practical terms, the Regulation will apply to things like employee records, customer
lists and contact details. It is the data itself to which the protections apply so it does
not matter whether records are held, for example, on a computer database or as
paper copies in a filing cabinet.

Personal data which cannot immediately be linked to a particular individual can still
fall within the scope of the Regulation, depending on how easy it would be to identify
the person whose data is being stored or processed.

There is a special category for sensitive personal data, for example, a person’s
religion, political opinions, ethnic origin or information relating to their health.
Processing of such data will only be allowed under certain conditions.

The Regulation provides individuals with a set of rights such as the right to be
informed and right of access.

One of the key objectives of the Regulation is to promote accountability. It is

anticipated that these objectives will complement the Regulation’s transparency
requirements.
