RESOLUTION EPPNOVNC AN ORDINANCE ESTABLISHING THE BAAO


COMMUNITY COLLEGE, PROVIDING FUNDS FOR ITS OPERATION AND
MAINTENANCE AND FOR OTHER PURPOSES

WHEREAS, the State shall protect and promote the right of all citizens to quality
education at all levels and shall take appropriate steps to make such education accessible to all;

WHEREAS, it is likewise the policy of the State to establish, maintain and support a
complete, adequate, and integrated system of education relevant to the needs of the people and
society, and that the State shall encourage non-formal, informal, and indigenous learning
systems, as well as self-learning, independent, and out-of-school study programs particularly
those that respond to community needs;

WHEREAS, Section 468(4xiii) of Republic Act 7160, otherwise known as the 199'l,Local
Government Code provides that one of the powers, duties, functions of the Sangguniang
Panlalawigan is to:

Approoe ordinances which shall ensure the fficient and ffictiae deliuery of the basic
seraices and facilities as proaided for under Section 17 of this Code, and, in addition to said
seraices andfacilities, shall: Subject to the aoailability of funds andto existinglazns, rules and
regulations, proride for the establishment and operation of aocational and technical schools and
similar post-secondnry institutions; and, with the approaal of the Department of Education,
Culture and Sports and subject to existing laws on tuition fees, fix reasonable tuition fees and
other school charges in educational institutions supported by the proaincial goaernrnent;

WHEREAS, the Provincial Government of Camarines Sur started and funded the
operation of Baao Community College in the year 2000 to cater the growing needs of the
iocality for an affordable and accessible tertiary education;

WHEREAS, the Sangguniang Bayan of Baao passed Resolution No. 2000-170 onJu.ly 12,
2000, requesting the Commission on Higher Education (CHED), Region V, for the recognition
of the newly established Baao Community College; Consequently, CHED issued Government
Recognition (GR) to the College on May 3,2004;

WHEREAS, CHED issued Memorandum Order (CMO)No.32, sedes of 20O6,providing


the Policies, Standards, and Guidelines Governing the Establishment and Operation of Local
Colleges and Universities (CLUs) by Local Government Units;

WHEREAS, in
compliance with the provisions of CHED Memo No. 32, the
Sangguniang Bayan of Baao enacted Municipal Ordinance No. 3, series of 2008, and
appropriated the amount of not less than Five Hundred Thousand Pesos (Php500,000.00) as
yearly subsidy to Baao Community College;

WHEREAS, however, despite of the enactment and appropriation in Municipal


Ordinance No. 03, the Local Government of Baao still failed to comply with Section 4 of CMO
32, which states: "There shall be a proaision for a regular annual appropriation from the local
goaernment unit to support and sustain the operation of the Local College/Unioersity", as it is the
Provincial Government that has a huge share in the expenses of the school;

WHEREAS, because of the financial constraint and realizing that the municipality
cannot attend to the growing needs of the College, the Sangguniang Bayan eventually passed
Ordinance No. 02, series of 2009, repealing the provisions of Municipal Ordinance No. 03, series
of 2008 and appropriating the Php500,000.00 subsidy to Baao Community Collgge as fund for
the Scholarship Program of the municipality in said school; /_

WHEREAS, with passage of the aforesaid Ordinance, the Provincial Government of


Camarines Sur is now vested with the sole authority to operate and maintain the College within
the territorial jurisdiction of the said municipality;

NOW, THEREFORE, on motion of Honorable Wilfredo Rex C. O1iva, jointly seconded


by Honorable Marcel S. Pan and Honorable Antonio T. Olaflo, be it -

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlalawigan in


session assembled, to approve, as it hereby approves, AN ORDINANCE ESTABLISHING THE
BAAO COMMUNITY COLLEGE, PROVIDING FUNDS FOR ITS OPERATION AND
MAINTENANCE AND FOR OTHER PURPOSES;

RESOLVED FURTHER, to enact and ordain, as it hereby enacts and ordains, the
following Ordinance:

BE IT ORDAINED by the Sangguniang Panlalawigan of the Province of Camarines


Sur, in Session assembled that:

Section 1. TITLE. This Ordinance shall be known as 'BAAO COMMUNITY


COLLEGE ACT".

Section 2. SCOPE. This Ordinance shall set the policies, standards and guidelines
governing the establishment and operation of Baao Community College in accordance with the
provisions of Commission on Higher Education (CHED) Memorandum Order No. 3, Series of
2006 and its Implementing Rules and Regulations (CHED Memorandum Order No. 04, Series of
2007), and other pertinent laws and issuances.

Section 3. ESTABLISHMENT OF THE BAAO COMMUNTY COLLEGE. There is


hereby established in the Municipality of Baao, a higher education institution which shall,
hereinafter, be known as BAAO COMMUNITY COLLEGE. The existing Baao Community
College shall serve as the foundation of the herein created community college, subject to the
guidelines set forth under CHED Memorandum Order No. 32, Series of 2006.

Section 4. BAAO COMMUNITY COLLEGE FOUNDATION DAY. The Foundation


Day of the College shall be celebrated every July 12, reckoned from the date of the passage of
the resolution requesting the Commission on Higher Education for its recognition onJ:uly 1,2,
2000.

Section 5. SCHOOL SITE. The College shall continue occupying its present site situated
inside Baao Central School campus in proper coordination with the Department of Education.
The Administration of the Baao Community College and the Provincial Government of
Camarines Sur shall cause the immediate acquisition of a permanent school site considering the
a) geographical location, b) accessibility, and c) zoning.

Section 6. COURSES TO BE OFFERED. In addition to the existing courses of Bachelor


of Secondary Education (majors in English, Science. Mathematics, and Sociai Studies), Associate
Computer Technology, and Bachelor of Science in Industrial Technology (majors in
Automotive and Electronics Technology, the Board of Trustees of Baao Community College is
hereby authorized to seek approval from CHED for the College to offer Bachelor of Elementary
Education starting S/Y 201,0-2011. Other courses may be offered by the college upon approval
of the Sangguniang Panlalawigan and in accordance with CHED Memo No. 32, Series of 2006.

Section 7,THE BOARD OF TRUSTEES OF THE BAAO COMMUNITY COLLEGE.


The Governing Board of the Baao Community College shall be vested in its Board of Trustees
(BOT) which shall be composed of the following: Chairman, the Governor of the Province of
Camarines Sur; Vice-Chairman, the President of the College; and seven (7) members
composed of, but not limited to, the President of the Faculty Association, President of the
Supreme Student Council/Government, President of the Alumni Association, Chairman of the
Sangguniang Panlalawigan Committee on Education, Association of Local
Colleges/Universities (ALCU) representative, Commission on Higher Education with rank not
lower than Director, and representative of the Local Government of Baao with a rank not lower
than Department Head. The CHED, ALCU, LGU Baao representatives shall be appointed by
the Board for a specific term, provided, that the representatives of the faculty, the student body
and alumni shall serve co-terminus with their respective terms of office.

Section 8. POWERS AND FUNCTIONS OF THE BOARD OF TRUSTEES. The Board


of Trustees shall promulgate policies in accordance with the declared state policies on higher
education as well as the policies, standards and thrusts of the CHED under Republic Act No.
7722 and other pertinent laws and local ordinances.

Section 9. THE COLLEGE ADMINISTRATION. The administration of the Baao


Community College shall be vested in the President who shall render fulI-time service. The
Board of Trustees upon the recommendation of a duly constituted Search Committee shali
appoint him/her. He/She shall have a term of four (4) years and shall be eligible for
reappointment for another term on1y. The President shall hold an appropriate earned doctoral
degree with at least five (5) years of relevant administrative experience. The Vice-President(s),
Dean(s), Directors, Registrar, Administrative Officer, Accountants, faculty, non-teaching
personnel and other officials shall be appointed by the President subject to the confirmation of
the Board; provided that the Vice-President for Academic Affairs must be a holder of an earned
doctoral degree; provided further, that their appointments sha1l be pursuant to existing Civil
Service Laws, Rules and Regulations.

Section 10. THE INTERIM ADMINISTRATION. The incumbent OlC/Administrator,


faculty and staff of the Baao Community College shall continue to hold their respective
positions until such time that the College has complied with the requirements set forth under
ED MEMORANDUM ORDER No. 32, Series of 2006 and the Board of Trustees shall have
beei convened.

Section 11. THE SEARCH COMMITIEE FOR PRESIDENT. The Search Committee for
President (SCP) shall have five (5) members to be appointed by the Board of Trustees with a
member each representing the Civil Service Commission (CSC), Academe, business or industry
sector, Association of Local Colleges and Universities (ALCU) and the Commission on Higher
Education (CHED). They shall elect a Chairman and Vice-Chairman from among themselves.
Six (6) months before the expiration of the incumbent OlC/Administrator/President, the Board
of Trustees shall appoint a Search Committee for President.

Section 12. PERSONNEL COMPLEMENT. In the interim, pending full compliance with
CHED Memorandum Order No. 32, series of 2006 and Subject to Civil Service Law, Rules and
Regulations, the following plantilla positions are hereby created to efficiently and effectively
maintain the operation of the Baao Community College, to wit:

Section 13. APPROPRIATIONS. The Provincial Goverrunent of Camarines Sur shall


include in its Annual Budget the funding necessary for the operation and maintenance of the
aao Community Coilege.

Section 14. REPEALING CLAUSE. Any local ordinance/local executive orders or local
issuances inconsistent with the provisions of this ordinance are hereby repealed or modified
accordingly.

Section 15. SEPARABILITY CLAUSE. If any part or provision of this Ordinance shall
be held invalid or illegal by competent authorities, other provisions thereof, which are not
affected thereby, shall continue to be in full force and effect.

Section 16. EFFECTMTY. This Ordinance shall take effect immediately.

Section 17. Let copies of this Resolution/Ordinance be furnished the Honorable


Governor Luis Raymund F. Villafuerte, Jr. for his approval; the Commission on Higher
Education (CHED), Region V; the Baao Community College; and all concerned for their
information.
