PROJECT: PROPOSED DRAINAGE AT KIDURONG INDUSTRIAL ESTATE (SMDS)

AT BINTULU
CONTRACT NO: BDA/CT/65/2020

Subject: Pilot Trenching

We received the Superintending Officer Representative (SOR) letter reference

:(14)BDA/CT/65/2020-407(Vol.4) dated 28th December 2022 (which was hand collected from
BDA on 30th January 2023 after being informed by your staff) and which attached the Minute of
Coordination Meeting dated 15th November 2022 (where we were not invited to attend) and the
Minute of Project Site Meeting No.4 dated 22nd November 2022.

In view of the lateness in the issuance and receipt of the said minutes, we provide the
following for your advice/decision:
a) We have no comment on the said coordination meeting dated 25 th November 2022 as we
were not present then;
b) The said project site meeting No.4 did not fully reflect what was discussed, example:
i. stated in paragraph 2 and 3 of our letter to the Superintending Officer (SO) of letter
reference : WUSB/BDA/CT/65/2020(126) dated 15th December 2022.
ii. the physical work variance in item 4.3 is not reflective of the factual matrix
because relevant EOT had not been granted. A more correct representation would
be as per S-Curve attached.
iii. item 5.3 - we had approval chit signed for completed work asyour staff seem not
familiar with request form RFI (which were prepare but left unsigned)
iv. the work in item 5.5 (second paragraph) had been done, exhibited by various
meeting with BDA and the service providers.
v. We could not carry out the “request to do Pilot Trenching” because:
- it is beyond our Scope of Works
- there was no SOI
- the location were not indicated or shown.
vi. In the event we are instructed to carry out Pilot Trenching, please advised that the
cost is RM________________.
vii. If item (vi) above is to be done, this letter also serves as a notice under Clause 41.1
and 43.1 of the FOC.
viii. Please also note that we had carried out the necessary inquiries from the various
Authorities on the existing services and hence all the discussion with the
Authorities (and BDA) in the course of this contract.
