remove and dispose of or otherwise remedy, at the Contractor’s expense any defective
or unsatisfactory work produced with the alternative equipment.

Neither the Employer nor the Contractor shall have any claim against the other for
either the withholding or the granting of permission to use alternative equipment, or
for the withdrawal of the permission.

(m) Maintenance of Existing Roads

Upon receipt of the Notice to Commence, the Contractor shall assume the
responsibility for maintaining properly the road sections scheduled for improvement
under this Contract. The obligation shall extend to public roads outside the Contract
limits and all detour structures that are used as access or haul roads by the Contractor.
Maintenance shall generally consist of routine patching, repairs and correction of
deformations for asphalt and concrete surfaced roads and the cyclic grading and repair
of gravel or earth surface roads. In addition to normal maintenance activities, the
Contractor shall be required to repair, at his own expense, any damage to any roads or
structures resulting from construction traffic associated with the Contract passing over
such roads or structures. Maintenance and repair work shall be carried out in
accordance with relevant Specifications or as instructed by the Engineer. Watering of
gravel road when necessary shall be made to reduce dust and nuisance to the public.
In relation to construction execution, traffic regulation such as load limit, traffic rules,
etc., shall be strictly in accordance with the traffic law of Timor - Leste and shall be
strictly observed. In case of any damage to existing road or structure, the Contractor
shall repair properly the damaged portion without delay at his own expense to the
satisfaction of the Engineer.

Maintenance of the existing road(s) shall not be measured for direct payment, but is a
subsidiary obligation of the Contractor under the Contract, covered by the unit rates
entered by the Contractor under the different pay items in the Bill of Quantities.

In cases where prior to start of construction operations the condition of the road or
structure to be used by the Contractor for construction operations is in deteriorated
condition which poses danger to the public, the Engineer may direct the Contractor to
rectify deteriorated panels or sections to an acceptable standard chargeable to the
project. Thereafter, maintenance shall be the sole obligation of the Contractor.

Any failure of the Contractor in complying with the obligations for maintenance and
traffic control of the existing road as specified above shall entitle the Engineer to carry
out such works as he deems necessary and to charge the Contractor with the full costs
thereof plus ten (10) percent of such cost, which shall be deducted from any expenses
due or which may become due to the Contractor under the Contract.

The MTCPW Standard Specifications, series of 2005 shall govern in the absence of regular pay items in this
specification.

SECTION 100 GENERAL REQUIREMENTS

ITEM 101 FACILITIES FOR THE ENGINEER

101.1 Sub-Section 101.1 of the MTCPW Standard Specifications, 2005 Offices and
laboratories for the Engineer is revised to read as follows:

101.1 (a) Provide Building for Field Office, Laboratory and Engineer’s Quarters including
Medical Room on a designated state-owned site. The Contractor shall furnish,

maintain until final acceptance of the project the hereinafter referred to as


the “Engineer’s Compound:

One (1) unit combined field office building and materials testing laboratory
and a separate building for the living quarters. The Engineer’s Compound shall
also contain a medical room for treatment of minor injuries to workers and
staff.

The Engineer will advise the site for the Engineer’s buildings to be approved by the
Ministry of Public Works (MPW) at the start of the construction contract.

The building shall be constructed in accordance with the standard specifications and
design shown on the Construction Drawings. The facilities shall be provided with all the
necessary electricity, water, drainage, sewer and security services for twenty-four (24)
hours a day, for all days of the contract period, for the exclusive use of the Engineer
and his staff. The Contractor shall obtain approval from the Engineer on the detailed
layout of the Engineer’s Compound before any work upon them is commenced.

The Engineer’s Compound shall be fenced with barbed wire (or equivalent) to a height
as shown on the Drawings and with necessary gates as directed or as shown on plans.
The estimated perimeter of fencing shall be determined and approved by the Engineer.
When required, the ground shall be raised to a grade that will keep it completely free
from flooding or to prevent inundation during rainy season. The compound shall be
provided with a parking area for at least six (6) vehicles. Outside lighting around the
building and parking shall be installed to the satisfaction of the Engineer and be
maintained at all times. Appropriate signs shall be installed to identify the facility to
public and visitors.

The building shall be ready for occupancy and use within three (3) months from the
Contract Start Date.

In the absence of potable water supply system within the area, the Contractor shall,
after approval of the Engineer, construct and install a three (3) cubic meters or 3,000
liter capacity elevated water tank, with two (2) horsepower deep well pump, or
equivalent capacity, to sufficiently supply the requirements of the Engineer’s Compound.
Water dispenser with hot and cold water supply for drinking shall also be made available.

Should there be no main electric line available, the Contractor shall also provide a
generator or power generating unit with enough capacity to supply the power needed.
The generator shall be housed in solid concrete bunkers to minimize the noise of the
operation and shall be located remotely from the building it is servicing.

All installations, fixtures, fittings and accessories shown are to be understood as


minimum requirements only and shall not restrict the Engineer from ordering the
Contractor to provide supplementary provisions. In the absence of any details or
specifications or provisions for the purpose of making alterations or amendments to the
Pay Items, the Contractor shall seek approval from the Engineer.

A septic tank, as part of the facilities for the engineer, shall have a capacity of not less
than six (6) cubic meters with two compartments. The Contractor must provide a drain
field with drain tile or a leaching well with adequate capacity for the personnel and the
usage of the facility for the duration of the Contract. The Contractor may propose other
satisfactory methods for disposing of sanitary waste that may be implemented only after
the written approval of the Engineer.

It shall be understood that if the Contractor cannot provide the articles as described or
intends to supply equivalent substitutes, he should secure the approval of the Engineer.

At the completion of the Contract, the combined Field Office/Laboratory and the Living
Quarters for the Engineer shall be turned-over and become property of the Government.

101.1 (a.1) PROVIDE, OPERATE AND MAINTAIN TEMPORARY FIELD OFFICE,


LABORATORY AND QUARTERS BUILDING FOR THE ENGINEER (RENTAL
BASIS)

The Contractor shall provide temporary office, laboratory and quarters for the
exclusive use of the Engineer on rental basis for three (3) months during the
construction of the permanent buildings. The temporary building shall have a
minimum floor area of 340 sq.m. and the lot area shall be a minimum of 600
sq.m. with parking provision for at least six (6) vehicles. The Contractor shall
first seek the Engineer’s approval of the building proposed to be rented before
finalizing any rental agreement. The building for the Engineer shall be
supplied with potable water and electricity 24/7, all as approved by the
Engineer.

In the event of Contractors default to complete and make ready for occupancy the
permanent Field Office Building, Laboratory and Quarters within the three (3) month
period, the Contractor will be solely responsible for the cost of extending rental,
operation and maintenance of the temporary facilities until such time that the permanent
facilities are occupied by the Engineer.

The unit of measurement for the provision of Engineer’s Temporary Office,


Laboratory and Quarters shall be on a monthly basis.

101.1(b) PROVISION OF FURNITURE, FIXTURES, EQUIPMENT AND APPLIANCES FOR


ENGINEER’S OFFICE, LABORATORY AND ENGINEER’S QUARTERS

The Office and Laboratory facilities shall be provided with the minimum
requirements of furniture, equipment and appliances specified in Schedules A,
B and C.

It shall be understood that if the Contractor cannot provide the articles as


described or intends to supply equivalent substitutes, the Engineer may
purchase the specified articles. The Contractor shall pay therefore as certified
by the Engineer, the expenses incurred in the purchase of the articles or the
Engineer shall have the right to deduct the amount from any money which is
due or which will become due to the Contractor.

The Contractor shall provide and maintain furniture and equipment per the
following schedules.

Provide Laboratory Equipment and Apparatus,

Upon completion of the Project these Equipment shall be turned over to the Government.
Equipment shall be recalibrated by approved technician on annual basis. Unacceptable items not
replaced within (15 days) of turnover date shall entitle the Engineer to deduct their replacement
costs based on current prices from any receivables of the Contractor.

Working tables and benches, with drawers and cabinets beneath, shall be constructed along the walls of the laboratory at
the direction of the Engineer.

101.1 (c) OPERATION AND MAINTENANCE OF ENGINEER’S OFFICE, LABORATORY AND


ENGINEER’S QUARTERS INCLUDING CONSUMABLE MATERIALS, SCHEDULE D

The buildings shall be provided with an air-conditioning system which can cool and dehumidify
the air, complete with all standard accessories and which will operate on a 220 volt, 60 cycle, 3-
phase current at the location and quantity/capacity reflected per approved Plans.

A generator set shall be provided in the event of a failure in the main supply. The generator shall
be housed in a solid concrete bunker to minimize the noise of operation and for the same reason
shall be located remotely from the building it is servicing and also from all local habitations.

In the event that main electricity is not available at the location of the office/quarters, the
Contractor shall provide and maintain a generator set of sufficient capacity to operate all electric
appliances and lighting for the duration of the contract period. Electricity shall be provided to the
site 24/7 for the duration of the contract.

Minor repairs to the building due to normal use shall be part of the maintenance aspect including
the monthly expenses for water and electric power services. The provision of adequate stocks of
expendable items such as floor wax, brooms, floor mats, insect sprays, tissue paper and other
building maintenance accessories are routine requirements for the proper maintenance of the
facilities.

In the event that a potable water supply is not available in the project area, the Contractor shall
provide an alternative source as follows:

a) The Contractor shall provide and maintain a deep well with mechanical pump coupled
with an electric motor controlled by an automatic pressure cut off switch. The
Contractor shall provide and maintain a 500 gallon galvanized steel pressure tank,
mounted on a steel frame. The water tank shall be made on steel galvanized steel
frame before construction starts. The type and make of electric motor and jet pump
shall be subject to the approval of the Engineer.

b) The Contractor shall provide an adequate supply of potable water from an approved
source for the use of the Engineer. The water shall be supplied and stored in a covered
container to maintain its potability.

The Contractor shall provide the following personnel to maintain all the facilities in good operating
condition. The personnel shall adequately safeguard and secure the buildings, equipment and
property day and night, regularly and properly clean these facilities, and shall render household
works, all as directed and approved by the Engineer.

For Quarters:
1 – Cook/Maid
1 – Laundry Woman
2 – Watchman
1 – Utilityman

The Contractor shall provide within thirty (30) days after receipt of Notice to Commence a
sufficient supply of all normal stationary printing papers, laboratory and testing materials and
consumable items specified under Schedule D, all as required and upon the discretion of the
Engineer.

It shall be understood that if the Contractor cannot provide the articles as described or intends to
supply equivalent substitutes, the Engineer may purchase the specified articles. The Contractor
shall pay therefore as certified by the Engineer, the expenses incurred in the purchase of the
articles or the Engineer shall have the right to deduct the sums from any money which is due or
which will become due to the Contractor.

All test and quality control works shall be done by the Contractor’s Materials Testing and
Laboratory Staff under the direct supervision of the Engineer. The Contractor shall also provide
qualified and experienced laboratory staff, to carry out all materials quality control and all the
tests specified in the Contract as required by the Engineer. The person so appointed by the
Contractor to manage the laboratory shall be well experienced in the type of work to be
undertaken and shall be subject to the approval of the Engineer.

For Laboratory:

All tests shall normally be carried out on the site, except that, certain special tests could be carried
out at an independent testing laboratory approved by the Engineer. The Contractor shall make all
necessary arrangements for the supply and delivery of samples to the laboratory and collection
of samples and the results from such laboratory. The Engineer shall define from the beginning of
the works, and in accordance with the Specifications, all tests to be performed for each kind of
material and/or works, together with the corresponding frequencies to be used. The Engineer
shall amend such statement from time to time during the progress of work, if deemed necessary.

Provision of Office Supplies and Consumable Stores for the Engineer, Schedule D

The other supplies and consumable stores to be provided shall be, but not limited to the items
and quantities listed under Schedule D. Schedule of deliveries shall be based on estimated monthly
consumption as directed by the Engineer.

COMMUNICATION EQUIPMENT

The Contractor shall furnish and deliver on or before the date of Commencement of Works, cellular phone
(open line) in the number of units shown in the Bill of Quantities.

All expenses related to the supply and use of the cellular phones shall be borne by the Contractor until
the completion of the Contract. Upon completion of the Contract the communication equipment shall
remain as property of the Contractor.

101.2 VEHICLES FOR THE ENGINEER

101.2.a PROVIDE, OPERATE AND MAINTAIN SERVICE VEHICLE FOR THE ENGINEER ON RENTAL
BASIS

The Contractor shall provide one (1) unit 4WD Double Cab Pick-up, 2500cc (minimum) Diesel Engine,
Airconditioned, 4 seats(minimum), 5 speed transmissions with high/low ratio transfer gear, fully loaded,
within thirty (30) calendar days upon receipt of the Notice to Commence, service vehicle for the exclusive
use of the Engineer. The vehicle shall be brand new.

The Contractor shall operate and maintain the vehicles on a monthly basis, including driver who will be
under the direction and supervision of the Engineer. The driver shall have professional drivers’ license,
be experienced, competent and subject to the approval of the Engineer. Operation and maintenance of
the vehicle shall include accessories, fuel, oil, car wash and expenses for the wear and tear and repairs,
insurance for third party liability, spare tires, tool kit, fire extinguisher, etc. and duly registered and comply
with legal requirements.

In case of major repair and/or breakdown of the service vehicle, the Contractor shall provide the
equivalent substitute immediately.

Failure by the Contractor to provide the service vehicle within the stipulated time, the Engineer shall be
entitled to provide the vehicle in a way he deems fit under government regulations and charge the cost
to the Contractor. The service vehicle will be returned to the Contractor at the end of the Contract.

101.2.b PROVIDE, OPERATE AND MAINTAIN UTILITY VEHICLES FOR THE ENGINEER’S STAFF ON
RENTAL BASIS

The Contractor shall provide, operate and maintain three (3) Units 4WD Double Cab Pick-up, 2500cc
(minimum) Diesel Engine, Airconditioned, 4 seats(minimum), 5 speed transmissions with high/low ratio
transfer gear, fully loaded, within thirty (30) calendar days upon receipt of the Notice to Commence, utility
vehicles for the exclusive use of the Engineer’s staff. The vehicles shall be brand new.

All vehicles shall comply in all respects, with all relevant National or Local Laws, statutes and regulations,
and shall be provided with comprehensive insurance, spare tires and wheels, and all necessary tools for
minor repair.

The Contractor shall operate and maintain the vehicles on a monthly basis, including drivers who will be
under the direction and supervision of the Engineer. The drivers shall have professional drivers’ licenses,
be experienced, competent and subject to the approval of the Engineer. Operation and maintenance of
the vehicles shall include accessories, fuel, oil, car wash and expenses for the wear and tear and repairs,
insurance for third party liability, spare tires, tool kit, fire extinguisher, etc. and duly registered and comply
with legal requirements.

In case of major repair and/or breakdown of the service vehicles, the Contractor shall provide the
equivalent substitute immediately.

101.3 ASSISTANCE TO THE ENGINEER

101.3 (a) PROVISION, OPERATION AND MAINTENANCE OF SURVEY EQUIPMENT AND APPARATUS FOR
THE ENGINEER

Add the following to Sub-Section 101.3:


The Contractor shall supply, within thirty (30) days from the receipt of the Notice to Commence, and
maintain for the duration of the contract, the following survey equipment for the exclusive use of the
Engineer and his representatives.

The surveying instruments shall be brand new, of the latest design and manufactured by a reputable
manufacturer acceptable to the Engineer. The Contractor shall submit to the Engineer for approval the
proposed manufacturer, type and models with parts performance catalogues and manufacturer’s warranty
prior to purchase of the instruments. The equipment shall be turned-over to the Government after the
completion of the project.

The Contractor shall provide a photographic record of the Construction Work. Such photographs shall
be taken before, during and after construction on the same angle of reference and as directed by the
Engineer or under the following occasions or events:

1. When a portion of the work is difficult or impossible to inspect at the time of a particular operation,
where a portion will be covered by backfill, or filling materials after completion and acceptance of
the work by the Engineer.

2. When or where special or unusual features of the work or latent conditions on the site are present.

When taking photographs, the Contractor is required to observe that:

1. An Indicator, such as scale, pole or similar item shall be placed thereon to signify or illustrate the
relative dimensions of the pictures.
2. Each picture shall be captioned and identified as to date, location, description of the work in
progress or completed operation or activity or presence of unusual features.
3. Each picture shall be properly referenced, and with same angle as it was taken before, during and
after construction.
4. The picture shall be clearly discernible in color having a dimension of not less than 200 mm x
150mm.

All photographs shall be submitted at intervals of not less than one (1) month or as required, taken
selectively by the Engineer, which represents the progress of the works.

The photographs selected by the Engineer, with copies furnished by the Contractor, shall be compiled in
albums together with the jpeg electronic files and shall be arranged in consecutive order and in
accordance with the construction program submitted to and approved by the Engineer. Each album shall
show the name of the Project on the cover and shall contain a location map of the construction site.

ITEM 102 OTHER GENERAL REQUIREMENTS

102.1 FACILITIES FOR THE CONTRACTOR

102.1.1 GENERAL

The Contractor shall provide and maintain such offices, stores, workshops, latrines, housing and
messing accommodations as necessary. The selection of the site shall be the responsibility of the
Contractor and shall be approved by the Engineer. It is entirely up to the Contractor to make whatever
arrangement he deems necessary with landowners regarding the use of land for the purpose of
erecting camps, workshops, garages, stockpiling of materials, location of plants, housing of labor and
staff, welfare facilities, etc. and all cost incurred in connection with rental or lease of such land shall
be at the Contractor’s expense.

The Contractor’s compound shall be located distinct and separate from the Engineer’s compound.
The Contractor shall not be permitted to erect temporary buildings or structures on the Site without
the specific permission in writing of the Engineer. The Contractor shall fence off the Contractor’s
store area from the rest of the Site. By the end of the Defects Notification Period, the Contractor
shall remove this fence and all buildings shall be cleared and the area shall be graded as required by
the Engineer.

The Contractor shall be solely responsible for securing the ECC for the erection of whatever facilities
he deems necessary to execute the work.

The Contractor shall not erect temporary buildings or structures within the road right-of-way without
the prior written approval of the Engineer.

102.1.2 HOUSING FOR LABOUR

The Contractor shall provide and maintain at his own expense living accommodation and amenities
for all staff and labour employed by him directly or indirectly in connection with the project, except
for those recruited from the immediate vicinity of the works. Each building for living accommodation
shall be provided with lights, water supply (both for drinking and other purposes), efficient sanitation
and refuse disposal system, cooking areas and equipment, and appropriate furnishings to the
satisfaction of the Engineer. All living accommodation shall be maintained in a clean and sanitary
condition at all times.

Except for shelter for watchmen, informal tented camps along the road shall not be permitted.

The Contractor shall ensure the site selection for housing for labour/workers’ accommodation
considers: a) community health and safety risks (i.e., not in a close proximity to schools, churches);
b) safe waste disposal, including sludge disposal, c) existing carrying capacities in terms of public
service and resources (i.e., health services, water availability). Selection of sites for workers’
basecamps shall be consulted with community representatives and approved by the supervision
engineer.

102.1.3 LAND REQUIRED FOR THE WORKS

1. The land available to the Contractors free of charge shall be that to be occupied by the
Permanent Works.
2. It is the responsibility of the Employer to ensure that this land is made available and, in the
event of objections being raised by the current occupiers or users, the Contractor shall
immediately report the circumstances to the Engineer.
3. The Contractor should note that notwithstanding unhindered access to the Site under this
Clause, he shall still observe the conditions with respect to maintaining services and ensuring
safety crossing the site and minimizing access restrictions due to works.
4. All necessary negotiations, agreements and payments for additional land for whatever purpose,
including that required for the Engineer’s facilities, shall be the responsibility of the Contractor
with approval from the supervision engineer. Additional land shall be obtained through
voluntary agreements with landowners/land users and properly documented.
5. The Contractor shall indemnify the Employer and the Engineer against any claims or
proceedings resulting from the occupancy and use of such areas of additional land.

102.1.4 TEMPORARY STRUCTURES AND FACILITIES

1. Acquisition of rights to land for the Contractor’s temporary facilities shall be the responsibility
of the Contractor.
2. Acquisition of rights to land for the Contractor’s temporary facilities shall be obtained through
voluntary agreements with landowners/users and shall be properly documented with prior
approval by the supervision engineer.
3. The Employer reserves the right to request copies of the original agreement with any land
owner.
4. Unless alternative arrangements are agreed at the time, when no longer required all
temporary facilities shall be removed and the land shall be restored by the Contractor.
5. The Contractor shall indemnify the Employer and Engineer against any claim or proceedings
resulting from the occupancy and use of such areas of additional land.
6. Along certain sections of the alignment of the road, restrictions exist on placing or locating
camps, temporary plant and facilities, for natural and/or environmental reasons.

102.1.5 TRANSPORT OF CONTRACTOR’S EQUIPMENT AND MATERIALS

1. Where the Contractor intends to use a particular route for the haulage of large quantities of
materials he shall consult well in advance with any affected communities and submit in
advance for the Engineer’s approval a plan including but not limited to the proposed route, the
existing condition of the pavement and bridges, the estimated number and type of vehicle
movements per day, a programmed for monitoring the condition of the pavement and
structures, and measures for limiting vehicle speeds and dust nuisance in built-up areas.
2. The Engineer reserves the right to disallow certain haul routes should these in his opinion
cause or be likely to cause unreasonable nuisance or hazards to the public.
3. The Engineer’s approval will not remove the Contractor’s obligations under the General
Conditions to prevent and repair damage to roads or his liability for compensation for any
accidents caused by his vehicles.
4. The Contractor’s shall include in the traffic management plan (MSIPs) relevant measures to
ensure traffic safety for the purpose of mobilization of contractor’s equipment and materials.

102.1.6 CLEARANCE OF CONTRACTOR’S FACILITIES AND REINSTATEMENT OF LAND

1. After expiry of the Defects Liability Period the Contractor shall clear away all his temporary
facilities including but not limited to offices, camps, storage and holding yards, workshops,
crushing and mixing plant, diversion and haul roads so that the land is returned to at least its
previous condition and, in the case of agricultural land, potential productivity. Clearance and
reinstatement shall include but not be limited to tasks such as the removal and disposal of all
wastes, disinfection of sewage disposal systems, demolition and removal of unwanted
structures, removal of metallic and concrete debris, removal and disposal of any soil
contaminated by diesel, bitumen or other polluting materials, ripping to relieve compaction,
grading, replacement of topsoil, and establishment of vegetative cover, as appropriate or as
directed.
2. Where improvements have been made such as land filling or installation of boreholes or
construction of buildings these may be retained subject to the agreement of the landowner if it
is privately owned.
3. The Employer reserves the right to inspect the site of any facilities established or used by the
Contractor in connection with the Works and to undertake any corrective measures necessary
to reinstate the land, and to recover the cost from monies due or to become due to the
Contractor.
4. Payment of any retention monies shall be dependent on the Engineer’s confirmation that
clearance and reinstatement have been carried out satisfactorily.

102.1.7 MEASUREMENT AND PAYMENT

Works prescribed in Contractor’s Facilities shall not be measured and paid for separately and shall be
deemed to be included in all other pay items of the contract.

102.2 MEDICAL ROOM AND FIRST AID FACILITIES

102.2.1 MEDICAL AND FIRST-AID FACILITIES

The Contractor shall provide and maintain throughout the duration of the Contract, a medical
examining room and sick bay together with all necessary supplies and equipment to be sited in the
Section VI – Fraud and Corruption 131
Contractor’s main camp. The rooms shall be used exclusively for medical purposes and shall be of
good quality construction with electric lighting and otherwise suitable for their purpose. The sick bay
shall have at least two beds, and shall be provided with adjacent washing and sanitation facilities.

The Contractor shall employ permanently on Site at least one fully trained medical aide, nurse or
para-medic who shall be engaged solely for medical duties.

The Contractor shall at his own expense provide first aid equipment at all camps and work sites to
the satisfaction of the Engineer, and shall ensure that at all camps and work sites where 40 or more
persons are engaged on the Works there shall at all times be a person qualified in first-aid with access
to appropriate first-aid equipment.

The location of the medical room and other medical and first-aid facilities shall be made known to all
employees by posting suitable notices at prominent locations around the site and by verbal instruction
upon recruitment.

The Contractor’s arrangements for complying with this Section shall be subject to the approval of the
Engineer and also to the approval of any qualified Medical Officer designated by the Government to
inspect or supervise medical arrangements on the Site.

The Contractor shall at his own expense provide relevant equipment to support the COVID-19
prevention protocols in the ESMP and testing kits for COVID-19, including ensuring clear referral
pathways for COVID-19 cases identified on site.

102.3 MOBILIZATION AND DEMOBILIZATION

102.3.1 DESCRIPTION

Mobilization, the Contractor shall perform all works necessary to transport equipment to the site and
furnish and install Plants to be used for all purpose necessary for the realization of the Works.

Demobilization; when the Contractor has moved out equipment that is no longer necessary, and when
the plants has completed its functions and the Contractor has dismantled the plants and moved out.
The area shall then be cleaned and temporary constructed offices, shops, accommodation, etc. of the
Contractor shall be dismantled properly to the satisfaction of the owner and acceptable to the
Engineer.

102.3.2 MOBILIZATION

1. Mobilized construction equipment including material testing equipment, shall mean owned or
leased equipment in good operating condition. Batching and Crusher plants completely erected
and certified operational by the Engineer fall under this definition. Testing equipment and
apparatus shall require the Engineer’s Certification and Approval.
2. Mobilized equipment required in the contract shall be duly listed by the Engineer for approval and
shall not be removed from the site by the Contractor without prior written approval by the
Engineer.

No later than thirty (30) days from the start of Contract, the Contractor shall prepare the initial listing
of the items specified in this Specification together with his assessment of the degree of
accomplishment for the Mobilization Phase. The final assessment or accomplishment shall be
undertaken by the Engineer prior to the start-up of critical work activities.

All Contractor’s mobilization costs such as planning and designing all temporary works and facilities
and making submittal to the Engineer, recruiting and transferring staff, obtaining all Government
licenses, permits, clearances, etc., clearing and grading areas for temporary and any other costs
involved in preparing to carry out the permanent works shall not be paid separately.

102.3.3 DEMOBILIZATION PHASE

On completion of the Project, the Contractor shall dismantle all improvements erected on the leased
areas; clear all to the satisfaction of the lot owners, rentals due fully paid and approved by the
Engineer.

102.3.4 BASIS OF PAYMENT

There shall be no separate payment for Mobilization and Demobilization. Costs for these activities are
deemed to be included in the bid price for various pay items.
