Dear Chin,

SHOW CAUSE AND SUSPENSION LETTER

This Letter serves a formal documentation for the following reported misconducts against you;

1. CHARGE OF MISCONDUCT

It has been brought up to the Management that you were alleged to commit the following misconducts in the
course of your duty as an Assistant Supervisor for Sandakan District - Sekong Zone;

CHARGE OF MISCONDUCT NO.1


You had submitted false information in the “Weekly R02 (Road Shoulder) Workdone Record” for District-
Sandakan-Sekong dated 15th to 21st October 2021, by reporting that the R02 Routine Work was completed
for the following road lengths, of which the actual findings at the said locations on 30 October 2021 by
Area Manager - Mr Henry Hiew showed that the routine work was incomplete;

Based on the above allegation, you are hereby deemed to violate the Company’s Policies & Regulations;

2.1 - GRAVE MISCONDUCT (ATTEMPT TO FALSIFY RECORDS / DOCUMENTS)

The alleged offence above is a violation of the Company’s rules and regulation As stipulated in Article 8,
subsection 8.2.1; Clause A: Grave Misconducts, Sub-Clause No.3 - “Prohibited to damaging, falsifying,
destroying any of the company’s properties, documents, records, equipments, furniture & etc. Any forgeries
of the attestation / signatures of any of the Company’s authorities and falsification / manipulations of any
contents / numerals of the Company’s official forms / documents / systems are subjected to instant
dismissal and legal action.”

2.2 - MAJOR MISCONDUCT (NEGLIGENCE OF DUTY)

The alleged offence above is a violation of the Company’s rules and regulation As stipulated in Article 8,
subsection 8.2.1; Clause B: Major Misconducts, Sub-Clause No.3 - “Failure to perform work assignments
or refusal to carry out tasks assigned by the Superior without justifiable reasons; incompetence in work
standards and performances; performing inefficiently or unsatisfactorily, or failing to apply effort on the
job, including intentionally showing down work or productivity and deliberately restricting output.”

2.3 - PUT COMPANY AT RISK FOR BREACH OF CONTRACT

Your alleged actions had put the Company at risk of breaching the existing road concession contract with
JKR for the Sekong Zone and causing possible enormous loss in revenue for the Company.

2.4 - BREACH OF OBJECTIVITY

Your alleged actions had indicated that you had breached the existing Standard Operating Procedure (SOP)
for Routine Maintenance Works below;

2.4.1 - Work Instruction (GLOB-W10) titled “Routine Inspection”

2.4.1.1 Work Procedure (iv) - The Inspector shall also inspect, identify and note down all defects and
damages to road pavements, shoulders, drains, road furniture and structures.
2.4.1.1 Work Procedure (v) - In the case of defects or damages that requires urgent attention, the
Inspectors shall inform the relevant Manager immediately through the communication equipment
provided for necessary action.
2.4.1.1 Work Procedure (vi) - The Inspector shall report daily to the Section Manager of all defects
identified for his necessary action.

2.5 - BREACH OF INTEGRITY

Your alleged actions had indicated that you were attempting to falsify reports and false reporting of
Supervisor’s Daily Reporting and issuance of Non-Compliance Record for the Sekong Zone. In addition,
your alleged action could be interpreted as dishonest act, breach of vision and mission statement and our
Company’s code of ethics.

2.6 - BREACH OF PROFESSIONAL COMPETENCY, DUE CARE & JOB SPECIFICATION

Your alleged actions had indicated that you failed to carry out the responsibilities outlined in the ISO
Document Ref. No: GLOB-J03 (Supervisor) - “The Supervisor reports directly to the Area Manager and is
responsible to carry out routine inspections and take required photos, to record his observations onto
the Supervisors’ Daily Report, to upload photos taken daily, and key-in Weekly Progress Report in the
company website. “

2.7 - BREACH OF PROFESSIONAL BEHAVIOR & CONDUCT

The alleged false reporting and falsifying reports given by you were pervasive. They not only distorted the
true and fair view of the site condition, but they had resulted in breach of law and regulations set by JKR
and Government in up-keeping the site conditions. The result of the false reporting and misleading of
reports could be a violation of law and regulation and result in accidents, mishaps and damage in
organization reputation.

3. You are, therefore required to revert a REPLY LETTER to the undersigned with your written explanation on
or before 18th November 2021 as to why further disciplinary action should not be taken against you on the
alleged acts of misconducts. Should you fail to reply accordingly, the Company would have no alternative but to
assume that you have no explanation to provide. Hence, the Company shall not hesitate to institute further
disciplinary against you accordingly within the purview of Sabah Labour Ordinance, which is DISMISSAL for this
Case in discussion.

4. In view of the above allegations that considered as grave misconduct, you are suspended from work, for
seven (7) days with half wages effective 16th November 2021 until 23rd November 2021 while waiting for
further investigation to be held. You are also reminded that the duration of your suspension of work may be
extended and it is automatically without notice at full pay after the seven (7) days’ suspension period expires.

4.1 During the suspension period:

4.1.1 You are required to provide your telephone number, latest address and personal e-mail
address to be contacted by the Company. You are also required to be contacted at any time
within the period of suspension of the service if it is required by the Company to make an
investigation in this case.

4.1.2 You are prohibited from entering the company premises or any company premises without the
approval of the Management.

4.1.3 You are to return the Company Vehicle with the plate no. SAC3975A (previously assigned to
you) to the Area Manager - Mr. Henry Hiew by 15th November 2021.

Please acknowledge your acceptance of this letter by signing and returning the duplicate copy to the
undersigned.
