1.0 Introduction

On Tuesday August 17, 2021 the community team responsible for the monitoring the
KARPOWERSHIP pipeline right of way (R.O.W) detected a possible encroachment on the
R.O.W and requested the Construction department for a technical assessment of the situation.
Upon a visit to the site it was discovered that a constructions project has been commenced by
a private developer whose parcel boundary per her documents overlaps with the R.O.W.

2.0 Site Assessment
After the visual assessment of the ground information it became imperative for a joint survey
to be conducted by GNGC’s team and the developer’s Surveyor to properly ascertain the
situation and to resolve it.
It was revealed that there is some discrepant between the developers document and the trend
of development on ground, But the developer’s boundary positions on ground were
established based on their documents without considering the trend of physical development
on ground leading to the error.
The developer’s surveyor argues that the portion under contention was properly acquired by
her client as evidenced by their document and that Ghana Gas rather encroached on their
property unlawfully.
The source of data upon which their land documentation is based on derails every argument
pertaining to it correctness. The site plan attached to their document was extracted from a
planning scheme covering that area without referencing to the ground information.

3.0 Recommendation and Conclusion
After a thorough assessment of the situation and considering the potential financial
repercussion it may pose, we have outlined the following recommendations for your
consideration.
a. To make a slight detour on the southern part of the R.O.W at the affected area to
accommodate this developer about (2.5- 3) m within the R.O.W.
b. Incase suggestion (a) is adopted an M.O.U should be signed by both GNGC and the
developer indicating the farthest her development can go.
c. The developer may then proceed with development within the agreed bounds base on
(a) and (b)
